The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Vice Chairman Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, David Windoloski, Stephen Zisk (Planning/Conservation Agent) and William Cundiff (Town Engineer).

7:00 PM CONSERVATION BUSINESS
1. Carrie Webb & James Athanas, 34 Peters Cove Road. Erosion control is replaced from the well installation. Straw bales were inadvertently removed. New straw bales and silt fence are in place. The new owners are advised of the Order of Conditions and will contact Zisk prior to any other construction.
2. Schedule Site Walk: Guaranteed Builders, 93 Davis Street

7:30 PM PUBLIC HEARING CONTINUED: MUMFORD RIVER
RESERVOIR COMPANY (NOI)
Whitin Reservoir Dam, Northwest Main Street
The Commission received a letter from Wendy Porter dated 7/30/09 withdrawing this Notice of Intent because the Whitin Watershed District will be taking the dam by eminent domain. The Whitin Watershed District will file a separate Notice of Intent for water level management at Whitin Dam. A MOTION was made by Yacino to close the Public Hearing, seconded by Van Roo. VOTE UNANIMOUS.

7:45 PM PUBLIC HEARING: TOWN OF DOUGLAS - BOARD OF
SELECTMEN (ANRAD)
Webster Street, Rte. 16 (Wind Farm)
Present on behalf of the Town was William Cundiff, Town Engineer. This parcel consists of 250 acres and is south of Rte 16 on Webster Street. Daniel Orwig Associates did a wetland delineation on behalf of the Board of Selectmen. BSC Group was hired by the Commission to do a wetland delineation for them. BSC Group will have a final report for the Commission by next week. A MOTION was made by Yacino to continue the Public Hearing on Monday, August 17, 2009 at 8:45pm, seconded by Van Roo. VOTE UNANIMOUS.

8:00 PM PUBLIC HEARING: SCOTT WASSELL (NOI)
54 Oak Street
Present on behalf of the Applicant was Michael Weaver of Guerriere & Halnon. Leon Mosczynski recused himself because he is an abutter. The scope of work consists of the construction of a single family house, driveway, septic system and grading. This lot was approved as a reduced frontage lot by the Planning Board. Board of Health has approved the plan. The large maple tree between the property line and the wetland will not be removed or tree roots disturbed by the driveway installation. The proposed driveway will be gravel. Cundiff suggested a deep pump catch basin to be installed on the opposite side of rip rap swale and basin. The Commission wants to see a series of temporary check dams for construction of driveway put on the plan along with the deep sump catch basin and type of material for road used. Abutter Michael Zwicker of 46 Oak Street is concerned about the grade of the septic. He is concerned about additional water running off the septic and off the driveway. Erosion controls will be installed. Also, Zwicker felt that wetland flags are on his property and are not shown on the plan. Abutter Shirley Mosczynski of 60 Oak Street is concerned about fertilizers and runoff because this property is in the watershed of a stream. The Commission could make this a condition in the Orders. Abutter Susan Mosczynski of 45 Oak Street indicates that wetlands should not be an issue. The Commission scheduled a site walk on 8/6/09 at 6:00pm. They asked Weaver to stake the center line of the driveway and the southwest corners of the septic system. A MOTION was made by Yacino to continue the Public Hearing on Monday, August 17, 2009 at 7:15pm, seconded by Van Roo. VOTE UNANIMOUS.

8:15 PM PUBLIC HEARING: SKM REALTY, INC. (NOI)
75 & 91 Chestnut Street
Present on behalf of the Applicant was Michael Yerka of Yerka Engineering. This is for a shared driveway with a replication area proposed for two crossings. The replication is one to five. Yerka asked if it can be reduced to 1% in order to reduce the disturbance of the wooded area. The Commission asked Yerka to do an alternative analysis. Zisk requested a construction sequence. A DEP Number has not been issued yet. A site walk will be scheduled at the next meeting. A MOTION was made by Yacino to continue the Public Hearing on Tuesday, September 1, 2009 at 7:45pm, seconded by Mosczynski. VOTE UNANIMOUS.

8:30 PM PUBLIC HEARING CONTINUED: JOHN & STACEY BAGAGLIO (NOI)
9 Potter Road
Present on behalf of the Applicants was Steven O’Connell of Andrews Survey. The Applicants want to construct a horse riding ring. NHESP requested that as a condition that slopes vegetate naturally and the site be surveyed by a licensed surveyor. No mowing is allowed. The riding ring was reduced to 70-feet by 90-feet. A revised plan was submitted dated 6/24/09. Cundiff is fine with the new plan notes. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Van Roo. VOTE UNANIMOUS.
