The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Michael Yacino, Leon Mosczynski, Ralph Dudley, Linda Brown, David Windoloski, Angela Saunders (Associate Member),
Stephen Zisk (Planning/Conservation Agent) and William Cundiff (Town Engineer). Absent was Brandi Van Roo.

MEETING MINUTES OF 4/7, 4/23 & 5/6
After previously reviewed, a MOTION was made by Brown to approve the Meeting Minutes of Monday, April 7, 2008, Wednesday, April 23, 2008 and Tuesday, May 6, 2008, as amended, seconded by Dudley. VOTE UNANIMOUS.

MEETING MINUTES OF 6/16/08
After review, a MOTION was made by Yacino to approve the Meeting Minutes of Monday, June 16, 2008, as amended, seconded by Dudley. VOTE UNANIMOUS.

7:15 PM PUBLIC HEARING: TOWN OF DOUGLAS (NOI)
645 Northwest Main Street
Present was William Cundiff, Town Engineer, to represent the Town of Douglas. The scope of work consists of the relocation of the street drainage system. This is to relocate discharge culverts that drain onto Christopher Podles property. BSC Group did confirm the wetland flag delineation on behalf of the Town from a previous ANRAD filed by Mr. Podles. The location of the proposed drainage will be moved and the distance from the old location to the new location will be 150-feet. The new discharge will feed into a proposed rain garden prior to entering the wetland. No replication is needed and the flows will remain the same. The old pipe will be plugged and sealed shut with cement and brick. Mr. Podles would like to see all disturbed stones, boulders and debris be neatly placed on the site so it will look as if it was never disturbed. A MOTION was made by Brown to close the Public Hearing and issue an Order of Conditions, seconded by Yacino. VOTE UNANIMOUS.

7:30 PM PUBLIC HEARING CONTINUED: OUTLAW TWO, LLC (NOI) 34 Peters Cove Road
The Commission received a letter from Michael Weaver of Guerriere & Halnon dated 7/15/08, on behalf of the Applicant, requesting a continuance to the August 4, 2008, meeting. A MOTION was made by Yacino to continue the Public Hearing on Monday, August 4, 2008, at 8:45pm, seconded by Brown. VOTE UNANIMOUS.

SIGN:
1. Extension Permit for Order of Conditions: KTKM Realty Trust, 14 Cobblestone Lane, Lot #39. A MOTION was made by Brown to approve this request for one year (7/18/09), seconded by Yacino. VOTE UNANIMOUS.
2. Certificate of Compliance: Leon Sochia, IV, 13 Cook Street. Dube recused herself because she is an abutter. A MOTION was made by Dudley to approve this request, seconded by Mosczynski. VOTE UNANIMOUS.

7:45 PM PUBLIC HEARING: NORTH BROWN, LLC (NOI)
“North Village”, North Street
Stephen Zisk recused himself from this Hearing because he is an abutter. Present was Applicant Edwin Taipale and his representatives Art Allen of EcoTec, Inc, and Paul Hutnak of Heritage Design Group. This filing is for an affordable housing local initiative project that was endorsed by the Board of Selectmen. A public hearing has already begun with the Zoning Board of Appeals for other permits. The proposed project consists of 105 condominiums and 28 single family homes. The access to the condominiums passes through wetland at the entry way located off of North Street. There is 4,908 feet of fill proposed in the wetland and retaining walls and an arched culvert is proposed at the wetland crossing. Endangered species were found on this site when the original ANRAD was filed. A conservation restriction is proposed after the project is built. All natural seeds are proposed for swales and detention ponds. The Applicant is requesting a waiver from the Conservation Local Wetland Bylaw so that only the MGL Wetland Protection Act applies. The Order of Resource Area Delineation (ORAD) expired in August of 2007. The Applicant said the original delineation has not changed. Cundiff is still reviewing the storm water calculations. The Commission wants to see a conservation restriction document and bonding in place. Abutter John Slocum of Brown Road, Sutton, is concerned about the detention pond increasing the flow of water onto his property. Abutter Frank Silun is also concerned about drainage issues on his property and asked if the Sutton Conservation Commission has been notified because work is being proposed within 100-feet of wetlands located in Sutton. Art Allen said he would look into the wetlands on the Sutton side and get the Douglas Commission the information. Allen will also provide the entire 2004 delineation report and note any changes, if any. The Commission scheduled a site walk for Saturday, August 2, 2008, at 9:00am. A MOTION was made by Brown to continue the Public Hearing on Monday, August 18, 2008, at 8:15pm, seconded by Mosczynski. VOTE UNANIMOUS.

8:00 PM PUBLIC MEETING: HARRIET VAN DYKE (RDA)
177 Wallis Road
Present on behalf of the Applicant was Byron Andrews of Andrews Survey. The Applicant wants to install a 16-foot dock and a fence. There will be no heavy equipment to dig the fence posts, only hand tools. This will be added as a “condition”. Abutter Craig Bosma is concerned about the position of the dock. The Application is for 177 Wallis Road and the plan presented is for 179 Wallis Road. Van Dyke needs to re-advertise and re-file with the correct address of “179” instead of “177” and also needs a signature on the application. The Commission wants to see a new plan that shows the property in conjunction to the Whitin Reservoir and the location of abutting docks.

8:15 PM PUBLIC HEARING: PAUL BRULE (NOI)
4 Kerney Road
Present on behalf of the Applicant was Michael Yerka of Yerka/Bacon Engineering. The grading is within the 100-foot and 50-foot buffer zone and the proposed well is within 50-feet. A MOTION was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Brown. VOTE UNANIMOUS.

8:30 PM PUBLIC MEETING: TOWN OF DOUGLAS (RDA)
Oak Street
Present on behalf of the Applicant was William Cundiff, Town Engineer. The scope of work is to install best management practices on the existing drainage system. The stormwater outlets are in the vicinity of Manchaug Pond. The drainage catch basins will be improved. A catch basin and gabion basket is proposed for site #6. Site #7 will have a trench, catch basin, regrade, stabilization mat and overflow structure. Mosczynski asked about tree removal and Cundiff said that there is a Planning Board Public Hearing for this scenic road scheduled tomorrow night to address the trees. A MOTION was made by Yacino to issue a Negative Determination of Applicability, seconded by Brown. VOTE UNANIMOUS.

8:45 PM PUBLIC HEARING CONTINUED: KAREN SHERLOCK (NOI)
318 Northwest Main Street
Present on behalf of the Applicants was Paul Hutnak of Heritage Design Group. A revised plan was submitted that shows the house moved away from the wetland and a retaining wall is proposed. Swales along both sides of the house are to discharge to ponding area between the house and wetland. Hutnak asked for a continuance to 8/18/08. A MOTION was made by Yacino to continue the Public Hearing on Monday, August 18, 2008, at 7:30pm, seconded by Brown. VOTE UNANIMOUS.

ADJOURNMENT
At 9:35pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Windoloski. VOTE UNANIMOUS.
