The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Vice Chairman Michael Yacino, Leon Mosczynski, Linda Brown, David Windoloski, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary). Absent were Ralph Dudley and Brandi Van Roo.

7:00 PM CONSERVATION BUSINESS
1. Reorganization. A MOTION was made by Yacino to elect Marylynne Dube as Chairwoman, seconded by Brown. VOTE UNANIMOUS. A MOTION was made by Brown to elect Michael Yacino as Vice Chairman, seconded by Windoloski. VOTE UNANIMOUS.
2. Application for Boards/Commissions (2). Chesley was asked to send a letter to John Hurley and Tracy Sharkey inviting them in to the Commissions meeting on Monday, October 5, 2009 at 7:00pm.
3. Site Walks Scheduled on Wednesday, September 9, 2009 starting at 5:15pm: 14 West Street, 114 West Street, Manchaug Road, and 75 & 91Chestnut Street.

MEETING MINUTES OF 5/18/09
After review, a MOTION was made by Brown to approve the Meeting Minutes of Monday, May 18, 2009, as amended, seconded by Mosczynski. VOTE UNANIMOUS

MEETING MINUTES OF 6/1/09 – ON HOLD

MEETING MINUTES OF 6/15/09
After review, a MOTION was made by Yacino to approve the Meeting Minutes of Monday, June 15, 2009, as amended, seconded by Mosczynski. VOTE UNANIMOUS.

7:30 PM PUBLIC HEARING CONTINUED: NORTH BROWN, LLC (NOI) “North Village” (Chapter 40B project), located off of North Street
The Commission received a letter from Edwin Taipale on behalf of the Applicant dated 8/31/09 requesting a continuance to Monday, October 5, 2009 at 7:30pm. A MOTION was made by Yacino to continue the Public Hearing on Monday, October 5, 2009 at 7:30pm, seconded by Brown. VOTE UNANIMOUS.


MEETING MINUTES OF 7/20/09
After review, a MOTION was made by Brown to approve the Minutes of Monday, July 20, 2009, as amended, seconded by Yacino. VOTE UNANIMOUS.

7:35 PM EXECUTIVE SESSION: To discuss strategy with respect to Litigation Regarding Coopertown Realty Trust, 34 Davis Street
At 7:35pm, a MOTION was made by Yacino to go to Executive Session and to allow William Cundiff, Stephen Zisk and Maria Chesley to remain, seconded by Brown. The Commission will return to regular session after the Executive Session. VOTE:

Regular Session of the meeting resumed at 7:50pm.

7:51 PM PUBLIC HEARING CONTINUED: SKM REALTY, INC. (NOI) 75 & 91 Chestnut Street
Present on behalf of the Applicant was Michael Yerka of Yerka Engineering. This submittal is for two lots off a shared driveway. Zisk asked for the alternatives analysis for our file and a one to one replication. The Commission received the DEP number and comments to the Applicant. The Commission scheduled a site walk on Wednesday, September 9, 2009 between 6:30pm and 7:00pm. A MOTION was made by Yacino to continue the Public Hearing on Monday, September 14, 2009 at 8:00pm, seconded by Mosczynski. VOTE UNANIMOUS.

After review, a MOTION was made by Yacino to approve the Minutes of Monday, August 3, 2009, as amended, seconded by Brown. VOTE UNANIMOUS.

MEETING MINUTES OF 8/17/09
Dube abstained. After review, a MOTION was made by Brown to approve the Minutes of Monday, August 17, 2009, as amended, seconded by Yacino. VOTE UNANIMOUS.

8:05 PM PUBLIC HEARING: ROSS TUBO (NOI)
43 Olde Carriage Lane, Lot #38
Present was the Applicant Ross Tubo and his representative Robert Poxon of Guerriere & Halnon. The scope of work consists of clearing of vegetation within the 100-foot buffer associated with a single family house. Tubo said that he would be cutting down two large pine trees, stumping and grading. Yacino asked if the trees were marked and Poxon said yes (three to four pine trees and some oak trees). The Commission will do a site walk on 9/9/09 if they have time and if not, they will go to the site on their own. Cundiff asked Tubo if he will be removing the trees from the property and Tubo said yes. A MOTION was made by Brown to continue the Public Hearing on Monday, September 14, 2009, at 8:45pm. VOTE UNANIMOUS.

8:15 PM PUBLIC HEARING: EDWARD WHIPPLE & GERALD SKEEAN (NOI)
114 West Street
Present was Applicant Edward Whipple and his representative Scott Rabideau from Marc Nyberg Associates. The scope of work consists of the construction of a single family dwelling with a driveway, septic system and well. Rabideau said that the wetland has been flagged and he will take the house out of the 50-foot buffer zone. The Board of Health has approved the plan (an on-site system). The well is located 100-feet from the septic system in the lower right corner. Zisk said that if the Applicant wants to add a shed or a deck in the future he should put it on the plan now. Zisk also said to show the entrance on the plan. Yacino suggested moving the house by shifting it easterly. The Commission received the DEP number along with comments regarding the 20-foot wide access easement. This easement leads to a lot with no frontage and is not buildable. The Commission scheduled a site walk for Wednesday, September 9, 2009 at approximately 5:15pm to 6:00pm. A MOTION was made by Yacino to continue the Public Hearing on Monday, October 5, 2009, at 7:45pm, seconded by Brown. VOTE UNANIMOUS.

8:30 PM PUBLIC HEARING CONTINUED: DOUGLAS PROPERTIES, LLC
(NOI) “Lakewood Estates” Subdivision
289 Wallum Lake Road
Present was Michael Yerka of Yerka Engineering and Cliff Van Reed. Cundiff and Zisk said that all the issues have been resolved. Cundiff said that the Planning Board is drafting their decision at their next meeting on Tuesday. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Brown. VOTE UNANIMOUS.

1. Extension Permit: Suzanne Gagnon, off Potter Road. A MOTION was made by Yacino to issue a one-year Extension Permit, seconded by Brown. VOTE UNANIMOUS.
2. Extension Permit: Paul Boutiette dba King’s Campground Realty Trust, “South Cove Way”. A MOTION was made by Yacino to issue a one-year Extension Permit, seconded by Mosczynski. VOTE UNANIMOUS.
3. Extension Permit: Framingham Co-operative Bank, “Whitin Reservoir Estates”. A MOTION was made by Yacino to issue a one-year Extension Permit, seconded by Brown. VOTE UNANIMOUS.
4. Extension Permit: Debra Muratore, 283 Southwest Main Street. A MOTION was made by Yacino to issue a one-year Extension Permit, seconded by Brown. VOTE UNANIMOUS.

8:45 PM PUBLIC HEARING CONTINUED: GUARANTEED BUILDERS AND DEVELOPERS, INC. (NOI)
93 Davis Street
Present on behalf of the Applicant was William Drexel and William Pybas. A final revised plan was submitted dated 8/14/09. Cundiff reviewed the drainage calculations. Mosczynski asked Drexel if the well could be moved four to five feet away from the tree trunk so as not to damage the roots. A MOTION was made by Brown to close the Public Hearing and issue an Order of Conditions, seconded by Mosczynski. VOTE UNANIMOUS.

At 8:50pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Brown. VOTE UNANIMOUS.
