The meeting was called to order at 7:00pm.

ATTENDENCE
Chairwoman Marylynne Dube, Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, David Windoloski, Angela Saunders (Associate Member), Stephen Zisk (Planning/Conservation Agent) and William Cundiff (Town Engineer).

CONSERVATION COMMISSION BUSINESS
1. Reorganization. A MOTION was made by Brown to re-appoint Marylynne Dube as Chairwoman and Michael Yacino as Vice Chairman, seconded by Van Roo. VOTE UNANIMOUS.
2. The Commission received a letter from Michael Guzinski, Administrator, in regard to 43D parcels. The Board of Selectmen request that ZBA, Board of Health and the Conservation Commission meet on 6/3/08 to discuss these parcels. The Board of Selectmen would like a non-quorum meeting with the Boards prior to 6/3/08. Dube and Van Roo may attend. Cundiff to get a date and time confirmation.
3. Dean & Laura Katragjini, 8 Linden Street. The Katragjini’s would like permission to bring in gravel at the east entrance to allow trucks to enter and exit. Zisk to send a letter in response.

7:30 PM PUBLIC HEARING CONTINUED: ED’S CONSTRUCTION, INC. (NOI)
88 West Street
Present on behalf of the Applicant was Erin Gallogly of Marc N. Nyberg Associates. The site does not have Board of Health approval. Abutter Jonathan Given of 92 West Street asked if the Commission has done a recent site walk and the Commission said not yet. The Commission scheduled a site walk for Thursday, May 22, 2008 at 5:15pm. The revised plan date is May 14, 2008. Abutter Kathleen Molvar of 90 West Street said that there are ongoing water drainage issues. A MOTION was made by Yacino to continue the Public Hearing on Monday, June 16, 2008, at 7:30pm, seconded by Van Roo. VOTE UNANIMOUS.

DISCUSSION
Van Roo would like to find out how to get wetland protection information out to the Douglas residents. She will contact other commissions to find out what they have sent and will update the members.

7:45 PM PUBLIC HEARING CONTINUED: MOBIL PIPE LINE COMPANY (NOI)
Ridge Trail/Northwest Main Street
Present on behalf of the Applicant was Jeff O’Donnell of Coler & Colantonio, Inc. Abutter Leon Mosczynski recused himself. The Applicant wants to relocate an existing cathodic protection system from private property to Northwest Main Street’s town right-of-way. The Board of Selectmen has authorized the relocation to town owned property with five (5) conditions. Abutter Shirley Mosczynski of 60 Oak Street said the stream on her property is in the process of being certified by the State as a cold water fishery. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions with the condition that Zisk is notified prior to construction, seconded by Van Roo. VOTE UNANIMOUS.

A MOTION was made by Brown to recess until 8:30pm, seconded by Van Roo. VOTE UNANIMOUS.

DISCUSSION:
1. Nicholas Furno, 69 Southeast Main Street. Furno present to discuss previous Order of Conditions on property he purchased. He is requesting a Certificate of Compliance and he said that he would submit his request in writing for the next meeting and the Commission will schedule a site walk at that time.

8:30 PM PUBLIC HEARING CONTINUED: MARGARET BANAGHAN c/o MICHAEL McCAFFREY, ESQ. (NOI)
125 Walnut Street
Present on behalf of the Applicant was Karen Keegan of Andrews Survey. Revised Notice of Intent and plans (dated 5/19/08) were submitted showing a revised replication, temporary construction area, rip rap and leveling pads as footings, square footage of temporary and permanent disturbance and planting schedule. Keegan said that she would e-mail the AutoCAD file to Zisk. Present on behalf of Beagle Club, abutter, was Timothy Lapan who asked what stage was the shared driveway in. This is by right and no permit is needed. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Van Roo. VOTE UNANIMOUS.

8:45 PM PUBLIC HEARING CONTINUED: OUTLAW TWO,
LLC (NOI)
34 Peters Cove Road
The Commission received a letter from Michael Weaver of Guerriere & Halnon dated 5/16/08 requesting a continuance of this Hearing to allow the Applicant to obtain Board of Health and Zoning Board of Appeals approvals. Abutter James Glode of 234 Perry Street asked about parking, the septic system and construction equipment. The Commission cannot answer these questions, only the Applicant or his representative could. The Commission did not accept the ZBA letter proposal at this time. A MOTION was made by Yacino to continue the Public Hearing on Monday, July 21, 2008, at 7:30pm, seconded by Van Roo. VOTE UNANIMOUS.
