October 15, 2018 Conservation Commission meeting

A meeting of the Conservation Commission was held on Monday, October 15, 2018. Ms. Sharkey called the meeting to order at 7:05 PM. She stated that the meeting is being recorded.

PRESENT: Tracy Sharkey (Chair), Katiegrace Dudley, Michael Greco (Vice Chair)
NON-VOTING: Stephen Zisk (Conservation Agent)

7:05 PM PUBLIC HEARING (NOI-DEP#143----): 0 Wallum Lake Road/ASD WALLUM MA SOLAR, LLC.
Ms. Sharkey opened the public hearing. Jeff Brandt of TRC, Lawrence Cook of AMP and Maria Firstenberg joined the meeting. Mr. Brandt stated that they have been looking at the site and assessing the environmental resources and wetland boundaries. They became aware of a set of previously delineated wetland boundaries, so they came to the Conservation Commission to confirm their boundaries. The site is surrounded by wetlands to the north, west and south. They would like Douglas’ consultant to walk the site with their consultant to review the boundaries. The goal is to keep the entire project outside the 100’ buffer. Mr. Brandt gave Ms. Sharkey a check to pay for the consultant.
Mr. Zisk stated that in 2004, the original ANRAD was done for the proposed, approved subdivision. The delineations of the wetlands on this proposal were different than the delineations from 2004. Art Allen of EcoTec will work with the applicant’s consultant.
Richard Forget of 36 Birch Hill Road asked if the area needs to be rezoned. Ms. Sharkey stated that it does not. She directed Mr. Forget to the bylaws and the Building Commissioner.
Denise Kinsley of 275 Wallum Lake Road asked if a meeting with the Planning Board was scheduled. The Planning Board public hearing will be 10/23/18.
Jeanne Lawrence of 119 Shore Road asked what the impact will be on the area, will the project involve removing trees, will the flow of water to the lake increase, and will the project be visible. Ms. Sharkey and Mr. Zisk explained the jurisdiction of the Commission. Mr. Brandt stated that Ms. Lawrence’s questions will be better answered at the Planning Board’s public hearing. Ms. Lawrence asked if trees are removed, would their removal affect the wetlands. Ms. Sharkey answered it would not if they are 100’ away from the wetlands.
Jean Forget of 36 Birch Hill Road stated that there are now three streams on the site that flow continuously.
Ms. Dudley made a motion to continue the public hearing for 0 Wallum Lake Road, ASD Wallum MA Solar, LLC to November 5, 2018 at 7:00 PM. Mr. Greco seconded the motion. Vote: Aye-2.

Bill Morris of Civil Site Engineering joined the meeting to present the revised plan which shows a narrower driveway, erosion controls staked out, and a well line added to the plan. There is now more impact to the buffer because, when they went out to refresh the wetland flags, they found an intermittent stream. Mr. Zisk has checked the flags.
Mr. Greco made a motion to close the public hearing and issue an Order of Conditions for James and Suzanne White, 41 Hemlock Street (NOI-DEP#143-0963) with the standard conditions. Ms. Dudley seconded the motion. Vote: Aye-2.

Approval of the September 17, 2018 Conservation Commission meeting minutes was deferred to the next meeting.

Jeanne Lawrence expressed interest in joining the Commission. She has a home on Wallum Lake, but her residence is in Rhode Island. The Commission stated that she would not be able to join the Commission unless she was a registered voter in Douglas.
Mr. Zisk stated that he received a complaint about someone taking down trees on Shore Road and also regarding a drainage issue. He received some photos. Ms. Sharkey suggested Mr. Zisk investigate and report on the issues on 11/5/18.

Mr. Greco made a motion to adjourn the meeting at 7:33 PM. Ms. Dudley seconded the motion. Vote: Aye-3.
