Meeting Minutes
November 13, 2007

• Call to Order – Session I:
Chairman Michael Hughes called the meeting to order at 6:05 pm. In attendance: Paula Brouillette, Mitch Cohen, and Executive Administrator Michael Guzinski. John Bombara, Scott Medeiros absent.

Other staff and citizens; Kopelman & Paige Attorney Rich Bowen, Attorney Jonathan Eichman.

• Executive Session I:
Mitch Cohen made a motion at 6:05 pm to go into Executive Session for the purpose of litigation and return to regular session before adjournment. Paula Brouillette seconded the motion. Roll Call Vote: Mitch Cohen – aye, Paula Brouillette – aye, Michael Hughes – aye.

Mitch Cohen made a motion at 7:00 pm to leave Executive Session for the purpose of joining the Planning Board meeting and to return to Executive Session for additional items. Paula Brouillette seconded the motion. Roll Call Vote: Mitch Cohen – aye, Paula Brouillette – aye, Michael Hughes – aye.

• Call to Order – Session II:
Chairman Michael Hughes called the meeting to order at 7:48 pm. In attendance: Paula Brouillette, Mitch Cohen, and Executive Administrator Michael Guzinski. John Bombara, Scott Medeiros absent.

Mitch Cohen made a motion at 8:36 pm to leave Executive Session and to return to Regular Session before adjourning. Paula Brouillette seconded the motion. Roll Call Vote: Mitch Cohen – aye, Paula Brouillette – aye, Michael Hughes – aye.

• Financial Policy: Michael Guzinksi handed out a draft Financial Policy for the Boards review. This item will be on the agenda for December 4th.

• Annual MMA Conference: At Suzanne Kane’s request, Michael Guzinski asked the Board if they had any objections to Ms. Kane attending the Annual MMA Conference in Boston this year. She has gone the past couple of years and gets a lot of information from this conference. The Board had no objections.

• Job Descriptions – Selectmen’s Office: Michael Guzinski reported that the job description for the Administrative Assistant and Administrative Secretary in the Selectmen’s Office were reviewed and updated in the fall. He will now be bringing them to the Personnel Board. Copies will be in the Selectmen’s read file.

• Corridor Commission: Michael Guzinski reported that the quarterly meeting for the Corridor Commission will be held in Douglas on Thursday at 9:00 am. This is the first time the meeting is in Douglas and it is an open public meeting.

• Agreement with Greenman – Pederson, Inc.: At the request of Town Engineer William Cundiff, Michael Guzinski presented an amendment to the agreement with Greenman – Pederson, Inc. for the Rt. 16 project. There are two things that are not on the original agreement; prepare a standard MassHighway traffic signal layout for the new over head flashing light requested by MassHighway and an alteration plan and order of taking for discontinuance of Davis Street as a State Highway. The total changes will cost approximately $6,700., which is already calculated into the Chapter 90 funds – the State has no problems with it. The Board asked that this item be placed on the next agenda.

• Perry Street Extension: Referring to a request from a citizen on Perry Street Extension, Paula Brouillette stated the Board has to determine if from a public safety standpoint this is something important to address. She would like to help the owners submit a petition for paving they would pay for and suggested the Board have a discussion on a Private Road Policy. Michael Guzinski outlined the history – in 2004 the Perry Street Extension citizen filed a petition to pave a private way. The process is a petition with the required number of signatures is placed on Town Meeting. If it is approved the Town is required to pave the road. The Town pays for the paving but then takes out a bond totaling the cost. Every year when the payment is due everyone on the street is assessed for their portion of the bond payment based on a percentage of their frontage. When the citizen filed in 2004 he did not file properly so it did not go to Town Meeting – problems with the language. The next year Michael Guzinski offered to help with the language but he did not hear from the citizen again until this morning. Michael Guzinski stated the estimated cost for the paving is well over one million dollars. Consensus of the Board to place a Private Road Policy item on the next agenda – covering issues of maintenance and paving.

• Adjournment:

Mitch Cohen made a motion at 9:03 pm to adjourn. Paula Brouillette seconded the motion. All – aye.
