CONSERVATION COMMISSION MEETING MINUTES
MONDAY, SEPTEMBER 16, 2019

A meeting of the Conservation Commission was held on Monday, September 16, 2019. Ms. Sharkey called the meeting to order at 7:00 PM.

ATTENDANCE:
PRESENT: Tracy Sharkey (Chair), Katiegrace Dudley, Michael Greco (Vice Chair), Arthur Montminy, Mark Mungeam
ABSENT: Eric Harris (Associate-Excused)
NON-VOTING: Stephen Zisk (Conservation Agent)

7:00 PM (RDA) PUBLIC MEETING: 310 Northwest Main Street/BLACK, STEPHEN.
Ms. Sharkey read the legal notice. Mr. Black joined the meeting and requested permission to remove two decayed trees. One tree is right at the base of the water, another is leaning over a neighbor’s fence. An arborist has said that the trees should be condemned. Mr. Zisk showed photos of the site. Mr. Black would like to plant some fruit trees in their place. He presented a certified plan.
The Commission stated that the wood should be taken off the property, and the stumps remain in place.
Ms. Dudley made a motion to issue a negative RDA for Stephen Black, 310 Northwest Main Street with the condition that the stumps remain in place. Mr. Greco seconded the motion. Vote: Aye-4.

7:15 PM (NOI DEP #143-0981) PUBLIC HEARING: 82 & 85 Peters Cove Road/BUCCIARELLI, ANTHONY & SARAH.
Ms. Sharkey opened the public hearing. Margaret Bacon of Civil Site Engineering joined the meeting. There are two existing cottages in various stages of disrepair under the same ownership. Peters Cove Road is a private road. The applicant is asking to raze the existing cottages and build a two-bedroom house with one septic and a garage. The septic and garage will be in the lot across the street from the reservoir. Everything is outside the 50’ buffer. The Commission reviewed a video of the site.
Ms. Bacon presented plans that show revisions per Mr. Zisk’s request. The stockpile will be across the street. There will be a porch on the lake side of the house, but the footprint will remain 25’ x 40’. The applicant will have a gravel drive on the lot near the lake, and asphalt grindings across the street to the garage.
The ZBA approved the variance in June. Ms. Bacon will be filing for the septic next week. Three large trees will need to be removed for the tanks and the house. Machinery will be parked outside the 100’ buffer on lot 85.
Ms. Dudley made a motion to close the public hearing for (NOI DEP #143-0981) 82 and 85 Peters Cove Road, Anthony and Sarah Bucciarelli. Mr. Greco seconded the motion. Vote: Aye-4.
Mr. Greco made a motion to issue an Order of Conditions for (NOI DEP #143-0981) 82 and 85 Peters Cove Road, Anthony and Sarah Bucciarelli with the conditions that all machinery shall be parked outside the 100’ buffer and no more than three trees shall be removed. Mr. Montminy seconded the motion. Vote: Aye-4.

7:26 PM (RDA) PUBLIC MEETING: 36 Ridge Trail/JOSEY, ROBERT.
Ms. Sharkey opened the public meeting. Mr. Josey joined the meeting and asked to remove 5 trees, 3 of which are shedding branches on the neighbor’s property. All of the trees are outside the 50’ buffer. Mr. Josey will leave the stumps. He does not plan to replace the trees.
Ms. Dudley made a motion to issue a negative RDA for Robert Josey, 36 Ridge Trail with the condition that no more than the five identified trees shall be cut, and the stumps shall remain. Mr. Greco seconded the motion. Vote: Aye-4.

7:30 PM (NOI DEP #143-0982) PUBLIC HEARING CONTINUED: 832 Northwest Main Street/WIEGELE, GEORGE & JOANNE.
Travis Brown of Andrews Survey and Engineering joined the meeting. Since the last meeting, he has provided additional information and revised the plans per Mr. Zisk’s initial comment letter. The Dept. of Environmental Protection (DEP) has reviewed the plan and has asked the applicant to add the riverfront area on Form 3.
Mr. Brown presented the following changes: added a proposed shed on a slab foundation (outside the 50’ buffer), provided a crossing detail and proposed grading, added a second pipe in the channel to maintain flow through the crossing, added a general construction sequence, added a driveway profile, stormwater calculations, revised the wetland replication area, and added replication detail and protocol. Mr. Brown also added soil hydrology and the break in the wall.
A discussion was held regarding whether or not one additional 12” pipe would be enough to control the flow of water. Mr. Brown stated that an open flow analysis was done based on two 12” pipes. Mr. Zisk does not feel it is necessary to add another pipe, however it could be added without much additional work or cost. Mr. Brown was willing to add an additional 12” pipe.
The fill area is 1150 sq. ft. and is the total area of disturbance in that area. Mr. Brown stated that they are not increasing the fill because they are only changing the grade between 4”-6”. There is an existing cart path. Mr. Mungeam feels the crossing is a detriment to wildlife.
Ms. Sharkey stated that everything that was asked for in the minutes has been addressed, including stormwater calculations.
Ms. Dudley made a motion to close the public hearing for (NOI DEP #143-0982) George and Joanne Wiegele, 832 Northwest Main Street. Mr. Montminy seconded the motion. Vote: Aye-4.
Ms. Dudley made a motion to issue a Notice of Conditions for (NOI DEP #143-0982) George and Joanne Wiegele, 832 Northwest Main Street with the condition of the addition of an additional 12” pipe, located at the contractor’s discretion between the existing pipe and the proposed pipe. Mr. Greco seconded the motion. Vote: Aye-3, No-1.

7:49 PM (RDA) PUBLIC MEETING: 200 Northwest Main Street/EVERS, THOMAS.
Ms. Sharkey opened the public meeting. Brian Hassett of Allen Engineering & Associates joined the meeting. The applicants are seeking to replace an existing garage. The new 40’ x 24’ garage would not be any closer to the resource area, but would be larger than the existing garage. Mulch socks will be staked starting at the existing house and wrapping around the proposed location for the garage and the existing garage. The Commission reviewed photos of the site. All existing grades will remain the same.
There is to be no stockpiling nor parking of equipment within the 100’ buffer. All erosion controls are to be installed before any demolition begins.
Mr. Mungeam stated that there is already an existing garage on the property. He asked what the purpose of this new garage would be. Mr. Hassett replied that this garage is for vehicles and storage. The other garage is outside the 100’ buffer. The increase in impervious area is a total of 221 sq. ft., which includes the area outside the 100’ buffer.
No gutters are currently planned for the proposed garage. Ms. Dudley is concerned that, with the removal of shrubs and the addition of a garage, there is nothing to hinder water flow other than the lawn. Ms. Sharkey suggested that Mr. Zisk ensure the area is stabilized before erosion controls are removed. The Commission asked that the disturbed area be landscaped with shrubbery in lieu of lawn.
When asked if Mr. Evers would be driving across the swale to access the garage, he replied that the garage will be mostly for storage and would not be accessed every day.
Ms. Dudley made a motion to issue a negative RDA for Thomas Evers, 200 Northwest Main Street with the following conditions: no stockpiling within the 100’ buffer, no parking of machinery within the 100’ buffer, no grading, no trees are to be removed, the area of disturbance between the new garage and the reservoir is to be landscaped with shrubbery in lieu of lawn, and Mr. Zisk will inspect the site before the existing structure is torn down and after to be sure it is stabilized before erosion controls are removed. Mr. Montminy seconded the motion. Vote: Aye-3, No-1.

DISCUSSION:
1. Douglas Renewables, 170 West Street: Wetland Crossing (#143-0967). Mr. Zisk stated that they are doing a great job at the site. The replication area is all prepped, erosion controls are in place, and they are at the right grade. He will have photos at the next meeting.
2. Whitin Reservoir Estates: (#143-0656). Mr. Zisk has not heard that all the rubble has been cleaned up
3. 25 Webster Street: Mr. Zisk showed photos of the site. The area is not yet subdivided. The property owner is looking to donate land (parcel A) to the Town for conservation. The consensus of the Commission was that they are not in favor of the donation as it is not advantageous to their mission statement of conservation in Town.
4. Application for Conservation Commission: Ms. Sharkey stated that if the applicant does not get appointed to the Cultural Council, he may attend a meeting to meet the Commission. The applicant was present, joined the meeting and expressed his interest in joining the Commission. It was the consensus of the Commission to favorably recommend to the Board of Selectmen to appoint the applicant to the Commission.
5. Minutes: June 3, July 15, & August 26, 2019.
Ms. Dudley made a motion to approve the minutes of the June 3, 2019 Conservation Commission meeting as presented. Mr. Montminy seconded the motion. Vote: Aye-3, Mr. Mungeam abstained.
Mr. Greco made a motion to approve the minutes of the July 15, 2019 Conservation Commission meeting as presented. Mr. Montminy seconded the motion. Vote: Aye-4.
Approval of the August 26, 2019 Conservation Commission meeting minutes was deferred to the next meeting.

OTHER BUSINESS:
Last weekend, Mr. Zisk reviewed a forest cutting plan for off of Chestnut Street to clear an area around Hemlock Street and Tinkerbell Brook. He was concerned because the plan did not address the sensitive areas, multiple crossings or riverfront area. He emailed the plan to the Regional Director of the Dept. of Environmental Protection and asked that Natural Heritage review it. A discussion was held.

Mr. Greco made a motion to adjourn the meeting at 8:25 PM. Mr. Montminy seconded the motion. Vote: Aye-4.
