CONSERVATION COMMISSION MEETING MINUTES
MONDAY, SEPTEMBER 18, 2017

A meeting of the Conservation Commission was held on Monday, September 18, 2017. Ms. Brown called the meeting to order at 7:00 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo (arrived 7:08), Stephen Zisk (Conservation Agent)
ABSENT:

7:00 PM (RDA) PUBLIC MEETING CONTINUED: 301 Southwest Main Street/LYONS, LEO.
Mr. Lyons and two others joined the meeting. All the work to reconstruct the wall will be done by hand. There will be no footings. The work will be done in 1.5 weeks. The Commission asked that straw wattles be used for erosion control on both sides, up to the edge of the water. Mr. Zisk is to be notified to inspect the erosion control before work is started.
Ms. Sharkey made a motion to issue a negative RDA for Leo Lyons, 301 Southwest Main Street with the condition that straw wattles be staked in before construction begins. Mr. Greco seconded the motion. Vote: Aye-3, Ms. Van Roo abstained.

7:10 PM (RDA) PUBLIC MEETING: 17 Hough Road/ LARAMEE, REBECCA.
Ms. Brown opened the public meeting. Ms. Laramee joined the meeting. She is planning to remove deteriorating stairs and open up the area where the wall is deteriorating to create a sand ramp into the water. She will reuse stones to repair the wall. When the water is drawn down, the water line is 100’ back from her wall. The Commission reviewed photos of the site.
Ms. Laramee plans to hand excavate and use a backhoe for the large rock. The backhoe will not be stored on site. Straw wattles will be staked 10’ from the wall. Ms. Laramee was told to notify Mr. Zisk before work is started so that he can inspect the erosion control.
Ms. Van Roo made a motion to issue a negative RDA for Rebecca Laramee, 17 Hough Road with the condition that the excavator be stored off the property and does not go past the grass. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:48 PM (NOI-DEP #143-0935) PUBLIC HEARING: 58 Chestnut Street/ DAPRATO, ALFRED.
Ms. Brown opened the public hearing. Norman Hill of Land Planning, Inc. and Frank Crowley, owner of the property joined the meeting. Mr. Hill presented the plans. There are three lots. The owner plans to give two to the Town or issue a no-build covenant on the two lots once this plan is approved. The riverbank and wetlands have been flagged. The proposed house is 28’ x 36’ with a garage 22’ x 22’.
Mr. Hill was asked to submit wetland delineation and documentation on how he complies with section10.57 of the Wetlands Act. Only one lot is on the NOI. Additional abutters need to be notified.
Ms. Van Roo made a motion to continue the public hearing for (NOI-DEP #143-0935), Alfred Daprato, 58 Chestnut Street to October 2, 2107 at 7:45 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Violation Notice: Cory & Natalia Lopes, 32 Linden Street. Mr. and Mrs. Lopes joined the meeting. Mr. Zisk showed pictures of the site. The Lopeses are not the original owners. The corner of the house is 60’ from the wetlands. The disturbance is on the left side next to the driveway. Three years ago, trees were cut and recently, clean fill laid down to create a lawn. Ms. Van Roo feels that the fill should be excavated. Before the fill is scraped back, straw wattles need to be installed that wrap around the back. Mr. Lopes needs to install the wattles by Wednesday. The excavation needs to occur within three weeks. The Lopeses were told to notify Mr. Zisk before work is started so that he can inspect the erosion control.
The Lopeses were told they need to file a Notice of Intent (NOI) if they wish to create a lawn in that area. The Commission will do a site walk if and when an NOI is filed.
Ms. Van Roo made a motion to issue a fine in the amount of $100. Ms. Sharkey seconded the motion. Vote: Unanimous.
2. Request for a Certificate of Compliance: Margaret Banaghan c/o Michael McCaffrey, Esq., 125 Walnut Street, Lot #2 (DEP #143-0786). JP Connelly of Andrews Survey and Engineering joined the meeting. He presented a new as-built plan and photos. He supplied a verification letter. A tree was cut and it fell into the wetlands. It was cut up and put over on the left side. The right side has been raked and cleaned.
Ms. Sharkey made a motion to issue a Certificate of Compliance for Margaret Banaghan c/o Michael McCaffrey, Esq., 125 Walnut Street, Lot #2 (DEP # 143-0786). Mr. Greco seconded the motion. Vote: Aye-3, Ms. Van Roo abstained.
3. Request for a Certificate of Compliance: Christopher Robert, 146 Monroe Street (DEP #143-0850). Margaret Bacon of Civil Site Engineering presented an as-built for a shared driveway that was built in 2014. It will remain a gravel drive and no additional material will be brought in. Mr. Zisk presented a video of the site.
The original Order of Conditions called for a paved driveway. The driveway was constructed 12’ wide around a tight curb at the wetland in lieu of 18’, which does not provide sufficient width for snowplowing. Ms. Bacon must speak to the integrity of the driveway and make the driveway 18’ wide where the plan states it should be 18’ wide. Ms. Bacon stated that only a small section of retaining wall was installed because they were able to stabilize the slopes without them. The retaining wall will need to be extended in order to maintain a stable slope for the 18’ wide drive.
4. Minutes: August 7 and August 21, 2017
Approval of the August 7 and 21, 2017 Conservation Commission meeting minutes was deferred to the next meeting.

OTHER BUSINESS:
-10 Colonial Road, Violation: Norman Hill of Land Planning, Inc. joined the meeting. The original plan had a 25’ no disturb zone. Mr. Hill showed the area that has already been excavated, which had not been flagged as wetlands. He stated that no wetlands have been excavated. Ms. Brown presented photos of the site. Mr. Hill stated that going forward, they agree to restore the 25’ no disturb zone. He will submit a planting plan at the October 2, 2017 meeting.
Mr. Hill asked the Commission’s permission to continue with the plan as originally approved. The Commission asked for a barrier to delineate the wetlands. Mr. Hill suggested boulders.
-GBI, 208 Yew Street, Violation: Ms. Sharkey recused herself. Luis Tusino of Guaranteed Builders Inc. (GBI) joined the meeting. Ms. Brown noticed that the road has been continued up to the proposed building site (#8 of the construction sequence) without completing the replication area (#6 of the construction sequence). She notified GBI last Thursday that the construction sequence was not followed. Mr. Tusino stated that he called Mr. Zisk who said that “as long as you are 100’ away from that, you can continue.” Mr. Zisk did not recall the conversation. Regardless, the replication was planted prior to this meeting and meets the approval of the Commission.
Ms. Brown stated that the erosion control has been removed, and the gravel driveway can wash into the replication area. She asked that the erosion control be re-installed per the plan. Mr. Zisk spoke with Karen, and he gave her the go ahead to remove erosion control on the uphill side. Photos of the site were shown.
Ms. Van Roo made a motion to issue a fine for $100 and erosion controls need to be re-installed within the week according to the plan. Mr. Greco seconded the motion. Vote: Aye-3, Ms. Sharkey abstained. Ms. Sharkey rejoined the meeting.
-Michael Moore joined the meeting. He stated that he is buying a house at 24 Perry Street. He was told by his counselor that a Certificate of Compliance was going to be issued tonight. They are planning to close October 13, 2017. Mr. Moore will need a request, an as-built and an engineer’s request for a deviation. Mr. Zisk will take photos once he receives the paperwork.
-Sleepy Hollow, Road Work: Andy Leonard joined the meeting. He asked to know if they can start work on the subdivision road and the retention basin. They will install erosion controls and erect signs. G&H staked the limits today. They will not be constructing the loop until next year. Mr. Leonard was told that Mr. Zisk has to approve the erosion controls before work begins.

Ms. Van Roo made a motion to adjourn the meeting at 9:26 PM. Mr. Greco seconded the motion. Vote: Unanimous.
