The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary). Absent was Brandi Van Roo, David Windoloski and Angela Saunders (Associate Member).

7:00 PM DISCUSSION: NPDES STORMWATER BYLAW
NPDES stands for the National Pollutant Discharge Elimination System. This Informational Meeting was placed in the Telegram & Gazette, posted in the Municipal Center, on the local cable access and the web site. This bylaw is to be adopted as a Stormwater Bylaw in our General Bylaws. The questions the Commission had for Town Counsel was that the maximum penalty for fines. Town Counsel said the maximum is $300.00. The Commission will go with a $300.00 fine for the first, second and third offense. The Commission’s question to Town Counsel on Section 11 F & G, Town Counsel said that the Commission could leave both F & G in the bylaw and that there would be no conflict. Town resident Eben Chesebrough has submitted questions and some of the questions the Commission had already changed.

7:20 PM DISCUSSION: 155 CEDAR STREET
Present was owner Michael Finamore. Mr. Finamore filed an Emergency Certification Form on 1/25/08 to repair the concrete head wall at the pond dam for fear of losing the building and draining the pond. This is a sluiceway at the old saw mill site on the corner of Cedar Street and Route 16. At present, jersey barriers and sand bags are in place. Zisk has contacted DEP and the Board of Selectmen. DCR (Christopher Haker) came out to the site on 1/24/08 and met with Finamore. Zisk issued an Emergency Certification Form and Finamore is waiting to hear from DEP to see if the State has jurisdiction over the dam. No work is to be done until we hear from the State. Yacino feels that from what he saw at the site there will be no potential danger of flooding below the dam site in the immediate future. Finamore will keep Zisk informed of any information from DEP.






7:45 PM PUBLIC HEARING CONTINUED: GUARANTEED BUILDERS & DEVELOPERS (NOI)
37 Glen Street, Lot #1B
The Commission received a letter dated 2/4/08 from William Pybas on behalf of the Applicant, requesting a continuance because his Engineer and the Board of Health engineer have not finalized the septic design. A MOTION was made by Yacino to continue the Public Hearing on Monday, April 7, 2008, at 7:45pm, seconded by Brown. VOTE UNANIMOUS.

7:47 PM PUBLIC HEARING CONTINUED: GUARANTEED BUILDERS & DEVELOPERS (NOI)
37 Glen Street, Lot #2B
The Commission received a letter dated 2/4/08 from William Pybas on behalf of the Applicant, requesting a continuance because his engineer and the Board of Health engineer have not finalized the septic design. A MOTION was made by Yacino to continue the Public Hearing on Monday, April 7, 2008, at 7:50pm, seconded by Brown. VOTE UNANIMOUS.

MEETING MINUTES OF 1/22/08
After review, a MOTION was made by Yacino to approve the Meeting Minutes of Tuesday, January 22, 2008, as amended, seconded by Brown. VOTE UNANIMOUS.

DISCUSSION-MAIL
1. The Commission received a letter from the Framingham Co-operative Bank dated 1/25/08 requesting an Extension for Order of Conditions for Whitin Reservoir Estates Subdivision (DEP #143-0656). Chesley will put this request on the last meeting in July to be signed prior to the Order of Conditions expiring in September, 2008.
2. Settlement Agreement: Paul Brule, Birch Hill Road & Kerney Road. This was originally an ANRAD Filing. A MOTION was made by Yacino to approve the ORAD language in the document, seconded by Brown. VOTE UNANIMOUS. The Commission signed the document from Town Counsel.
3. Staff Hours. Yacino would like to go on record that the Commission’s staff hours should not be reduced. Yacino and Dube will draft a letter to the Board of Selectmen.
4. Town Wide Private Well Water Testing. Yacino would like to see private well owners have their well water tested periodically.
5. Zisk will contact Cary VandenAkker at Wallum Lake State Park for an update on Wallis Dam.




8:15 PM PUBLIC HEARING CONTINUED: LOUIS TUSINO (NOI)
103 Shore Road
The Commission received a letter dated 2/4/08 from Louis Tusino, requesting a continuance because his engineer and the Board of Health engineer have not finalized the septic design. A MOTION was made by Yacino to continue the Public Hearing on Wednesday, April 23, 2008, at 7:30pm, seconded by Brown. VOTE UNANIMOUS.

8:17 PM PUBLIC HEARING CONTINUED: MICHAEL MARTINSEN (NOI) Gilboa Court, Lot #2
Present on behalf of the Applicant was Karen Keegan of Andrews Survey. Revised plans were submitted. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Brown. VOTE UNANIMOUS.

8:30 PM PUBLIC HEARING: MARK SANTORA (NOI)
14 Prentice Court
Present was Applicant Mark Santora. The scope of work includes the upgrade of an existing septic system. A Revised Notice of Intent was submitted. Zisk said this filing needs Board of Health approval. The wetland is on the other side of the driveway. There were no other issues. A MOTION was made by Yacino to continue the Public Hearing on Tuesday, February 19, 2008, at 8:30pm, seconded by Mosczynski. VOTE UNANIMOUS.

8:45 PM PUBLIC HEARING: WILLIAM & TEENA PORTER (NOI)
317 South Street
Present on behalf of the Applicants was Michael Yerka of Yerka/Bacon Engineering. The scope of work is for the construction of a garage within the riverfront area. This had previously been denied and appealed to DEP. DEP has turned it back to the Commission because Yerka provided flood plain calculations and a revised plan dated 12/29/07. Cundiff approved these calculations. A MOTION was made by Brown to close the Public Hearing and issue an Order of Conditions, seconded by Dudley. VOTE UNANIMOUS. The Order of Conditions will be signed at the next meeting.










ADJOURNMENT
At 8:55pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Brown. VOTE UNANIMOUS.
