Board of Selectmen’s Meeting
December 12, 2000 at 7:00 PM


Members Present: Rich Preston, Ron Forget, Shirley Mosczynski, Buff Therrien


1. Call to order at 7:00 PM

2. Chairman’s Announcements
• Encourage residents to participate in town government. If there are any interests please contact the Selectmen's Office at 508-476-4000 ext. 350
• Selectmen’s Meetings will be recorded and played on channel 18 for those who cannot watch during the time of the meetings.

3. Acceptance of Minutes
• October 24, 2000
 Shirley Mosczynski moved to approve October 24, 2000 minutes as amended, seconded by Buff Therrien.
• VOTE: 3 in favor, 1 abstain due to being absent (Ron Forget)
• Rich Preston requested a revised copy of minutes.

4. Winter Town Meeting Date
• Norman MacNeill presented three possible dates for the Town Meeting
 March 5, March 15 and March 26.
• Norm MacNeill recommended the last date (March 26)
• Shirley Mosczynski questioned whether these dates have been discussed with the Town Clerk.
 They will be discussed with the Town Clerk
• It was the consensus of the Board that the date of the Winter Town Meeting be March 26, 2000, pending discussion with the Town Clerk.

5. Response to School Committee Report
• Norman MacNeill presented a letter written to the Board of Selectmen from the School Committee regarding the School Building Project and School Building Committee
• Norm presented a letter to the School Committee on behalf of the Board of Selectmen regarding the School Committee’s role to the School Building Committee.
 The School Building Committee will fall under and report to the School Committee
 The Board of Selectmen will retained no administrative oversight to this responsibility.
• Shirley Mosczynski moved to approve the presented letter as prepared by Norman MacNeill in response to the School Committee’s letter dated December 8, 2000, seconded by Ron Forget.
 VOTE: ALL IN FAVOR
• This letter is only lending clarity and defining roles and responsibilities to what has already been established.

6. New Business
• Ron Forget stated that there is a need for signing to be on a future agenda.
• Buff Therrien stated his concern with town employees who are not represented by a union not being compensated during the Personnel Classification Study regarding salary and salary increase percentages.
 Norman MacNeill stated that there has been no particular recommendation for the increased cost of living percent.
• Buff Therrien questioned issue regarding Grove and West Street
 Buff Therrien will contact a nursery to begin to take care of this problem because it is a safety issue.

7. Cable Advisory Committee Meeting joint with Board of Selectmen
• Began at 8:30 PM
• Members Present: Rich Preston, Shirley Mosczynski, Ron Forget, Buff Therrien, Paul Crandall.
• Due to lack of interest from residents, the Board of Selectmen have been appointed to the Cable Advisory Committee along with Marc Serra and Paul Crandall.
• Reorganization
 Establishing Chairman and Vice Chairman
 Ron Forget nominated Rich Preston and Tom Navaroli as Cable Advisory Committee Chairman and Vice Chairman.
 Shirley Mosczynski moved to appoint Rich Preston as Chairman and Tom Navaroli as Vice Chairman of the Cable Advisory Committee, seconded by Ron Forget.
• VOTE: ALL IN FAVOR
 Rich Preston thanked Paul Crandall for his willingness and activity as a member.
• Camera Purchase
 The camera was purchased for residents to be able to have more exposure of town meetings.
 The Cable Advisory Committee fund’s balance is $2,714 as of November 2000.
 Ron Forget stated that rates from Cable Company should be negotiated, they are only giving the town $.50 per subscribed household.
 Ron Forget questioned if we would be better off using the fund to up date our equipment.
 Rich Preston proposed the approval of the purchase of the camera and to look into pricing of proper VCR.
 Ron Forget moved to approve the camera and looking into pricing of an appropriate VCR and to authorize Norman MacNeill to use the Selectmen’s budget with in reason to purchase an appropriate VCR, seconded by Shirley Mosczynski.
• VOTE: ALL IN FAVOR
• Cable Renewal process
 Current contract/agreement expires August 2003.
 Norman MacNeill proposed a schedule to come out of negotiations in March of 2002.
 Looking to set public hearing dates or set meetings to set these dates.
 The survey process needs to identify as many needs of the residents as possible.
 Rich Preston stated that town counsel emphasized public hearings to use as grounds for negotiations.
 Ron Forget questioned looking at other communities “access” communication equipment and facilities.
• Norman MacNeill agreed to obtain videos of this.
 We do not have to negotiation if the Cable Company does not comply with needs of the town.
 Norman MacNeill proposed to set dates for the public hearings.
• Have the survey out bye the first public hearing so the results can be used for information.
• Move the first public hearing to June 5, 2001.
• Shirley Mosczynski moved to approve the schedule for the Cable Contract Renewal process as amended, seconded by Ron Forget.
• VOTE: ALL IN FAVOR
 Paul Crandall volunteered to develop a survey by using samples from other communities.
 The next Cable Advisory Committee meeting will be January 23, 2000 with the Board of Selectmen.
 Shirley Mosczynski moved to adjourn at 8:20 PM, seconded by Ron Forget
• VOTE: ALL IN FAVOR

• Norman MacNeill reported on Massachusetts Rural Development Council
 January 26, 27, and 28 – Reaching into the historical Past of the Community.

8. Executive Session.
• Note that the Board of Selectmen will adjourn after Executive Session.
• Shirley Mosczynski motioned to have a five-minute recess at 8:25 PM, seconded by Ron Forget.
 VOTE: ALL IN FAVOR
• Ron Forget moved to come out of recess at 8:30 PM, seconded by Shirley Mosczynski
 VOTE: ALL IN FAVOR
• Shirley Mosczynski moved to convene in Executive Session on three matters as follows: (1) To meet with the Conservation Commission and Planning Board to discuss strategy with respect to litigation in the matter of Town v. Vecchione where such discussion may have a detrimental effect on the litigation position of the Town; (2) To meet with the Planning Board to discuss strategy with respect to litigation in the matter of Schwartz v. Town where such discussion may have a detrimental effect on the litigation position of the Town; and (3) To discuss strategy with respect to litigation in the matter of Town v/ Renaud, Trustee where such discussion may have a detrimental effect on the litigation position of the Town. The Board intends to adjourn immediately upon the close of the Executive session. Seconded by Ron Forget. Role call vote: Richard Preston aye, Shirley Mosczynski aye, Ronald Forget aye, Edward Therrien aye.

9. Adjourn
• Shirley Mosczynski moved to adjourn at 11:05 PM, seconded by Ron Forget.
 VOTE: ALL IN FAVOR
