ATTENDANCE
Chairwoman Marylynne Dube, Vice Chairman Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, Angela Saunders (Associate Member), Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary). Absent was David Windoloski.

7:00 PM CONSERVATION BUSINESS
1. Request for Certificate of Compliance/Schedule Site Walk: KTKM
Realty Trust, 14 Cobblestone Road, Lot #39. The Commission said that they will discuss this at the next meeting because they want to wait until the grass grows.
2. Request for Certificate of Compliance/Schedule Site Walk: Douglas Properties, Webster Street. The Commission will do a site walk on Tuesday, April 14, 2009, at approximately 10:00am.
3. Request for Certificate of Compliance/Schedule Site Walk: Odisef Tsimogiannis, 42 Martin Road. Zisk did a site walk and took pictures. A MOTION was made by Brown to issue a Certificate of Compliance, seconded by Yacino. VOTE: YES-5, ABSTAINED-1. VOTE PASSED.
4. Request for Certificate of Compliance/Schedule Site Walk: Alternatives Unlimited, 6 North Street. Zisk said that he would contact the above to have them sweep the parking lot.
5. Request for Extension Permit for Order of Conditions: Framingham Co-operative Bank, 301 Northwest Main Street (“Whitin Reservoir Estates”). A MOTION was made by Yacino to grant a one-year Extension Permit from the date of their request, seconded by Mosczynski. VOTE UNANIMOUS.
6. Request for Certificate of Compliance/Schedule Site Walk: Jesse & Deborah Speckhard, 93 Chestnut Street. Zisk was asked to find out if this is a DEP Superseding Order.
7. Request for Extension Permit for Order of Conditions: Pride Real Estate, “Morse Pond Preserve” Subdivision, Southwest Main Street. A MOTION was made by Yacino to issue a one-year Extension under our Local Bylaw (4/18/2010), seconded by Brown. VOTE UNANIMOUS.
8. Letter from William & Barbara Petrocelli, 127 West Street regarding 133 West Street. The Commission will do a site walk on Tuesday, April 14, 2009, at approximately 10:00am. They will also do a site walk at 137 West Street.

7:25 PM PUBLIC MEETING: GEORGE LAHOUSSE (RDA)
1 Buxton Road
The Applicant was present. He is requesting permission to finish grading, screen and spread loam, seed entire yard, plant shrubs and mulch where needed. He would also like to install a walkway to the front door and replace the driveway. Zisk said that a stone berm (wall) should be constructed to prevent silt from going into the intermittent stream. A MOTION was made by Yacino to issue a Negative Determination of Applicability, seconded by Mosczynski. VOTE UNANIMOUS.

7:30 PM PUBLIC HEARING: MICHAEL NELSON (NOI)
143 Shore Road
Present was Applicant Michael Nelson and his representative Michael Andrade of Graves Engineering. The scope of work is to clean out the swale and place a 24-inch culvert pipe that leads to the lake. Nelson said that the swale is in disrepair. The head wall and 12-inch culvert will be removed. Cundiff and Zisk are concerned about the depth of the swale which is 3 to 4-feet into the structure. Yacino suggests removing the silt from the pipe prior to going into the lake. Mosczynski asked if the Highway Department will keep the basin clean because it is not a town road. Nelson said that he would keep the catch basin cleaned himself. Andrade said that he wants to put in rip rap to stabilize the area. Zisk said that this may undermine Shore Road. Cundiff feels that a 4-foot swale is not adequate and to have a minor pitch in the surface swale because there is room further away. A shallow 2-foot deep swale can accommodate three (3) 12-inch pipes and get the same capacity. Depth is an issue. Dudley suggested making the swale wider and slope down. Andrade said that there would be a minimal cover on the pipe. Zisk said that they would be replicating 25 square feet. Cundiff asked Andrade to show a cross section and topography on the plan. A MOTION was made by Yacino to continue the Public Hearing on Tuesday, April 21, 2009, at 7:15pm, seconded by Brown. VOTE UNANIMOUS.

7:52 PM PUBLIC HEARING CONTINUED: DOUGLAS PROPERTIES, LLC
(NOI) “Lakewood Estates” Subdivision
289 Wallum Lake Road
The Commission received a letter dated 4/3/09 from Michael Yerka of Yerka Engineering requesting a continuance. A MOTION was made by Brown to continue the Public Hearing on Monday, May 18, 2009 at 8:00pm, seconded by Dudley. VOTE UNANIMOUS.

A MOTION was made by Brown to approve the Meeting Minutes of Monday, January 5, 2009, as written, seconded by Yacino. VOTE UNANIMOUS.

A MOTION was made by Brown to approve the Meeting Minutes of Tuesday, January 20, 2009, as written, seconded by Van Roo. VOTE UNANIMOUS.

MEETING MINUTES OF 2/2/09
A MOTION was made by Yacino to approve the Meeting Minutes of Monday, February 2, 2009, as amended, seconded by Van Roo. VOTE UNANIMOUS.

MEETING MINUTES OF 2/9/09
A MOTION was made by Brown to approve the Meeting Minutes of Monday, February 9, 2009, as amended, seconded by Van Roo. VOTE UNANIMOUS.

MEETING MINUTES OF 2/17/09
A MOTION was made by Brown to approve the Meeting Minutes of Tuesday, February, 2009, as amended, seconded by Van Roo. VOTE UNANIMOUS.

8:04 PM PUBLIC MEETING: BARBARA DELUCA (RDA)
58 Southeast Main Street
Present was the Applicant Barbara Deluca. The scope of work is to construct a 24-foot by 24-foot addition (Accessory Apartment) to the existing dwelling. The proposed work is approximately 90-feet to an intermittent stream and 60-feet from the buffer zone. A MOTION was made by Yacino to issue a Negative Determination of Applicability, with a condition that double staked straw bales are placed at the edge of the lawn, seconded by Brown. VOTE UNANIMOUS.

MEETING MINUTES OF 3/2/09
A MOTION was made by Yacino to approve the Meeting Minutes of Monday, March 2, 2009, as amended, seconded by Brown. VOTE: YES-4, ABSTAINED-2. VOTE PASSED.

*The Meeting Minutes of 3/16/09 are on hold for the next meeting. Chesley to review tape.

8:25 PM PUBLIC HEARING: WASHINGTON MUTUAL BANK (NOI)
137 West Street
Present was the Applicants representative Mike Catalano of Inline Associates to inform the Commission that he did not advertise the Public Hearing. The Commission gave him a new Public Hearing date of 5/5/09 @ 8:00pm.

8:30 PM PUBLIC HEARING: GUARANTEED BUILDERS
AND DEVELOPERS, INC. (NOI)
93 Davis Street
The Commission received a letter dated 4/6/09 from the Applicants representative William Drexel of Northwest Engineering stating that the legal notice did not run in the Telegram as arranged. He will advertise and notify the abutters again. The Commission scheduled a new Public Hearing date of 5/5/09 @ 8:15pm.

DISCUSSION
1. Whitin Reservoir. Cundiff asked the Commission if they want to hire Kopelman & Paige or Kathleen Connolly (the Sutton Conservation Commission’s Attorney for the Manchaug Pond filing) to help with the Notice of Intent. Zisk will contact Connolly to ask for a scope of services. This will be discussed at the next meeting along with a set fee not to exceed a certain amount.

At 8:43pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Brown. VOTE UNANIMOUS.
