The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Leon Mosczynski, Linda Brown, Ralph Dudley Brandi Van Roo, David Windoloski, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary). Absent was Vice Chairman Michael Yacino.

7:00 PM CONSERVATION BUSINESS
1. Eisnor, 103 Franklin Street: Tree Removal. The Commission did a site walk due to the request of the owners asking permission to take down two large pine trees. The wood will be taken off site and there will be no stump removal. Zisk said that he would have the owners mark off the trees that are within the 100-foot buffer zone. A MOTION was made by Mosczynski to approve this request, seconded by Van Roo. VOTE UNANIMOUS.
2. Meeting Minutes of 9/1/09. After review, a MOTION was made by Brown to approve the Meeting Minutes of Tuesday, September 1, 2009, as amended, seconded by Windoloski. VOTE UNANIMOUS.
3. Cash Bond: Madden Way, Lot #11R. Cundiff informed the Commission that there is a cash bond in the amount of $500 plus interest that needs to be returned. Should the money go to a) the developer – Bruce Taylor, or b) the current homeowner. The Commission asked Cundiff to contact Town Counsel for their opinion and to establish protocol. A MOTION was made by Dudley to give Cundiff permission to contact Kopelman & Paige, seconded by Van Roo. VOTE: YES-5, ABSTAINED-1. VOTE PASSED.
4. Forest Cutting Plan: Zwicker, Oak Street. The Commission received a copy of a Forest Cutting Plan from DCR.

07:30 PM - 143-0806 (NOI): PUBLIC HEARING CONTINUED - 54 Oak Street / WASSELL, SCOTT
Leon Mosczynski recused himself. Present on behalf of the Applicant was Michael Weaver of Guerriere & Halnon. An alternative plan was presented with the house shown in the front. Zisk suggested removing the white oak tree (runoff, near culvert). The Applicant did not submit an application for a Variance to the Zoning Board of Appeals because Wassell does not have a hardship. A MOTION was made by Brown to close the Public Hearing and issue an Order of Conditions, seconded by Dudley. VOTE UNANIMOUS.

07:45 PM – 143-0807 (ANRAD): PUBLIC HEARING CONTINUED - Webster Street, Rte. 16 (Wind Farm) / TOWN OF DOUGLAS - BOARD OF SELECTMEN
Present was William Cundiff, Town Engineer on behalf of the Applicant. Cundiff said that the owners’ consultant is working with BSC Group (our wetland consultant) and will be finishing very soon. Cundiff asked for a continuance. A MOTION was made by Van Roo to continue the Public Hearing on Monday, October 5, 2009, at 8:15pm, seconded by Brown. VOTE UNANIMOUS.

DISCUSSION
1. Agendas. Cundiff informed the Commission that it is very costly to mail everyone’s agenda packages twice a month. He asked if they would either pick them up on The Thursday prior to the meeting or have the information e-mailed to them. Mosczynski and Van Roo want the information e-mailed to them and Dube, Brown and Dudley will pick them up. Chesley will ask Yacino how he would like to receive the agendas.
2. Legal Size File Cabinet. Chesley asked the Commission’s permission to purchase a legal size file cabinet. A MOTION was made by Brown to give Chesley permission to purchase a legal size file cabinet, seconded by Van Roo. VOTE UNANIMOUS.
3. Mumford Road Parking Area. Mosczynski said that parking area is needed to access the conservation land and said that the work would include clearing and fill. A MOTION was made by Brown to instruct Zisk to start the Notice of Intent process for access off of the Mumford Road conservation land, seconded by Van Roo. VOTE UNANIMOUS.

08:00 PM – 143-0810 (NOI): PUBLIC HEARING CONTINUED -
75 & 91 Chestnut Street / GOSSELIN, JOHN / SKM REALTY, INC.
Present on behalf of the Applicant was Michael Yerka of Yerka Engineering. The Commission did a site walk. The alternative analysis showed that it would double the amount of wetland crossing. The wetland replication will be a one to one instead of a two to one. The Commission agreed that the replication area has significant healthy tree and shrub growth. The Commission will continue this Hearing in order to find out if all taxes were paid. A MOTION was made by Brown to continue the Public Hearing on Monday, October 5, 2009, at 7:25pm, seconded by Van Roo. VOTE UNANIMOUS.

Discussion: Maple Street property. Yerka said that they are going to change the plan to put the house back where the septic system is out front. This will be a minor project. The house will stay out of the 50-foot buffer zone. The Commission saw no problem with this.

08:15 PM – 143-0809 (NOI): PUBLIC HEARING - 32 Kerney Road /
TUSINO, JAMES - GUARANTEED BUILDERS AND DEVELOPERS, INC.
Present on behalf of the Applicant was William Pybas of Guaranteed Builders & Developers. The work consists of construction of a single family house and the Board of Health has approved the septic system. The house is within 100-feet of the wetland buffer zone. All issues have been addressed. Cundiff said there will be a significant amount of grading that must be maintained. A condition will be added concerning construction detail on the retaining wall. Abutter Thomas Legassey of 216 Wallum Lake Road looked at the plan and is concerned about runoff. Pybas said that Guaranteed Builders and Developers would be responsible if any runoff occurs. A MOTION was made by Van Roo to close the Public Hearing and issue an Order of Conditions, seconded by Brown. VOTE UNANIMOUS.

08:30 PM – 143-0813 (NOI): PUBLIC HEARING - Manchaug Road
TOWN OF DOUGLAS - WATER-SEWER DEPARTMENT
Ralph Dudley recused himself. Present on behalf of the Applicant was Michael Weaver of Guerriere & Halnon and Robert Josey, Water/Sewer Commissioner. Cundiff said that this is a Mass Highway project because they are the owners of the road. The scope of work consists of the installation of a low pressure sewer line from Caswell Court to the Mumford River on Manchaug Road. There are three lots that will need to file for the individual grinder pump stations. Cundiff asked Weaver who is responsible to pay for the grinder pumps and Weaver said that the homeowner is. Cundiff asked when the work would be done and Weaver said probably next spring. Straw bales will be placed where it is close to the 100-foot buffer zone areas. A MOTION was made by Brown to close the Public Hearing and issue an Order of Conditions, seconded by Van Roo. VOTE UNANIMOUS.

08:45 PM – 143-0811 (NOI): PUBLIC HEARING CONTINUED – 43 Olde Carriage Lane, Lot #38 / TUBO, ROSS
Present on behalf of the Applicant was Michael Weaver of Guerriere & Halnon. The scope of work is remove 4 pine trees, some small oak and maple trees (12 trees total). A site walk was done and Zisk said that this project is for selective cutting. A MOTION was made by Brown to close the Public Hearing and issue an Order of Conditions. VOTE UNANIMOUS.
