CONSERVATION COMMISSION MEETING MINUTES
MONDAY, JUNE 17, 2019

A meeting of the Conservation Commission was held on Monday, June 17, 2019. Ms. Sharkey called the meeting to order at 7:04 PM.

ATTENDANCE:
PRESENT: Tracy Sharkey (Chair), Katiegrace Dudley, Michael Greco (Vice Chair), Arthur Montminy
ABSENT:
NON-VOTING: Stephen Zisk (Conservation Agent)

7:04 PM (RDA) PUBLIC MEETING: 56 Davis Street/PICANSO, MATTHEW.
Ms. Sharkey opened the public meeting. Mr. and Mrs. Picanso joined the meeting. They are asking to install an above ground pool, 35’-40’ from the wetland edge. Mr. Zisk presented photos of the site. Due to the location of the septic and well, there are not a lot of places to put the pool. Mr. Picanso will put gravel around the pool. He will put up a silt fence between the grass line and the drop off. Ms. Sharkey stated that no machinery can be parked within the 100’. Mr. Zisk asked that the backwash from the pool be kept away from the wetland.
Mr. Greco made a motion to issue a negative RDA for Matthew Picanso, 56 Davis Street, with the condition that the pool be no closer than 35’ from the wetland, no heavy machinery parked within the 100’, the Conservation Agent is to sign off on the installation of erosion controls before the Building Permit is issued, and the backwash will be discharged opposite the wetlands. Ms. Dudley seconded the motion. Vote: Aye-3.

7:15 PM (NOI #143-0976) PUBLIC HEARING: 161 Maple Street/DAVIS, DENISE.
Ms. Sharkey opened the public hearing. Bruce Williams of Allen Engineering joined the meeting. He is in the process of revising the plan in response to Mr. Zisk’s comments. The applicant would like to create a 60’ x 120’ wetland pond, 8.5’ deep at the rear of the property. The pond will be within the 200’ riverfront area. They are working with Goddard Consulting on the details for the wetland habitat.
The proposed dwelling will be pivoted away from the wetlands and lowered.
Mr. Williams gave a background of the project. A survey was done last winter, and the wetlands were not apparent at that time. GIS did not show the wetlands as they currently exist. The proposed home and septic were originally in the wetlands area. The plan does not show the work that has been done. Mr. Zisk presented photos of the site.
Scott Goddard from Goddard Consulting (did not identify himself) joined the meeting and said that the site was logged 2008-2010. Ms. Davis bought the property in September. A second unidentified gentleman stated that topsoil had been scraped off in the fall for a gravel driveway before they knew wetlands existed in the area. He put back the topsoil in the spring when the wetlands were identified. Mr. Goddard stated that they fully intend to submit a mitigation plan to restore that area.
The new plan will need to show the extent of the disturbed area. Ms. Sharkey would prefer that the pond be located where the disturbed BVW was. Mr. Zisk stated that a third party review is needed.
The percentage of riverfront area on the lot has not yet been calculated. Mr. Zisk stated that the Commission cannot allow over 10% of disturbance. Mr. Williams stated that Mr. Zisk’s comments will be incorporated into the next set of plans. Dimensions need to be added to all the structures.
Mr. Zisk is concerned about the future plans for a pool. Mr. Williams explained that the new design has less fill. It was decided to show the pool because they were filling an area for the pool.
Mr. Williams stated that the wetland is being fed by overland flow. Mr. Goddard said that there might be an underground spring.
Mr. Montminy made a motion to continue the public hearing for (NOI #143-0976) Denise Davis, 161 Maple Street to July 15, 2019 at 7:00 PM. Mr. Greco seconded the motion. Vote: Aye-3.

7:42 PM (NOI-143-0977) PUBLIC HEARING: 41 Shore Road/PRINCE, CHERYL.
Ms. Sharkey opened the public hearing. Steve Donatelli of Shea Engineering joined the meeting. All of the work is within the 100’. They are proposing to replace the existing cesspool with a tight tank, create a landscape area in front of the house, and drill a new well out front 30’ from the tight tank. Pea stone will be brought in by wheelbarrow, not machinery. The Commission reviewed a video of the site.
The clearing of trees in the front was not detailed on the plan. All the trees on the bank will be removed. Mr. Zisk had assumed that the trees being removed were as a result of the septic repair. Mr. Donatelli explained that other trees planning to be removed are for the preservation of the house as they are unhealthy. Mr. Zisk stated that the area is a coldwater fishery. Removing the shade is a concern. Mr. Zisk asked that every tree that they are proposing to clear be flagged and be identified as to which are hazardous.
The Commission reviewed the NOI that was filed. Ms. Sharkey suggested that a new plan with revisions be filed with Metro Heritage and DEP. Ms. Sharkey asked for a construction sequence and details on how the pea stone was going to be brought in and kept from washing into the wetland, and for an exact description for the walkway.
Mr. Greco made a motion to continue the public hearing for (NOI #143-0977) Cheryl Prince, 41 Shore Road to July 15, 2019 at 7:15 PM. Mr. Montminy seconded the motion. Vote: Aye-3.

8:02 PM (NOI-DEP #143-0973) PUBLIC HEARING CONTINUED: 49 & 53 Woodland Road/DEER CROSSING DEVELOPMENT, LLC.
Tim Nealon of Deer Crossing Development, LLC joined the meeting. Mr. Nealon stated that stockpile locations, check dams, rocks for anti-creep, and a construction schedule were added to the plan. Dave Marquedant of JD Marquedant Associates was unable to attend. The Commission reviewed the revisions to the plan and construction sequence, including adding a line of rocks, rip rap limits, stockpile area, wash stone apron, and check dams.
Mr. Montminy made a motion to continue the public hearing for (NOI-DEP #143-0973) 49 & 53 Woodland Road, Deer Crossing Development, LLC to July 15, 2019 at 7:30 PM. Mr. Greco seconded the motion. Vote: Aye-3.

8:06 PM (NOI-DEP #143-0974) PUBLIC HEARING CONTINUED: 49 Woodland Road, Lot 57A/ DEER CROSSING DEVELOPMENT, LLC.
Tim Nealon of Deer Crossing Development, LLC joined the meeting. Dave Marquedant of JD Marquedant Associates was unable to attend. A line of rocks and a check dam were added to the plans.
Mr. Greco made a motion to continue the public hearing for (NOI-DEP #143-0974) 49 Woodland Road, Lot 57 A/Deer Crossing Development, LLC to July 15, 2019 at 7:35 PM. Mr. Montminy seconded the motion. Vote: Aye-3.

8:07 PM (NOI-DEP #143-0975) PUBLIC HEARING CONTINUED: 53 Woodland Road/Lot 58A/ DEER CROSSING DEVELOPMENT, LLC.
Tim Nealon of Deer Crossing Development, LLC joined the meeting. Dave Marquedant of JD Marquedant Associates was unable to attend. Changes were made to add a line of rocks, check dam, limit of work on lot 57A, and no on-drive 57A.
Mr. Montminy made a motion to continue the public hearing for (NOI-DEP #143-0975) 53 Woodland Road, lot 58A, Deer Crossing Development, LLC to July 15, 2019 at 7:40 PM. Ms. Dudley seconded the motion. Vote: Aye-3.

DISCUSSION:
1. Coldwater Fisheries: Peter Coffin. Mr. Zisk stated that Mr. Coffin has offered to come to a meeting to give a seminar on coldwater fisheries. Ms. Dudley stated that she has been to this presentation twice. Ms. Sharkey asked that Mr. Coffin provide information and a list of coldwater fisheries in Douglas.
2. Complaint: Shore Road. Ms. Sharkey recused herself. Mr. Zisk showed photos of the area where there the road is in very poor condition. Shore Road and Birch Hill Road are private roads. The owner has placed reground in the area to improve the condition of the road. A discussion was held. Mr. Zisk suggested that the owner file an RDA before doing any work in the future.
Ms. Sharkey rejoined the meeting.
3. Request for a Certificate of Compliance: Diane & Michael Creasey, 306 Yew Street (DEP #143-0486). The Commission reviewed photos of the site. There is no as-built. The project was completed in 2002. Two Orders were issued, one of which was an amendment.
Mr. Greco made a motion to issue a Certificate of Compliance for Diane and Michael Creasey, 306 Yew Street (DEP #143-0486). Mr. Montminy seconded the motion. Vote: Aye-3. Both books and pages need to be noted on the Certificate of Compliance.
4. Request for a Certificate of Compliance: Steve Bagdis, 90 Peters Cove Road (DEP #143-0961). Mr. Bagdis joined the meeting. Mr. Zisk gave a background of the situation. The dock location has been straightened.
Ms. Dudley made a motion to issue a Certificate of Compliance for Steve Bagdis, 90 Peters Cove Road (DEP #143-0961). Mr. Montminy seconded the motion. Vote: Aye-3.
5. Request for a Certificate of Compliance: Leslie Stevens, 64 Depot Street (DEP #143-0950). Mr. Stevens joined the meeting. The Commission reviewed photos of the site. Mr. Stevens stated that the neighbor’s parked machine is being sold. The Commission told Mr. Stevens that the equipment needs to be moved farther away from the regrind area, and the silt fence needs to be removed. Mr. Stevens will ask the owner to move the machine closer to the garage area.
Mr. Montminy made a motion to issue a Certificate of Compliance for Leslie Stevens, 64 Depot Street (DEP #143-0950), with the condition that the equipment needs to be moved farther away from the wetland area, and the silt fence needs to be removed before the Conservation Agent signs the Certificate. Mr. Greco seconded the motion. Vote: Aye-3.
6. Schedule Site Walk: 134 Southeast Main Street. Mr. Zisk has looked at the plans. Margaret Bacon of Civil Site Engineering questioned why the as-built was so red. Mr. Zisk answered that the as-built has 1’ contour lines. Mr. Zisk stated that both driveways are under the Order of the property that is being sold, and the work is not finished. He has spoken to Ms. Bacon and she will clarify.
7. Minutes: April 22, & May 13, 2019.
Mr. Greco made a motion to approve the April 22, 2019 minutes of the Conservation Commission meeting as amended. Ms. Dudley seconded the motion. Vote: Aye-2, Mr. Montminy abstained.
Approval of the May 13, 2019 Conservation Commission meeting minutes was deferred to the next meeting.
