ZONING BOARD OF APPEALS MEETING MINUTES
WEDNESDAY, JULY 10, 2019

A meeting of the Zoning Board of Appeals (ZBA) was held on Wednesday, July 10, 2019. Mr. Heney called the meeting to order at 7:02 PM in the Community Meeting Room.

ATTENDANCE:
PRESENT: Daniel Heney (Chairman), John Bombara Michael Fitzpatrick, Pamela Holmes (Vice Chairman), Sean Holland, Louis Tusino (Alternate)
ABSENT:
NON-VOTING: William Cundiff (Town Engineer), Maria Lajoie (Administrative Assistant)

7:02 PM DISCUSSION: NORTHBROWN, LLC: NORTH VILLAGE UPDATE.
Atty. Ed Taipale joined the meeting and provided an updated sale and construction schedule and a list of the recorded sales with the books and pages listed. Installation of the cistern is complete, and they are waiting for the Fire Dept. to do the flow test.
Mr. Cundiff asked for copies of the actual deeds for the record. Atty. Taipale agreed.
Mr. Cundiff stated that a gravel turnaround has been constructed. They are rerouting construction traffic to separate it from residential traffic in phase one, and it would be prudent to maintain a traffic control plan that maintains that separation going forward.

7:15 PM PUBLIC HEARING: ANTHONY & SARAH BUCCIARELLI (2019-06), 85 & 82 Peters Cove Road.
Mr. Heney opened the public hearing. Mr. Heney recused himself and Ms. Holmes took over as Chair. Voting on the case will be Mr. Holland, Ms. Holmes, Mr. Bombara and Mr. Fitzpatrick. Margaret Bacon of Civil Site Engineering and Mr. Bucciarelli joined the meeting. Ms. Bacon stated that the applicant is looking to replace two existing cottages with a 25’ x 40’ seasonal dwelling and a 24’ x 24’ two car garage. A new raised-system septic will be installed on the lot farther away from the lake. The applicant has not yet been before the Conservation Commission.
Ann Horan of 102 Peters Cove Road asked if there would be a room in the two car garage. Mr. Bucciarelli replied that there will be a loft in the garage with no plumbing in the structure.
Steve Bagdis of 90 Peters Cove Road asked if the garage will be located in the same location as the current cottage. Ms. Bacon replied that the current cottage encroaches on the zoning lines, therefore the garage will be shifted 12’.
Greg Graham and another woman of Peters Cove Road, direct abutters, stated that they have no objection to the plans.

Mr. Bombara made a motion to close the public hearing for Anthony and Sarah Bucciarelli (2019-06), 85 and 82 Peters Cove Road. Mr. Fitzpatrick seconded the motion. Vote: Aye-4.
The Planning Board had no objection.
Mr. Bombara made a motion to approve the Special Permit for Anthony and Sarah Bucciarelli (2019-06), 85 and 82 Peters Cove Road, per the plan submitted by Civil Site Engineering as the plan will not be more detrimental to the neighborhood. Mr. Holland seconded the motion. Vote: Aye-4.
Mr. Heney rejoined the meeting and resumed as Chair.

7:31 PM PUBLIC HEARING: LESLIE STEVENS (2019-07), 131 Franklin Street.
Mr. Heney opened the public hearing. Voting on the case will be Mr. Heney, Ms. Holmes, Mr. Bombara, Mr. Holland and Mr. Fitzpatrick. The Planning Board had no objection to the Special Permit request. Mr. Stevens joined the meeting and stated that there is an existing dwelling on the property that sits 21’ off the road. He is proposing a setback of 22’ and requesting a side setback variance of 23’ with the overhang. The wetland boundaries have caused them to place the proposed 27’ x 48’ raised ranch house such that these variances are being requested.
Mr. Fitzpatrick suggested rotating the house 90 degrees to improve encroachment on the front setback. Mr. Stevens stated that that was not done due to the lot layout.
Michael Costanza of 125 Franklin Street asked, “Why 23 feet?” Mr. Stevens replied that the dwelling cannot be moved over further due to the septic system.
Mr. Bombara made a motion to close the public hearing for Leslie Stevens (2019-07), 131 Franklin Street. Mr. Holland seconded the motion. Vote: Aye-5.
Mr. Bombara made a motion to approve the Special Permit for Leslie Stevens (2019-07), 131 Franklin Street per the plans submitted. Mr. Holland seconded the motion. Vote: Aye-5.

DISCUSSION:
1. MINUTES: May 8 & June 12, 2019.
Mr. Fitzpatrick made a motion to approve the May 8, 2019 ZBA meeting minutes as presented. Ms. Holmes seconded the motion. Vote: Aye-4, Mr. Bombara abstained.
Mr. Holland made a motion to approve the June 12, 2019 ZBA meeting minutes as presented. Mr. Fitzpatrick seconded the motion. Vote: Aye-4, Mr. Bombara and Mr. Heney abstained.

OTHER:
Mr. Heney asked the members to review the “Code of Conduct for Boards and Committees” in the packet.
Mr. Fitzpatrick stated that case #2019-03 has not reapplied. It was decided to ask the Building Commissioner to come to the next meeting for an update.

7:58 PM ADJOURNMENT:
Mr. Fitzpatrick made a motion at 7:58 PM to adjourn the ZBA meeting. Mr. Bombara seconded the motion. Vote: Aye-6.
