CONSERVATION COMMISSION MEETING MINUTES
MONDAY, NOVEMBER 4, 2019

A meeting of the Conservation Commission was held on Monday, November 4, 2019. Ms. Sharkey called the meeting to order at 7:00 PM.

ATTENDANCE:
PRESENT: Tracy Sharkey (Chair), Paul Beckwith, Katiegrace Dudley, Michael Greco (Vice Chair), Arthur Montminy
ABSENT: Eric Harris (Associate-Excused), Mark Mungeam
NON-VOTING: Stephen Zisk (Conservation Agent)

7:00 PM (RDA) PUBLIC MEETING: COMMONWEALTH OF MASS/DOUGLAS STATE FOREST, 107 Wallum Lake Road.
Ms. Sharkey opened the public meeting. Cary VandenAkker joined the meeting and stated that over 250 dead trees are marked to be taken down at the entrance to the park, the boat ramp, parking areas and throughout the picnic area. The plan is to have a showing later this month to bid on taking the wood. They hope to remove many of the trees by January or February 2020. They hope to remove them all at once so as to minimize the equipment impact. Stumps will not be removed. Come spring 2020, they plan to grind the stumps in just the picnic area and cover them. Some of the trees are right on the water. In the future, they may need to plant trees. A discussion was held.
Mr. VandenAkker was asked to notify Mr. Zisk before works begins.
Ms. Dudley asked if some of the biomass could remain in the forest. Mr. Vanden Akker replied that part of the scope of the bid is to take the chippings from trees that are not in the wetland area and broadcast spread them into the forest to a depth of 1”-2”.
Ms. Dudley made a motion to issue a negative RDA for the Commonwealth of Mass/Douglas State Forest, 107 Wallum Lake Road with the condition of notifying the Conservation Agent before work begins, and no stumping, except for stumps to be ground in the picnic area only. Mr. Greco seconded the motion. Vote: Aye-4.

7:31 PM. (NOI #143-0983) PUBLIC HEARING: 38 Railroad Avenue/BALLOU, HOWARD.
Glen Krevosky joined the meeting. The hearing had not been advertised. It will be on the agenda for 12/2/19.

DISCUSSION & DELIBERATION:
1. Request for Minor Project Change: Denise Davis, 161 Maple Street (DEP #143-0976). Scott Goddard of Goddard Consulting and Franz Burke joined the meeting to request a change to the wetland restoration area. The impact area has considerably revegetated over the 75% threshold. They are asking to revegetate the 20’ buffer zone along the western side of the impacted wetland in order to not disturb the revegetated area. They reduced the number of shrubs by10, cut down the number of ferns by half, and will change the seed mix to the conservation wildlife mix. They plan to do the work this Friday or Sunday. A discussion was held.
Mr. Montminy made a motion to approve the minor project change for Denise Davis, 161 Maple Street (DEP #143-0976) as presented. Ms. Dudley seconded the motion. Vote: Aye-4.
2. Request for a Partial Release of Certificates of Compliance: Whitin Reservoir Estates (#143-0656). There was no discussion. Mr. Zisk has not had a chance to review them.
3. Request for Return of Funds: David MacKenzie, Southeast Main Street/Wetlands Crossing (#143-0969). This was approved at the last meeting.
4. Chapter 61 Section 8-Notice of Intent to Sell: Estate of Alice Chase, Orange Street (5.19 Acres). This was discussed at the last meeting.
5. Request for a Certificate of Compliance: Bonnie Johnson, 42 Hough Road (DEP #143-0948). Byron Andrews of Andrews Survey and Engineering and Ms. Johnson joined the meeting. Ms. Dudley stated that the gravel drive extends outside the original permitted limit of work. Mr. Andrews reviewed photos and a video taken before construction showing that the area behind the house and the gravel driveway was fairly bare. The area behind the house labeled “gravel driveway” on the plan was labelled as such in error and is not actually a gravel driveway. That area was and is very rough, without good loam. Ms. Johnson has offered to seed the area.
The tree line and limit of disturbance on the original plan vs. the as-built do not match. Mr. Andrews does not believe any trees were disturbed.
Regarding the hoses coming out of the basement, Ms. Johnson had a sump pump installed in the basement. It was installed too low and was pumping all the time. The neighbors complained. It was fixed by May, and there is no water coming out of it. The Commission was concerned about erosion and pumping into the wetland. Mr. Zisk feels the hoses should be removed and a dry well installed. A discussion was held.
Mr. Andrews and Ms. Johnson will discuss options.
6. Request for a Certificate of Compliance: Roy Vaz, 25 Fair View Drive, (DEP #143-0922). Byron Andrews of Andrews Survey and Engineering joined the meeting. The Commission reviewed the proposed plan and the as-built. Ms. Dudley stated that there is more driveway in the 100’ wetlands buffer than proposed, the deck is larger than proposed and there are stairs off the deck. Ms. Sharkey approved of there being less disturbance between 60’-0’ and where the well is. All structures are outside the 50’ buffer. A discussion was held.
Mr. Andrews did not know anything about the proposed drainage easement. Mr. Zisk feels it must be for the subdivision.
Mr. Montminy made a motion to issue a Certificate of Compliance for Roy Vaz, 25 Fair View Drive (DEP #143-0922). Mr. Greco seconded the motion. Vote: Aye-4.
7. 2020 Conservation Commission Meeting Schedule. Mr. Beckwith made a motion to approve the 2020 Conservation Commission Meeting Schedule as amended to change the 4/21/20 meeting to 4/27/20. Mr. Montminy seconded the motion. Vote: Aye-4.
8. Vouchers.

OTHER BUSINESS:
Violation: 144 Southeast Main. Mr. Zisk stated that he was across the street looking at a crossing, and he noticed the property owner is doing work in the buffer zone. Mr. Zisk left the NOI and as-built with the property owner. Tyler O’Connor joined the meeting and stated that the Dept. of Environmental Protection wetlands map did not show any notifications, nor did he see anything on the assessors database. He stated that the majority of the work is outside of 30’, with the exception of two (trees). One (tree) does fall within 18’-20’ and one in the “blue section”. He removed trees that were at risk of falling.
Ms. Sharkey stated that the grading for the septic is right on the edge of the 25’. Ms. Sharkey stated that a title search should have come up with the wetlands on the property.
Mr. O’Connor stated that he did not get a permit to install a 5”, 20’-long DOT approved culvert pipe under the driveway, however it is temporary. A discussion was held.
Ms. Dudley made a motion to issue a $100 fine for the violation of the wetland bylaws at 144 Southeast Main. Mr. Greco seconded the motion. Vote: Aye-4.
Mr. O’Connor plans to remove five more trees, three at the 50’, and one at the 20’. An arborist has said that the trees are dead. Mr. O’Connor plans to plant grass and perhaps a garden outside the 50’. The wood chips will be used on the opposite side of the property for compost. The logs will be taken off the property. The stockpile will be removed.
Mr. O’Connor was told to file a Notice of Intent (NOI) for the remainder of the work. He may use the existing as-built as long as the Commission has accurate records as to what he is doing and what is allowed in the Order of Conditions. Mr. O’Connor was told that he cannot do any further work until the Commission reviews the NOI, except to install staked straw wattles at the limit of work. He needs to call Mr. Zisk when the erosion controls are installed. The chipper needs to be moved outside the buffer.
