The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Vice Chairman Michael Yacino, Linda Brown, Ralph Dudley, Brandi Van Roo, David Windoloski, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary). Absent was Leon Mosczynski.

7:00 PM CONSERVATION BUSINESS
1. Request for a Partial Certificate of Compliance: Nathaniel Smith, Northwest Main Street: Lot #3. This is a release for the existing house in the front of the property. The Commission asked that a condition be put on the Partial Certificate of Compliance stating that “no work is to be done on Lot #2”. A MOTION was made by Yacino to issue a Partial Certificate of Compliance, seconded by Van Roo. VOTE UNANIMOUS. The Commission signed this.
2. Request for a Certificate of Compliance: Jonathan & Sarah McClure, Hemlock Street. A site walk will be done on 7/30/09 at 5:15pm.
3. Request for a Certificate of Compliance: Richard Mosher, 12 Shady Lane. A site walk will be done on 7/30/09 at 5:30pm.
4. 105 Shore Road: Photo taken by Guaranteed Builders regarding septic issues from his neighbor’s yard. Cundiff will send a letter to the Board of Health. A site walk will be done on 7/30/09 at 5:45pm.

2. Extension Permit for Order of Conditions: John Morais, 5 Fairbanks Court. A MOTION was made by Yacino to grant a one-year extension permit, seconded by Van Roo. VOTE UNANIMOUS.
3. Certificate of Compliance: Taryn & Christopher Eisnor, 103 Franklin Street. A MOTION was made by Yacino to issue a Certificate of Compliance, seconded by Brown. VOTE UNANIMOUS.
4. Meeting Minutes. The Minutes will be approved at the next meeting.

7:30 PM PUBLIC HEARING CONTINUED: DOUGLAS PROPERTIES, LLC
(NOI) “Lakewood Estates” Subdivision
289 Wallum Lake Road
Present was Applicant Cliff Van Reed and Michael Yerka of Yerka Engineering. Yerka said that the drainage issues were taken care of with Mr. Michael Nelson. Zisk’s comments have been addressed. Yerka said he was almost done with the Planning Board and needs to provide the cost of the stormwater system. Yerka asked for a continuance to the 2nd week of August. A MOTION was made by Yacino to continue the Public Hearing on Monday, August 17, 2009 at 7:30pm, seconded by Van Roo. VOTE UNANIMOUS.

DISCUSSION
Proposals for Webster Street (Wind Farm) ANRAD Wetland Delineation. Cundiff submitted two proposals from EcoTec, Inc and BSC Group for the Commission’s review and decision. EcoTec’s proposal was $3,430 and BSC Group’s proposal was $2,145. After discussion, a MOTION was made by Brown to accept the proposal from BSC Group in the amount of $2,145, seconded by Yacino. VOTE UNANIMOUS. Cundiff will contact BSC Group and have them start the wetland delineation on Webster Street.

7:45 PM PUBLIC HEARING: JOHN & STACEY BAGAGLIO (NOI)
9 Potter Road
Present were the Applicants and their representative Steven O’Connell of Andrews Survey. The work includes the installation of a 109-foot by 90-foot horse riding ring, wood post and rail fence and associated earthwork. The Applicants have a 33-foot wide Mobil Pipeline Restriction on their property. Mass Wildlife will be responding with their comments by 7/30/09 (wood turtle). There are two scenarios: a) Tilt the ring slightly because it will lower the elevation. The Applicants said that the ring would then be too small. B) Install a retaining wall on the high side using 3-foot boulders horizontally and compact surface. O’Connell said they staked the 200-foot riverfront Mobil Pipeline and the boundaries have been surveyed. Cundiff asked O’Connell to show the monuments and elevation differential and have John Andrews stamp the plan (Surveyor). The Commission scheduled a site walk on 7/30/09 at 6:30pm. A MOTION was made by Yacino to continue the Public Hearing on Monday, August 3, 2009 at 8:30pm, seconded by Van Roo. VOTE UNANIMOUS.

8:00 PM PUBLIC HEARING CONTINUED: GUARANTEED BUILDERS AND DEVELOPERS, INC. (NOI)
93 Davis Street
Present on behalf of the Applicant was William Drexel. Revised plans were submitted. Drexel said that the gravel was tested in the underground storage for permeability and ground water area elevation. The outflow will go into the wetland and will use a conservation seed mix. The driveway will be paved asphalt out front. The grass area will have honeycomb sheets in the ground for stabilization and isolated building roof drains. Cundiff asked Drexel to get him the drainage calculations. A MOTION was made by Yacino to continue the Public Hearing on Monday, August 17, 2009 at 7:45pm, seconded by Brown. VOTE UNANIMOUS. A site walk will be scheduled on 8/3/09.

8:30 PM PUBLIC HEARING CONTINUED: NORTH BROWN, LLC (NOI) “North Village” (Chapter 40B project)
Located off of North Street
Neither the Applicant nor the representative appeared for this Hearing. A MOTION was made by Yacino to continue the Public Hearing on Monday, August 17, 2009 at 8:00pm, seconded by Brown. VOTE: YES-4, ABSTAINED-1. VOTE PASSED. Cundiff will contact the representative.

ADJOURNMENT
At 8:45pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Brown. VOTE UNANIMOUS.
