ZONING BOARD OF APPEALS MEETING MINUTES
WEDNESDAY, JULY 8, 2020

A meeting of the Zoning Board of Appeals (ZBA) was held on Wednesday, July 8, 2020. Mr. Heney called the meeting to order at 7:05 PM in the Municipal Center. Due to the COVID-19 pandemic, participants were also invited to attend remotely by Zoom.

ATTENDANCE:
PRESENT: Daniel Heney (Chairman), Michael Fitzpatrick, Pamela Holmes (Vice Chairman), Louis Tusino (Alternate)
ABSENT: John Bombara (Excused), Sean Holland (Excused)
NON-VOTING: Maria Lajoie (Administrative Assistant), Mark Kaferlein (Building Commissioner-Remote), William Cundiff (Town Engineer)

BUSINESS:

7:05 PM PUBLIC HEARING CONTINUED: REBECCA LARAMEE (CASE #2020-04), 17 Hough Road-Possible Votes.
Ms. Laramee joined the meeting. Mr. Heney informed Ms. Laramee that she would need four votes to approve the Special Permit, therefore if a vote is taken tonight, it would need to be unanimous. The appeal process was explained to her. A discussion was held. Ms. Laramee decided to move ahead with tonight’s meeting.
Ms. Laramee stated that she sent some “stuff” to Ms. Lajoie. Ms. Lajoie stated that a letter was received today. Mr. Cundiff stated that three emails were forwarded to the ZBA earlier, and three forwarded tonight. The emails and letter are from abutters. Ms. Laramee distributed the letters.
Ms. Laramee stated that, at the time Mr. Kaferlein issued the Stop Work Order, just a 2x8 was holding the roof up. Ms. Laramee was told she had “to make it safe”, therefore she put up crossbeams. The project is not finished. A discussion was held.
Mr. Kaferlein stated that he had instructed Ms. Laramee to add cross bracing on the posts and the beams, but he did not tell her to put up the rafters, sheathing, or metal roofing. A discussion was held.
The ZBA has yet to see a certified plot plan. Mr. Fitzpatrick’s opinion is that 3.5’ to 5’ is not a reasonable distance from a property line. Mr. Tusino suggested Ms. Laramee get her property surveyed. Ms. Holmes suggested that Ms. Laramee move the structure away from the property line. A discussion was held.
The ZBA explained why a nonconforming structure cannot be replaced with a more nonconforming structure. A discussion was held. Ms. Laramee will have a plot plan done.
Mr. Fitzpatrick made a motion to continue the public hearing for Rebecca Laramee (Case #2020-04), 17 Hough Road to September 9, 2020 at 7:00 PM. Ms. Holmes seconded the motion. Roll Call Vote: Daniel Heney-Aye, Michael Fitzpatrick-Aye, Pamela Holmes-Aye, Louis Tusino-Aye.


DISCUSSION:
1. Planning Board Site Plan Review Application: 93 Davis Realty Trust, 93 Davis Street-Possible Votes. Ms. Holmes was concerned about traffic. A discussion was held regarding police details. Overflow parking issue has not yet been resolved.
2. MINUTES: January 8, February 12, March 11, and June 10, 2020-Possible Votes.
Ms. Holmes made a motion to approve the January 8, 2020 ZBA meeting minutes as presented. Mr. Fitzpatrick seconded the motion. Vote: Aye-4.
Ms. Holmes made a motion to approve the February 12, 2020 ZBA meeting minutes as presented. Mr. Tusino seconded the motion. Vote: Aye-3, Mr. Heney abstained.
Ms. Holmes made a motion to approve the March 11, 2020 ZBA meeting minutes as presented. Mr. Fitzpatrick seconded the motion. Vote: Aye-4.
Approval of the June 10, 2020 ZBA meeting minutes was deferred to the next meeting.
3. Sign: Invoices and McIntyre decision.

OTHER TOPICS:
Ms. Holmes has seen concrete steps on a new constructions not resting on the ground. Mr. Kaferlein responded that the steps are bolted into the foundation and do not need to be resting on the ground.
Mr. Fitzpatrick asked to have copies of the information for case #2020-04 placed in the packet.
Ms. Holmes asked if Ms. Sullivan has been contacted regarding getting a copy of the plans for Olde Colony Road, Dermitt Collins. Ms. Lajoie will get in touch with her.

8:11 PM ADJOURNMENT:
Mr. Fitzpatrick made a motion at 8:12 PM to adjourn the ZBA meeting. Ms. Holmes seconded the motion. Roll Call Vote: Daniel Heney-Aye, Michael Fitzpatrick-Aye, Pamela Holmes-Aye, Louis Tusino-Aye.
