PLANNING BOARD MEETING MINUTES
TUESDAY, JULY 9, 2019

A meeting of the Planning Board was held on Tuesday, July 9, 2019. Mr. Marks called the meeting to order at 7:01 PM and announced that the meeting is being recorded and will be available on cable and on the website.

ATTENDANCE:
PRESENT: Ernest Marks (Chair), Michael Greco, Jake Schultzberg, Aaron Socrat, Tracy Sharkey (Vice Chair), Les Stevens, Michael Zwicker

NON-VOTING: William Cundiff (Town Engineer)

7:01 PM PUBLIC HEARING: JESSICA RECORE (AA-190528) APPLICATION FOR AN ACCESSORY APARTMENT SPECIAL PERMIT, 5 Manchaug Street.
Mr. Marks opened the public hearing. Ms. Recore joined the meeting. She moved into the property 4/2/19 and will be making no changes to the accessory apartment, which will be occupied by her mother.
Ms. Sharkey made a motion to close the public hearing and grant the Accessory Apartment Special Permit (AA-190528) for Jessica Recore, 5 Manchaug Street. Mr. Zwicker seconded the motion. Vote: Aye-7.

7:05 PM ANR PLAN: AARON SOCRAT (#2019-07), 49 Lindberg Avenue.
Mr. Socrat recused himself. Byron Andrews of Andrews Surveying and Engineering joined the meeting. He stated that the plan shows proposed buildings, which are only for the illustration purposes of discussion. The mylar does not show the proposed buildings.
Mr. Socrat is hoping to separate out two buildable lots with frontage on Southwest Main Street from 7 acres. Wetlands and the flood zone determine the position of the proposed dwellings. They intend to apply for letters of map amendments to remove an area from a flood zone.
Aaron Socrat of 49 Lindberg Avenue stated that he has a buyer who recognizes the difficuties the lots have. He will not be registering the ANR until the flood zones and Conservation Commission are satisfied.
Mr. Cundiff stated that the issue with the ANR is practical access. Strictly by engineering, the mapping shows that they do not have access. Mr. Cundiff agrees with Mr. Andrews that the topography would suggest that the flood plain would go around the hills, but that is not what it is today. Lot 1 looks like it may have access to the buildable portion. Lot 2 has an 11% slope.
Local regulations require that the lots meet AASHTO requirements for sight distances, and lot 1 has 175 feet. Mr. Socrat stated that the driveway can be moved to increase sight distance. Ms. Sharkey stated that 50’ would place the driveway right on the wetland line. A discussion was held.
The applicant decided to withdraw, without prejudice.

Ms. Sharkey made a motion to accept the withdrawal, without prejudice, for the ANR plan for Aaron Socrat (#2019-07), 49 Lindberg Avenue with the condition that the fee for reapplication will be waived for up to one year. Mr. Zwicker seconded the motion. Vote: Aye-6.

7:28 PM ANR PLAN: TOD & NANCY PORTER (#2019-08), 77 Martin Road.
Ms. Porter joined the meeting and stated that they are looking to split 77 Martin Road from the house lot. Mr. Cundiff stated that the existing dwelling does lie within the building setback. Approval of the ANR may have an impact on any pre-existing, nonconforming status. The remainder of his comments have been addressed. A discussion was held.
Ms. Sharkey made a motion to endorse the ANR plan for Tod and Nancy Porter (#2019-08), 77 Martin Road. Mr. Greco seconded the motion. Vote: Aye-6.
Mr. Socrat rejoined the meeting.

Mr. Marks stated that the applicant has withdrawn the application.

DISCUSSION:
1. Medicinal Alternatives, 120 Gilboa Street (SPR-170419). Tim St. Germain of Medicinal Alternatives joined the meeting. Mr. St. Germain stated that the Building
Commissioner pointed out in May that there is roof mounted equipment, and during the site plan review, it was stated that there would be no exterior alterations. The decision did not specifically say that no exterior improvements were allowed. All the changes/ alterations are already built. The Building Commissioner suggested that the applicant come back before the Planning Board for input to see if a modification of the Special Permit is needed.
Mr. St. Germain reviewed all the exterior alterations, including installation of a carbon dioxide bulk storage tank on an existing pad next to the chimney, and installation in March of commercial air units HMUA 1 and 2 and MAU 1. The 2017 Building Permit included this equipment. A discussion was held.
Ms. Sharkey asked to see a letter from the Zoning Enforcement Officer, a copy of the Special Permit that was granted, and the plan that was issued.
Mr. Cundiff stated that an option for the applicant is to request a modification of the Special Permit. They would need to reopen the public hearing and submit something that quantifies the changes.
Scott Duncan of 106 Gilboa Street reiterated that during site plan review, it was stated multiple times that there would be no modifications to the outside of the building. All the equipment can be seen from his property. Mr. St. Germain stated that the three cooling towers cannot be seen from Mr. Duncan’s property.
Mr. Duncan stated that the exhaust units on the roof are listed on the permit as “fume exhaust”. Mr. St. Germain stated that all fumes will be filtered. Nuisance complaints go directly to the State’s Board of Health.
Mr. Duncan stated that there were also modifications done to the building’s power. Mr. St. Germain stated that the electric company maintains their infrastructure.
2. Guaranteed Builders & Developers/Pyne Sand & Stone: 37 Glen Street (ER-180312). Ms. Sharkey recused herself. Murray Bristol and Andy Leonard of Pyne Sand & Stone joined the meeting and presented a revised plan based on groundwater elevations. Mr. Leonard stated that they lowered the site 4’-5’ and did away with the retaining wall on the back portion of the property by creating a 2:1 slope from the property line.
Mr. Cundiff stated that test pit TP-1B clearly states that the water table is at 500’. The monitor well MW-1B establishes it at at 494’. The applicant has excavated down to 505’, which is less than the required 10’ offset from high groundwater. Mr. Leonard stated their position that TP-1B is the same pit as MW-1B and the high groundwater is at the same elevation as was determined by Allen Engineering. If that is the case, Mr. Cundiff stated that he is comfortable with the plan.
Mr. Cundiff suggested that the applicant have their engineer prepare an explanation as to what the bust was and stamp it.
Mr. Zwicker made a motion to accept the plan as submitted by Guaranteed Builders & Developers/Pyne Sand & Stone: 37 Glen Street (ER-180312) with the condition that the Town Engineer is satisfied by the applicant’s engineer’s certified explanation of the high groundwater determination at TP-1B. Mr. Greco seconded the motion. Vote: Aye-6.
Ms. Sharkey rejoined the meeting.
3. Lakeside Zoning DLTA Project. Mr. Cundiff stated that he received an email from Central Mass. Regional Planning Commission (CMRPC) reviewing this task.
Mr. Stevens left the meeting.
4. ZBA Application: Anthony and Sarah Bucciarelli, 85 & 82 Peters Cove Road. Ms. Sharkey stated that the applicant is looking to replace both cottages with one year- round house and two-car garage. A discussion was held. The Board had no objection to the application.
5. ZBA Application: Leslie Stevens, 131 Franklin Street. Mr. Socrat stated that the applicant is looking to replace a dwelling and is asking for relief on one side. The Board had no objection to the application.
Mr. Stevens rejoined the meeting.
6. Voucher: CMRPC.
7. Minutes: June 11, 2019.
Approval of the June 11, 2019 Planning Board meeting minutes was deferred to the next meeting.

OTHER:
Mr. Cundiff stated that at the last meeting, the Board decided to split the solar decommissioning consulting services. Both consultants modified their proposals. Mr. Cundiff ran it by both developers. He has not heard back from Wallum Lake Solar. Douglas Renewables was fine with the modifications therefore, Mr. Cundiff issued a Notice to Proceed for that one.
Ms. Sharkey read some public hearing notices from Webster and Dudley.
Mr. Cundiff asked the Board to review stormwater management documents. Mr. Cundiff will ask the engineer to give a presentation to the Board and a summary of the changes.
Ms. Sharkey asked to know about the rights to the parking lot being used by Gilboa Properties.

Ms. Sharkey made a motion to adjourn the Planning Board meeting at 8:43 PM. Mr. Socrat seconded the motion. Vote: Aye-7.
