The meeting was called to order at 7:05pm.

ATTENDANCE
Chairwoman Marylynne Dube, Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, Angela Saunders (Associate Member), Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary). Absent was David Windoloski.

CONSERVATION COMMISSION BUSINESS
1. Meeting Minutes of 3/3/08. After review, a MOTION was made by Yacino to approve the Meeting Minutes of Monday, March 3, 2008, as amended, seconded by Brown. VOTE UNANIMOUS.
2. Schedule Site Walk: William Staruk dba Lake Manchaug Camping,
76 Oak Street. The Commission scheduled a site walk on Tuesday,
March 25, 2008 at 5:30pm.
3. Schedule Site Walk for a Request for Certificate of Compliance:
Shawn Kasper, 42 Conservation Drive. The Commission scheduled a
site walk on Tuesday, March 25, 2008 at 5:45pm.
4. FYI. Received a copy of a letter from the Department of Conservation
& Recreation dated 2/22/08 regarding non-compliance of dam safety for
Joel Smith and Wellman Pond Dam located off of Martin Road and Depot
Street.

7:15 PM DISCUSSION: “Lakewood Estates” Subdivision.
The Commission received a letter from Michael Nelson of 143 Shore Road, regarding “Lakewood Estates” Subdivision. Abutter Michael Nelson was present.
Nelson said that he has had well issues in the past and has a shallow well. He is concerned with the proximity of the detention pond and his well right now because of the water from the Lakewood Estates site. Nelson submitted photos showing erosion and drainage problems and is letting the Commission know of these issues ahead of time.

7:30 PM PUBLIC HEARING CONTINUED: MARGARET BANAGHAN c/o
MICHAEL McCAFFREY, ESQ. (NOI)
125 Walnut Street
Present on behalf of the Applicant was Karen Keegan of Andrews Survey & Engineering. Keegan asked the Commission for a continuance of the Hearing because BSC Group (the Commissions Wetland Consultant) performed a site walk today and the wetland flags are incorrect. BSC Group wants to reschedule the delineation with the Applicants Engineer. A MOTION was made by Van Roo to continue the Public Hearing on Monday, April 7, 2008, at 8:45pm, seconded by Yacino. VOTE UNANIMOUS.

7:45 PM PUBLIC HEARING: MICHELLE LALIBERTY (NOI)
36 Riedell Road
Present on behalf of the Applicant was John Savello of Savello & Associates.
The scope of work involves re-grading a portion of property that falls within the 100-foot wetland buffer zone. This work will alleviate flooding in her back yard where the water ponds there and the wetlands have been delineated. The limit of fill and yard work will be 25-feet from the wetland and the grade will be raised with 1 ½ -feet of fill that will be brought in. Straw bales will be used and all disturbance will be on her existing lawn. Laliberty contacted DEP to have her abutter stop trying to create a pond because his actions were flooding her property. It was the consensus of the Commission to be added to the Order of Conditions stating that the existing shed that is scheduled for demolition is removed by hand only. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions with the above special condition, seconded by Mosczynski. VOTE UNANIMOUS.

8:00 PM PUBLIC HEARING CONTINUED: MARK SANTORA (NOI)
14 Prentice Court
The Commission received the Board of Health (James Malley) approval for the septic system. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Mosczynski. VOTE UNANIMOUS.

8:05 PM DISCUSSION: Chapter 43D, Webster Street
Tony Caner, Grubb & Ellis
Mr. Caner present. This parcel is located on the Douglas/Webster town line and is zoned Industrial. Caner wants to do some soil testing. There is an established path that runs through the site. The entrance way on the path currently has standing water. Dan Boone, Vice President of Durland Van Voorhis Architects said that there are other areas of wetland that they want to cross. By consensus, the Commission felt that Caner should file a minimum RDA application.

8:30 PM DISCUSSION: Cross Street Wetland Crossing
Present was Daniel Heney to ask permission to cross the wetland. This is for a previous filing on a retreat lot. Heney wants to install pipes in the crossing and steel plates on top. One of the “conditions” was that the (permanent) crossing is to be done during the dry season. Heney is asking to do this (temporary crossing) work during the wet season and said that he would post a bond now. The Commission asked Heney to file an RDA with a plan including construction protocol. The Commission tentatively scheduled Heney for his Public Meeting on 4/7/08 @ 7:15pm if the RDA is filed in time.
DISCUSSION:
1. The Commission received a letter from Fletcher, Tilton & Whipple discussing the donation of land off of Chestnut Street by John Gosselin. Cundiff asked if the Commission could authorize this to be sent to Town Counsel (Kopelman & Paige) for review at the Commission’s cost. A MOTION was made by Brown to authorize Kopelman & Paige to review the document at the Commission’s expense, seconded by Mosczynski. VOTE UNANIMOUS.
