The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Michael Yacino, Leon Mosczynski, Linda Brown, Brandi Van Roo, David Windoloski, Angela Saunders (Associate Member) and William Cundiff (Town Engineer). Absent was Ralph Dudley, Stephen Zisk (Planning/Conservation Agent) and Maria Chesley (Secretary).


7:00 PM DISCUSSION: NPDES Stormwater Bylaw
This discussion will be held on Tuesday, January 22, 2008, at 7:00pm.


7:10 PM DISCUSSION: North Village (Chapter 40B)
Attorney Edwin Taipale represents the owner of this property located off of North Street. The development will consist of single-family homes and townhouses. He asked the Commission to release the Local Wetland Bylaw to the Zoning Board of Appeals jurisdiction. The Commission will discuss this further at 8:30pm tonight.


7:29 PM PUBLIC MEETING CONTINUED: RONALD FORGET (RDA) 505 Northwest Main Street
Applicant Ronald Forget was present. The scope of work is to construct a run-in shed for his horses. The wetlands were delineated by Heritage Design Group and are 85-feet from the edge of the proposed building. A MOTION was made by Van Roo to issue a Negative Determination of Applicability, seconded by Mosczynski. VOTE UNANIMOUS.


7:35 PM PUBLIC MEETING CONTINUED: JOEL SMITH (RDA)
45 Martin Road
Present on behalf of the Applicant was Michael Yerka of Yerka Engineering. The scope of work is to determine that this is an intermittent stream based on the Wetlands Protection Act. A MOTION was made by Yacino to issue a Negative Determination of Applicability based on the above, seconded by Van Roo. VOTE: YES-3, ABSTAIN-2. VOTE PASSED.



7:45 PM PUBLIC MEETING CONTINUED: JAMES KOLLETT (RDA) 72 Pine Street
Present on behalf of the Applicant was Michael Yerka of Yerka Engineering. Yerka asked the Commission for a continuance of this meeting. A MOTION was made by Yacino to continue the Public Meeting on Tuesday, January 22, 2008, at 7:30pm, seconded by Brown. VOTE UNANIMOUS.


DISCUSSION: William & Teena Porter, 218 South Street
Present on behalf of the Applicant was Michael Yerka of Yerka Engineering.
Yerka asked the Commission if he could submit the calculations on the flood plain instead of a FEMA Survey. The Commission felt comfortable that Cundiff make the determination if the data submitted is enough to make the flood plain decision.


2008 CONSERVATION COMMISSION MEETING SCHEDULE
After review of Chesley’s draft, a MOTION was made by Yacino to approve the 2008 Meeting Schedule as follows: January 7 & 22, February 4 & 19, March 3 & 17, April 7 & 23, May 6 & 19, June 2 & 16, July 21, August 4 & 18, September 2 & 15, October 6 & 20, November 3 and December 8, seconded by Van Roo. VOTE UNANIMOUS.


8:00 PM PUBLIC HEARING CONTINUED: MOBIL PIPE LINE COMPANY (NOI)
Ridge Trail/Northwest Main Street
Mosczynski recused himself from this Hearing because Mobil wants to do some activity on his property. Abutter Shirley Mosczynski of 60 Oak Street informed the Commission that neither she nor her husband has been contacted by the Mobil Pipe Line Company. Zisk received an e-mail from Jeff O’Donnell dated 12/3/07 requesting a continuance of this Hearing because Mobil is in the process of filing a road permit with the town to operate the facility within the Northwest Main Street Road Right of Way. A MOTION was made by Yacino to continue the Public Hearing on Monday, April 7, 2008, at 7:30pm, seconded by Van Roo. VOTE UNANIMOUS.


8:15 PM PUBLIC MEETING CONTINUED: ARMAND PETER GUERTIN (RDA) 106 Peters Cove Road
An advertisement was not placed in the newspaper. A MOTION was made by Yacino to continue the Public Meeting on Tuesday, January 22, 2008 at 8:00pm, seconded by Van Roo. VOTE UNANIMOUS. The Commission will have Chesley write Mr. Guertin a letter informing him of this.
DISCUSSION: Chestnut Street Land Swap
This Article was passed over at the Special Town Meeting and the Commission will obtain the parcel as conservation land in the future.


(2 SETS) EXECUTIVE SESSION MEETING MINUTES OF 11/5/07
After review, a MOTION was made by Van Roo to approve the Executive Session Meeting Minutes of November 5, 2007, as written, seconded by Brown.
VOTE UNANIMOUS.


8:30 PM PUBLIC MEETING: FRED DODD (RDA)
51 Shady Lane
Present was Applicant Fred Dodd who is requesting permission to replace wood posts with concrete for his dock. A MOTION was made by Yacino to issue a Negative Determination of Applicability with conditions that Zisk and Cundiff be notified that work will be done during the water draw down and the dock is no longer than 60-feet, seconded by Brown. VOTE UNANIMOUS.


DISCUSSION
1. Roy Goodwin, 53 Gilboa Street. The Commission talked about what to do about the fines that were issued to Goodwin. The Commission feels that they should pursue this in court. Zisk, instructed by the Commission, asked DEP for advice and has not had any response from them. By consensus, the Commission agreed to pursue the fines issued to Goodwin in criminal court and to keep trying to get a response from DEP. Zisk will draft a letter to the Supervisor at DEP.
2. Blackstone Valley Paving. It was the consensus of the Commission to pursue these fines issued also.


MEETING MINUTES OF 11/5/07
After review, a MOTION was made by Brown to approve the Meeting Minutes of November 5, 2007, as amended, seconded by Van Roo. VOTE UNANIMOUS.


DISCUSSION CONTINUED: North Village (Chapter 40B)
Attorney Edwin Taipale represents the owner of this property located off of North Street. A MOTION was made by Yacino to accept the proposal submitted by Attorney Taipale tonight regarding the Chapter 40B Project off of North Street, seconded by Van Roo. VOTE: YES- 2, NO – 2, ABSTAINED - 2. VOTE DID NOT PASS.


DISCUSSION
1. Beaver Dams. The Commission needs to create some guidelines to use as conditions. The Board of Health determines a health emergency but an applicant still needs to file with the Commission for conditions on dam removal. Examples: Breach in morning, during dry season. Van Roo said that she would write up draft guidelines.
2. Seminar on “Keeping Water Protected”. The seminar will be held at the Doyle Conservation Center in Leominster on 12/17/07 from 6:30pm to 8:30pm. Yacino said that he would go.

At 9:55pm, a MOTION was made by Yacino to adjourn the meeting, seconded by Brown. VOTE UNANIMOUS.
