PLANNING BOARD MEETING MINUTES
TUESDAY, JANUARY 22, 2019

A meeting of the Planning Board was held on Tuesday, January 22, 2019. Mr. Marks called the meeting to order at 7:06 PM and announced that the meeting is being recorded and will be available on cable and on the website.

ATTENDANCE:
PRESENT: Ernest Marks (Chairman), Ken Ballou, Michael Greco, Tracy Sharkey (Vice Chairperson), Aaron Socrat, Michael Zwicker
ABSENT: Les Stevens
NON-VOTING: William Cundiff (Town Engineer)

7:06 PM PUBLIC HEARING CONTINUED: ASD WALLUM LAKE MA SOLAR, LLC (SPR-181002): APPLICATION FOR SITE PLAN REVIEW, 0 Wallum Lake Road.
Evan Turner of ASD Wallum Lake MA Solar and Jeff Brandt of TRC joined the meeting. Mr. Brandt stated that they recalculated all the stormwater calculations to include the two culverts on Shore Drive. The results showed that post project, less water will be reaching the culverts during storm events. The amount of water reaching the wetlands does not change. An additional diversion berm was added to channel water towards the detention basin. The berms have rip rap at the end. The infiltration trench was made larger and placed adjacent to the pad. Infiltration trenches were added up near the street. A revised stormwater report was filed.
Mr. Brandt described how the infiltration trenches will be constructed.
Mr. Cundiff stated that he has not thoroughly reviewed the revised calculations and drawings. In theory, the concept and approach look correct. He had no issues with the infiltration trenches and the revision on the stormwater check dams. He feels that the flow rate chart is good. He has started to draft a decision.
He is concerned about erosion at the diversion berms. He suggested perhaps having a second detention basin for the other culvert in lieu of the diversion berms.
Mr. Turner asked for a copy of the conditions before the next meeting.
Ms. Sharkey made a motion to continue the public hearing for ASD Wallum MA Solar, LLC (SPR-181002), Application for Site Plan Review, 0 Wallum Lake Road to February 12, 2019 at 7:30 PM. Mr. Greco seconded the motion. Vote: Aye-6.

DISCUSSION:
1. Whitin Heights Subdivision: Bond Amount. Mr. Cundiff informed the applicant of his surety estimate prior to the deadline set at the last meeting. Mr. Cundiff used the current MassDOT weighted average bid prices. Lori Funari informed Mr. Cundiff today that they will have their engineer look at the estimate, and she asked to be put on the next meeting’s agenda.
2. Discussion: Private Ways. Mr. Cundiff presented Article 22 from the last Town Meeting, which contains the language that was voted and approved for private ways. He and the Town Administrator are working with Town Counsel to modify some language.
3. Discussion: Lakeside Residential. Mr. Cundiff contacted Central Mass. Regional Planning Commission (CMRPC) for a status. Mr. Cundiff presented an application for a District Local Technical Assistant (DLTA) Grant from the State. CMRPC are looking to start work on this project in May. Letters of support and letters of commitment will be prepared.
4. Pyne Sand & Stone, Route 146 at Lackey Dam Road: Request for a One-Year Earth Removal Special Permit Extension (ER-14-01). Mr. Cundiff asked them for their annual update, which is required in their permit, but it has not yet been received.
5. Guaranteed Builders & Developers, Inc.: 37 Glen Street, Change of Ownership; & 6-month Extension Request (ER-180312). Ms. Sharkey recused herself. The Board reviewed a letter from Lou Tusino and Paul Dauphinais dated 1/19/19 asking for a 6-month extension for the Earth Removal Permit on Glen Street to 11/8/19 and to transfer ownership from the current permit applicant to Paul Dauphinais of CCAP, LLC. Town Counsel Atty. Jay Talerman feels that the permit is non-transferrable. It was the opinion of the Board that Mr. Dauphinais needs to file for a new Earth Removal Special Permit.
Regarding the 6-month extension, Mr. Cundiff will ask the applicant if they would prefer to extend for one year.
Ms. Sharkey rejoined the meeting.
6. Minutes: January 8, 2019
Mr. Greco made a motion to approve the minutes for the January 8, 2019 Planning Board meeting as amended. Mr. Ballou seconded the motion. Vote: Aye-6.
7. Central Mass. Regional Planning Commission (CMRPC) Zoning Map Revisions. The Board reviewed the map. Ms. Sharkey feels that the map should be left as it is and the zoning bylaws amended. The bigger problem is to get utilities to the areas around Rte. 146 to attract businesses for economic development.
A new location off Rte. 146 was proposed for the Adult Entertainment Overlay District. Mr. Cundiff suggested having several options and then conduct meetings with the landowners to see if they are receptive to the change.
Mr. Cundiff will have CMRPC draw the hashed-in area as the Adult Entertainment Overlay District and prepare a map. After the map is prepared, Mr. Cundiff will reach out to the property owners. The Board decided not to modify the zoning map by district.

8:12 PM ADJOURNMENT:
Ms. Sharkey made a motion to adjourn the Planning Board meeting at 8:12 PM. Mr. Greco seconded the motion. Vote: Aye-6.
