The meeting was called to order at 7:25pm.

ATTENDANCE
Chairwoman Marylynne Dube, Vice Chairman Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, David Windoloski, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary). Absent was Angela Saunders (Associate Member).

7:25 PM PUBLIC HEARING CONTINUED: JEFFREY MILLER (NOI)
26 Northwest Main Street, Lot #1
The Commission received the final revised plan that was approved by the Board of Health. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Mosczynski. VOTE UNANIMOUS.

7:28 PM CONSERVATION COMMISSION APPOINTMENTS
Received a Memo from the Board of Selectmen’s Office stating that Commission Members Michael Yacino, Linda Brown and Brandi Van Roo three year terms will be ending as of June 30, 2009. Chesley was asked to write the Selectmen’s Office stating that the Commission recommended the reappointment Yacino, Brown and Van Roo for another three year term.

7:32 PM PUBLIC HEARING: DOUGLAS PUBLIC SCHOOLS
33 Davis Street
Present on behalf of the Applicant was Mark Mungeam and Robert Doyon. The scope of work is to create a 1.6 mile (team will run it twice) cross country course for the school to hold track meets and will also be open to the public. 80% of the course is on an existing trail and there are wetlands in two areas. Wellman Brook is located at the entrance to the high school and Mungeam said that flat stones will be placed on either side of the road. Due west of the high school was an existing trail bridge that is now gone. Mungeam wants to add a bridge with 2 20-foot long logs laid across and place them 5-feet apart with planks and hand rails. There will be no clearing required. Mungeam said that a new crossing is needed at a ponded area by adding a 12-inch pipe 10-feet long and fill a wet area 6-feet long. Mungeam will be using the existing rocks and will place rip rap. Mosczynski asked what kind of timbers would be used and Mungeam said oak trees 20-feet long. Van Roo asked about the use of equipment and Mungeam said a winch and pulleys and maybe a backhoe. Mungeam said it will be a corduroy bridge with the oak planks being laid side by side. Zisk said that it will be a nice spot when it is done and the town residents will be able to enjoy it too. Cundiff said that this project is an overall benefit with stabilized areas. The Commission told Mungeam that as a condition no equipment shall be stored overnight in the buffer zone. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Brown. VOTE UNANIMOUS.

7:55 PM PUBLIC MEETING: SCOTT & CHRISTINA WASSELL (RDA)
Oak Street
Mosczynski recused himself because he is an abutter. Present were the Applicants and their representative Normand Gamache of Guerriere & Halnon. The scope of work is to access the property to do perk testing down on the hill side. A site walk was done and there is 23-feet between the two trees to the perk testing area (a large white oak and a dead tree) all located in the buffer zone. Gamache said they would use a mini excavator and will place straw bales on the down side. Van Roo asked about storing equipment and Gamache said that it would not be kept on site overnight. A MOTION was made by Yacino to issue a Negative Determination of Applicability, seconded by Brown. VOTE UNANIMOUS.

8:00 PM PUBLIC HEARING CONTINUED: DOUGLAS PROPERTIES, LLC (NOI) “Lakewood Estates” Subdivision

The Commission received a letter from Michael Yerka of Yerka Engineering dated 5/18/09 on behalf of the Applicant requesting a continuance to allow additional time for review of the revised plans by Zisk. A MOTION was made by Yacino to continue the Public Hearing on Monday, June 1, 2009 at 7:45pm, seconded by Van Roo. VOTE UNANIMOUS.

The Commission received a letter from Edwin Taipale dated 5/5/09 on behalf of the Applicant requesting a continuance to 7/20/09 @ 8:30pm. A MOTION was made by Yacino to continue the Public Hearing on Monday, July 20, 2009 at 8:30pm, seconded by Brown. VOTE UNANIMOUS.

8:16 PM PUBLIC MEETING CONTINUED: MICHAEL ZWICKER (RDA)
46 Oak Street
Mosczynski recused himself because he is an abutter. Mr. Zwicker was present. The scope of work is to put in a road through his property to have access to the end of his property so that he can cut trees for personal firewood and make a path to build a fieldstone wall along the property line within a wetland buffer zone. Zwicker said that DEP told him that he could cut the trees for his own personal use. The Commission is concerned about cutting the trees and said that he would have to cut them “off season” during the winter. Zwicker wants to use a backhoe to put in a road. Yacino said that the Commission needs to know exactly what will be done and this would require a plan showing the trees, shrubs and use of the motorized equipment. Yacino feels that a Notice of Intent should be filed. Van Roo said that the crown cover shall not be less than 50% and the Commission will require this in writing. After discussion, a MOTION was made by Yacino to issue a Positive Determination of Applicability, seconded by Brown. VOTE UNANIMOUS. Zisk said he would contact Guy Lachance at DCR.

DEP has scheduled a site walk at Ed’s Construction, 88 West Street on May 20, 2009, at 10:30am.

At 8:43pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Brown. VOTE UNANIMOUS.
