CONSERVATION COMMISSION MEETING MINUTES
MONDAY, MAY 13, 2019

A meeting of the Conservation Commission was held on Monday, May 13, 2019. Ms. Sharkey called the meeting to order at 7:04 PM.

ATTENDANCE:
PRESENT: Tracy Sharkey (Chair), Katiegrace Dudley, Michael Greco (Vice Chair)
ABSENT:
NON-VOTING: Stephen Zisk (Conservation Agent)

7:04 (NOI-DEP #143-0---) PUBLIC HEARING: 84 Bigelow Road/FULLER, RICHARD.
Ms. Sharkey opened the public hearing. Margaret Bacon of Civil Site Engineering joined the meeting. The property is an existing cottage. It is a very tight lot. Ms. Bacon has designed a two-bedroom, low-profile septic system. The Board of Health has approved the design and the Dept. of Environmental Protection (DEP) had no comments. Ms. Bacon has applied for waivers from the Zoning Board. Mr. Zisk presented photos of the site. Several large trees will need to be removed. The stockpile area will be in the existing gravel driveway area. A discussion was held.
Mr. Greco made a motion to close the public hearing for (NOI-DEP #143-0---) 84 Bigelow Road, Richard Fuller. Ms. Dudley seconded the motion. Vote: Aye-2.
Mr. Greco made a motion to issue an Order of Conditions for (NOI-DEP #143-0---) 84 Bigelow Road, Richard Fuller for the revised plan dated 4/15/19 with the condition that the stockpile area shall be on the existing gravel driveway, outside of the 100’ buffer. Ms. Dudley seconded the motion. Vote: Aye-2.

7:20 PM (NOI-DEP #143----) PUBLIC HEARING: 49 Woodland Road, Lot 57A/ DEER CROSSING DEVELOPMENT, LLC.
Ms. Sharkey opened the public hearing. Dave Marquedant of JD Marquedant and Associates and Tim Nealon of Deer Crossing Development, LLC joined the meeting. Mr. Marquedant stated that the wetlands were re-evaluated by Art Allen of EcoTec. There is a shared driveway that will cross the wetlands to gain access to #57 and #58. The proposed 62’ x 36’ house is 52’ off the wetland. All of the replication will be on a different site.
Mr. Zisk does not know if the applicant is able to have two DEP numbers on one lot for two active projects. This project is unique in that the property line goes right through the crossing. Usually, all projects would be combined under one DEP number. Mr. Nealon feels that that would cause issues when it came time to convey the lots. Mr. Nealon is waiting to hear back from Denise Childs. Mr. Zisk suggested partial releases. A discussion was held.
Mr. Greco made a motion to continue the public hearing for (NOI-DEP #143-0---) 49 Woodland Road, Lot 57 A/Deer Crossing Development, LLC to June 3, 2019 at 7:10 PM. Ms. Dudley seconded the motion. Vote: Aye-2.

7:50 PM (NOI-DEP #143----) PUBLIC HEARING: 49 & 53 Woodland Road/DEER CROSSING DEVELOPMENT, LLC.
Ms. Sharkey opened the public hearing. Dave Marquedant of JD Marquedant and Associates Tim Nealon of Deer Crossing Development, LLC joined the meeting. Mr. Marquedant stated that these lots involve an 18’ wide, 241’ long shared driveway with underground utilities under it. A 6’ x 6’ concrete culvert with earth 2’ from the bottom and rip rap aprons on both sides is proposed. A block retaining wall is proposed, both to the left and right of the crossing. The height of the crossing is 8.5’. There is 1035 sq. ft. of alteration with 1575 sq. ft. of replication.
Mr. Zisk asked for more information on the construction of the crossing, including a construction sequence.

7:59 PM (NOI-DEP #143----) PUBLIC HEARING: 53 Woodland Road/Lot 58A/ DEER CROSSING DEVELOPMENT, LLC.
Ms. Sharkey opened the public hearing. Dave Marquedant of JD Marquedant and Associates and Tim Nealon of Deer Crossing Development, LLC joined the meeting. Mr. Marquedant stated that this lot is to the left of the shared driveway. The proposed 62’ x 36’ house is outside the buffer zone. A small section of the driveway is within the buffer zone. The grade of the driveway is 7.7 with utilities underneath.
Mr. Marquedant was asked to have a plan for dewatering.
Mr. Greco made a motion to continue the public hearing for (NOI-DEP #143-0---) 53 Woodland Road, lot 58A, Deer Crossing Development, LLC to June 3, 2019 at 7:20 PM. Ms. Dudley seconded the motion. Vote: Aye-2.

8:04 PM (ANRAD #143-0968) PUBLIC HEARING CONTINUED: Thomas Circle, off South Street/QUARTZ SOLAR, LLC.
Andrew Sanna of GEI Consultants joined the meeting and presented the plan with the revised wetlands line, which was determined from Art Allen’s Peer Review Report dated 3/18/19. Mr. Sanna stated that the silt has been cleaned from the streets and silt sacks and catch basins have been installed. Ms. Dudley asked for a plan for removing the silt sacks. Mr. Sanna agreed.
Ms. Dudley made a motion to close the public hearing and issue the ORAD for (ANRAD #143-0968) Quartz Solar, LLC, Thomas Circle off South Street. Mr. Greco seconded the motion. Vote: Aye-2.
The current Order of Conditions dated 9/18/2006 will be valid until it expires. Mr. Zisk will check the expiration date of the current Order. The request for a Certificate of Compliance for the original Order is still open.

8:16 PM (NOI #143-0970) PUBLIC HEARING: 21 Orange Street/KTN ENTERPRISES.
Ms. Sharkey opened the public hearing. David Duplessis of 21 Orange Street joined the meeting. He is building a single-family home. Mr. Zisk presented photos of the site. There are no wetlands, but there is riverfront area. The stream has been flagged. Some of the work that Mr. Duplessis has done is within the Commission’s jurisdiction.
A riverfront area is a resource area. Only 10% of the riverfront area on a lot can be disturbed. Mr. Duplessis stated that his intent is to not do any more clearing or disturbance in the riverfront area.
Mr. Duplessis was not opposed to moving the proposed house outside the 200’ riverfront area. The septic is outside the Commission’s jurisdiction. The maximum disturbance will be the 7900 sq. ft. as shown on the plan.
Ms. Dudley made a motion to close the public hearing for (NOI #143-0970) KTN Enterprises, 21 Orange Street. Mr. Greco seconded the motion. Vote: Aye-2.
Ms. Dudley made a motion to issue an Order of Conditions for (NOI #143-0970) KTN Enterprises, 21 Orange Street, with the condition that the proposed house be moved outside the 200’ riverfront area and the impact area limited to no more than 7900 sq. ft. Mr. Greco seconded the motion. Vote: Aye-2.

8:28 PM (RDA) PUBLIC MEETING: Ledgestone Road/CAHILL, DAVID & JANIS.
Ms. Sharkey opened the public meeting. David and Janis Cahill joined the meeting. Mr. Cahill stated that they have approximately 500’ of waterfront, however only two small 15’ openings exist to get to the lake. They are asking for permission to cut 20’ of thicket and scrub brush. There will be no earth disturbance and no lawn is planned.
Mr. Cahill would like to remove some dead trees that are closer to the house, away from the lakefront.
Mr. Cahill would like to install a 14’ long aluminum dock, however the RDA does not include the dock. The application is requesting to do 180’ of clearing. The Commission asked that Mr. Cahill re-advertise for the next meeting.
Mr. Zisk sent the forest cutting inquiry to DEP and the Dept. of Conservation and Recreation (DCR). Mr. Cahill stated that the neighbor is going to buy the land from him.
Mr. Greco made a motion to continue the public meeting for (RDA) David and Janis Cahill, Ledgestone Road/Cahill to June 3, 2019 at 7:30 PM. Ms. Dudley seconded the motion. Vote: Aye-2.

DISCUSSION:
1. Proposal for Wetland Crossing: Southeast Main Street (WHP Trucking & Excavating). Mr. Zisk stated that the person doing the crossing and replication area estimated $49,000 for the bond. Mr. Zisk showed photos of the site. A discussion was held.
Mr. Greco made a motion to accept $49,931.25 for bonding for the wetland crossing for Southeast Main Street, WHP Trucking & Excavating. Ms. Dudley seconded the motion. Vote: Aye-2.
2. Pyne Sand & Stone: 49 Glen Street. If the Town wants to do any work within the Commission’s jurisdiction, they will need to file.
3. Keith Forget: Breezy Picnic Grounds. Keith Forget of 525 Northwest Main Street joined the meeting. Mr. Zisk stated that he received an inquiry about a structure that is being rehabbed. The footprint is the same, except for the right side where there was a two-story deck and tubes were installed in the ground. Mr. Zisk presented some photos. He did not see any disturbance.
It was the consensus of the Commission to authorize the Building Permit application for Keith Forget, Breezy Picnic Grounds.
4. Application for Board/Committee: Mark Mungeam, 20 Depot Street. Ms. Sharkey stated that there were a couple of applications. She asked Mr. Zisk to ask the applicants to come to a meeting to talk with the Commission.
5. Request for a Certificate of Compliance: Rose Marie Galimi-Hayes, 136 Perry Street, (DEP #143-0939). Ms. Galimi-Hayes and a gentleman joined the meeting. Mr. Zisk presented photos of the site. Ms. Galimi-Hayes stated that the area has been re-seeded.
Mr. Greco made a motion to issue a Certificate of Compliance for Rose Marie Galimi-Hayes, 136 Perry Street, (DEP #143-0939). Ms. Dudley seconded the motion. Vote: Aye-2.
Ms. Galimi-Hayes asked about the status of an Order of Conditions for her property from 2004. Mr. Zisk stated that the area grew in naturally. Ms. Sharkey stated that Ms. Galimi-Hayes can come before the Commission with a request for a Certificate of Compliance.
6. Request for a Certificate of Compliance: Deer Crossing Development, 49 Woodland Road (DEP #143-0726). No work has commenced and the Certificate has expired.
Mr. Greco made a motion to issue a Certificate of Compliance for Deer Crossing Development, 49 Woodland Road (DEP #143-0726) due to no work having been done on the site. Ms. Dudley seconded the motion. Vote: Aye-2.
7. Request for a Certificate of Compliance: Deer Crossing Development, 53 Woodland Road (DEP #143-0733). No work has commenced and the Certificate has expired.
Mr. Greco made a motion to issue a Certificate of Compliance for Deer Crossing Development, 53 Woodland Road (DEP #143-0733) due to no work having been done on the site. Ms. Dudley seconded the motion. Vote: Aye-2.
8. Conservation Land: Manchaug Road property (7 acres). There are two parcels; one is Conservation land and the other is owned by the Town. The parking area and stairs may not be on Conservation land. The non-Conservation parcel may go up for auction. Mr. Zisk suggested using funds designated for conservation land to draw up plans to square off the parking area, signs, trails, etc. The Commission was in agreement. Mr. Zisk will start to investigate the cost.
9. Conservation Land: Southeast Main Street property (60 acres). Katherine Petersson of 229 Southeast Main Street joined the meeting. She and Mr. Zisk have walked the property. The abutters would like to clear fallen trees and brush from the existing trails now. They would use nothing larger than a chainsaw. After that is done, they would like to submit a proposal to the Commission to work on the parking area, clear boulders, etc. Ms. Petersson will be meeting with Open Space next week.
Ms. Dudley made a motion to grant permission for maintenance of existing trails on Conservation land, using nothing larger than a chainsaw, as long as the Volunteer Waiver Form is signed. Mr. Greco seconded the motion. Vote: Aye-2.
Mr. Zisk will give Ms. Petersson trail flags. Work is being done to obtain an easement and a sign.
10. Volunteer Waiver Form. This form has been reviewed by Town Counsel. The Commission asked that the waiver be signed and kept in the Board of Selectmen’s (BOS) office. Mr. Zisk will speak with the BOS to see how they would like to handle it. See discussion above.
11. Sign: Vouchers. Project Review: 64 Birch Street. The area is 14.12 acres and all work is outside the 100’.
12. Minutes: April 1, 2019
Approval of the April 1, 2019 minutes of the Conservation Commission meeting were deferred to the next meeting.
