The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Vice Chairman Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary). Absent were Brandi Van Roo, David Windoloski and Angela Saunders (Associate Member).

7:00 PM PUBLIC HEARING: TOWN OF DOUGLAS CONSERVATION COMMISSION
Proposed Updates to Wetland Protection Regulations
The Commission made minor changes to their Regulations.
Page 8 – 6.2 Hearing Continuation. Added was closing public hearings and Notice of Intent’s that have expired.
Page 10 – 10.1 Minimum Setback from Resource Area. The Commission added the word “stream”.
Page 16 - #9. The word “straw bales” was added and “hay bales” taken out.
Page 16 - Last paragraph & last sentence. “for further guidance” was removed after Conservation Agent.
A MOTION was made by Yacino to approve the Wetland Protection Regulations, as revised, seconded by Brown. VOTE UNANIMOUS.

7:15 PM CONSERVATION COMMISSION DISCUSSION
SIGNED:

2. Order of Conditions: Paul Brule, 4 Kerney Road
3. Negative Determination of Applicability: Town of Douglas, Oak Street
4. Certificate of Compliance: Brian Devlin, 14 Prentice Court
5. DISCUSSION: “Whispering Pines” Subdivision Conservation Easement. Present was Art Poisson. A MOTION was made by Yacino to obtain the easement for the Town, seconded by Mosczynski. VOTE UNANIMOUS.

7:30 PM PUBLIC HEARING: STEVEN BAGDIS (NOI)
90 Peters Cove Road
Present was the Applicant Steven Bagdis and his representative Robert Murphy of Murphy & Associates. The proposed work is to demolish and replace an existing house with a new house that will be 42-feet by 30-feet along with a new tight tank and well and regrade the front yard with new landscaping. Zisk said that Murphy submitted a revised plan to him today. Murphy said that the tight tank is outside of the 100-foot buffer zone and said that the Board of Health approved the tight tank and well but were waiting for James Malley’s approval in writing. The old well will be abandoned and the new well is closer to the water. Zisk suggested placing a pit. The grading is 6 to 8-inches in front to cover the tank. The Commission asked Bagdis if he intends to have a deck and he said yes eventually and the Commission asked Murphy to add the deck on the plan. Murphy said that the calculations were done for a 100 year floodplain; there is no bordering vegetated wetland because the concrete wall is at the edge of the water. Bagdis said that he would not be paving the driveway nor wants a shed. Murphy said that the cesspool will be crushed and filled in. The Commission will schedule a site walk at their next meeting. A MOTION was made by Yacino to continue the Public Hearing on Tuesday, September 2, 2008, at 7:45pm, seconded by Brown. VOTE UNANIMOUS.

7:45 PM PUBLIC HEARING: NATHANIEL SMITH (NOI)
75 Northwest Main Street
Present on behalf of the Applicant was Seth Lajoie of Seth Lajoie & Associates. The proposed work includes the construction of a 60-foot by 40-foot single-family home, a 370-foot gravel driveway, associated grading and a sewage disposal system. A revised plan was submitted per Zisk’s review comments. Cundiff asked Lajoie why he didn’t connect the two ends and Lajoie said he didn’t due to the topography. Zisk asked Lajoie if he had Board of Health approval and Lajoie said yes. Zisk asked Lajoie to make two sheets to show the wetland flag location and to also have the Executor of the Estate of Chandler B. Smith to sign the Notice of Intent. The Commission will schedule a site walk at their next meeting.
A MOTION was made by Yacino to continue the Public Hearing on Tuesday, September 2, 2008, at 8:00pm, seconded by Brown. VOTE UNANIMOUS.

8:00 PM PUBLIC HEARING: MARGARET BANAGHAN (NOI)
Walnut Street, Lot #2
Present on behalf of the Applicant was Karen Keegan of Andrews Survey. Also present was John Zifcak and Timothy Lapan on behalf of the Beagle Club. The proposed work includes the construction of a single-family home, driveway, an onsite sewage disposal system, well and associated grading. The home, sewage system and well are outside the 100-foot buffer zone. The gravel driveway is within the 50-foot buffer zone. Straw bales will be placed and will loam and seed when the work is completed. Keegan said that she received Board of Health approval. Cundiff asked Keegan to show the foundation drain, gravel drain and to pit around the well. A MOTION was made by Yacino to continue the Public Hearing on Tuesday, September 2, 2008, at 8:15pm, seconded by Brown. VOTE UNANIMOUS.

*Charles French of 229 Makowski Drive contacted Zisk and told him that he would cut the conservation land in September. The Commission asked Chesley to find out how much money the Commission paid to cut other properties in the past.

8:15 PM PUBLIC HEARING: JOSEPH FITZPATRICK (NOI)
36 Davis Street
The Commission waited until 8:30 but no one appeared for this hearing. The Commission will hold the hearing later if the Applicant should come in.

8:30 PM PUBLIC MEETING: LEON SOCHIA, IV (RDA)
11 Cook Street
Present was Applicant Leon Sochia, IV. Marylynne Dube recused herself because she is an abutter. Michael Yacino was Acting Chairman. The scope of work is to construct a new garage and remove the existing garage. The new garage will have three bays and a portion of it is within 200-feet of the Mumford River. A MOTION was made by Brown to issue a Negative Determination of Applicability, seconded by Dudley. VOTE UNANIMOUS.

8:45 PM PUBLIC HEARING: JOSEPH FITZPATRICK (NOI)
36 Davis Street
Present was the Applicant and his brother/owner James Fitzpatrick. The proposed work is to demolish the existing garage and the construction of a two car garage. The garage will be 33-feet to the edge of the wetland. Zisk asked that the straw bales be shown on the plan. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Mosczynski. VOTE UNANIMOUS.

8:55 PM PUBLIC HEARING CONTINUED: OUTLAW TWO, LLC (NOI) 34 Peters Cove Road
Present on behalf of the Applicant was Michael Weaver of Guerriere & Halnon. Ralph Dudley recused himself because he is an abutter. The scope of work includes the construction of a single-family house, on-site sewage disposal system and associated grading within a 100-foot buffer zone of a bordering vegetated wetland. A revised plan was submitted. The project was approved by the Board of Health and the Zoning Board of Appeals. The special conditions added were that all material is to be taken off the property – no stockpiling and no heavy equipment is to be left on the property. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Brown. VOTE UNANIMOUS.

MEETING MINUTES OF 7/21/08
After review, a MOTION was made by Yacino to approve the Meeting Minutes of Monday, July 21, 2008, as written, seconded by Dudley. VOTE UNANIMOUS.

ADJOURNMENT
At 9:05pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Mosczynski. VOTE UNANIMOUS.
