CONSERVATION COMMISSION MEETING MINUTES
MONDAY, JULY 17, 2017

A meeting of the Conservation Commission was held on Monday, July 17, 2017. Ms. Brown called the meeting to order at 7:02 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:02 PM (NOI-DEP #143-0924) PUBLIC HEARING CONTINUED: Gilboa Court Extension/GOGOLINSKI, CAROL, A. & COGLEY, WILLIAM S.
Ms. Brown stated that the applicant has asked for a continuance.
Ms. Van Roo made a motion to continue the public hearing for (NOI-DEP #143-0924), Gilboa Court Extension, Carol Gogolinski and William S. Cogley to August 7, 2017 at 7:00 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:03 PM (RDA) PUBLIC MEETING: 358 Southwest Main Street/PROVENCAL, BRIAN.
Ms. Brown opened the public meeting. Mr. Provencal joined the meeting. Mr. Zisk presented photos of the site. Mr. Provencal filed an RDA to remove the existing shed and erect an 18’ x 22’ shed. There will be no digging. The foundation will be a poured concrete slab. Mr. Provencal plans on installing straw wattles.
Ms. Van Roo made a motion to issue a negative RDA for 358 Southwest Main Street, Brian Provencal. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:20 PM (NOI-DEP #143-0906) PUBLIC HEARING CONTINUED: 439 Northeast Main Street, 34 & 36 Davis Street/JMT SLEEPY HOLLOW, LLC, & FITZPATRICK, JAMES.
Bruce Williams of Guerriere and Halnon joined the meeting. Most of the revisions to the plan made since the last meeting have to do with the references to MassDOT standards. He has introduced two flat top ridges in the area where the Commission had concerns. The water loop is shown down to Davis Street and a separate plan has been created for the water loop to show the wetland crossing in more detail. The layout is essentially the same as was previously presented. The Town Engineer has completed his review of the drainage system and has stated that all of his comments have been addressed. The packet submitted in June included a letter of support from the Water/Sewer Dept. One more revision to the plans will be made; the Planning Board has asked for a street light to be shown at the central mailbox area.
At the last meeting, the Commission asked for a staked center line for the water loop. That has not been staked.
Mr. Williams described the construction of the crossing in detail. The construction of the crossing should take only one day. The schedule was reviewed. Ms. Van Roo asked for a spec sheet for the grass fiber matrix.

Dennis Michalik, 415 Northeast Main Street stated that in September, the brook trout come into that area to breed. He is concerned that this project will affect that. He also cannot understand that the stormwater drainage calculations take into consideration the 24 house lots. Ms. Brown stated that the Town Engineer has reviewed the stormwater calculations. Mr. Michalik explained how there was an issue with the runoff from the school project. He would like to know what recourse exists if the brook fails as a cold water fishery. He feels the brook will be starved when this project goes in.
Ms. Van Roo made a motion to continue the public hearing for (NOI-DEP #143-0906) 439 Northeast Main Street, 34 & 36 Davis Street, JMT Sleepy Hollow, LLC and James Fitzpatrick to August 7, 2017 at 8:15 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:53 PM (NOI-DEP #143-0933) PUBLIC HEARING: North Street/TOWN OF DOUGLAS.
Ms. Brown opened the public hearing. Jim Noyes of Greenman-Pederson and Laura Krause of Nover-Armstrong joined the meeting. Mr. Noyes gave the background on the Emergency Order of Conditions that was before the Commission several months ago. The crack on the top of the wall is approximately 8”. The temporary wall will not hold.
The concrete block and existing wall will be taken apart. They will excavate out into the road and North Street will be closed during that time, for approximately six weeks. All equipment will stay out of the water. The proposed wall will be mortared and will be constructed using stone from the existing wall. They are looking at widening the bridge by extending it on both sides. There will be at least one sidewalk.
Ms. Krause described the resource areas.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0933) North Street, Town of Douglas. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Request for a Certificate of Compliance: Jeromy Durand, 61 Oak Street, (DEP #143-0903). Mr. Zisk presented photos of the site. The Commission reviewed the As-Built. A shed was not built. Mr. Zisk called the applicant and left a message asking if he is planning to build the shed. Mr. Durand joined the meeting and stated that he will not be building a shed.
Ms. Van Roo made a motion to issue a Certificate of Compliance for Jeromy Durand, 61 Oak Street (DEP #143-0903). Ms. Sharkey seconded the motion. Vote: Unanimous.
2. Request for a Certificate of Compliance: Christopher & Concepcion Goodwin, 11 Manzi Way, Shady Knoll Estates, Lot #27 (DEP #143-0420). Mr. Zisk is still waiting for an As-Built.
3. Minutes: May 15, 2017.
Ms. Van Roo made a motion to approve the May 15, 2017 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Unanimous.

8:24 PM ADJOURNMENT:
Ms. Van Roo made a motion to adjourn the meeting at 8:24 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
