The meeting was called to order at 7:00pm.

ATTENDANCE
Acting Chairman Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, David Windoloski, Kelley Donley (Associate Member), Tracey Sharkey (Associate Member) - arrives at 8:00pm, Stephen Zisk (Planning/Conservation Agent) and Maria Chesley (Administrative Secretary). Absent were Chairwoman Marylynne Dube, Brandi Van Roo and William Cundiff (Town Engineer).

DISCUSSION
1. Stormwater Management Bylaw. Zisk said that the EPA drafted two bylaws (Stormwater Management & Land Disturbance Bylaw and Post Construction Stormwater Management Bylaw) that need to be adopted by the town. The Commission wants to wait for Cundiff to be present for discussion on 1/20/10.
2. 2011 Budget. It was the consensus of the Commission to recommend a level funded budget.
3. Received a letter from National Grid dated 12/11/09 in regard to applying herbicides along power line right-of-ways that pass through Douglas. This was discussed at the last meeting on 12/17/09.
4. Request for a Certificate of Compliance: Steven Bagdis, 90 Peters Cove Road (DEP #143-0784). A MOTION was made by Brown to issue a Certificate of Compliance, seconded by Windoloski. VOTE UNANIMOUS.
5. Request for a Certificate of Compliance: Creative Development Associates (formerly J.S.B. New Homes), 187 Maple Street (DEP #143-0635). On hold until the public hearing later this evening.
6. Received a letter from Pauline Gavlak, 34 Depot Street dated 12/22/09 requesting a copy of the 12/7/09 meeting minutes regarding 288 Northwest Main Street. A letter had been sent to Gavlak along with a copy of the Regulations. Gavlak present requesting that someone on the Commission meet with her to explain the regulations to her. Yacino said that he would meet with her at the Municipal Center on January 5, 2010 at 1:00pm.
7. Received a letter from the Board of Selectmen dated 12/9/09 stating that the appointment of Associate Members falls under the jurisdiction of the Conservation Commission.
8. Received a letter from MACC dated 12/18/09 stating that Stephen Zisk (Planning/Conservation Agent) has successfully completed MACC’s Advanced Certificate Training Program.
9. Received a copy of a letter from DEP dated 12/11/09 regarding an existing
dock at the property of Stuart Snow, 25 Hough Road. Zisk said that he
spoke to Snow and said that if Snow has to file a Chapter 91 License with
the state he will only need to write a letter informing the Conservation
Commission, Zoning Board of Appeals and the Board of Selectmen. If the
dock was built after 1984, he will have to file with the Commission. Snow
will be in to speak to the Commission on 1/20/10 at 7:00pm.
10. Douglas Properties, 143 Martin Road. Cliff Van Reed wrote a letter
requesting an extension for this property. The Order of Conditions expired
on 9/19/09. The Commission denied this request. Chesley will write him a
letter.
11.The Commission received a copy of a Request for a Superseding Order
of Conditions for Coopertown Realty Trust, 34 Davis Street from
Attorney Henry Lane to DEP dated 12/31/09.

After review, a MOTION was made by Brown to approve the Meeting Minutes of Monday, December 7, 2009, as amended, seconded by Mosczynski. VOTE UNANIMOUS.

MEETING MINUTES OF 12/17/09
After review, a MOTION was made by Brown to approve the Meeting Minutes of Thursday, December 17, 2009, as written, seconded by Windoloski. VOTE UNANIMOUS.

7:30 PM - DEP #143-0782 (NOI) PUBLIC HEARING CONTINUED -
“North Village” (Chapter 40B project) located off of North Street / TAIPALE, EDWIN – NORTH BROWN, LLC
The Commission received an e-mail today from Edwin Taipale on behalf of the Applicant requesting a continuance to 1/20/10 because their project engineer is out sick. A MOTION was made by Brown to continue the Public Hearing on Wednesday, January 20, 2010 at 7:45pm, seconded by Windoloski. VOTE UNANIMOUS.
The Commission recessed until 7:45pm.

7:45 PM - DEP #143-0815 (NOI) PUBLIC HEARING CONTINUED – 49 Lindbergh Avenue / SOCRAT, PATRICIA & AARON
Present was Aaron Socrat and his representative Steven O’Connell of Andrews Survey. Socrat said that he has received Zoning Board of Appeals approval for a Special Permit and Board of Health approval for his septic system. Revised plans were submitted dated 1/4/10 for Zisk to review. Socrat asked if he could use a filter mitt instead of straw bales for erosion control and he gave the Commission the information for filter mitts. The Commission had no issue with this and it will be noted in his conditions. Socrat also said that the only three (3) trees removed will be between the two houses and the shed will stay where it is for now but he will file in the future when he wants to move it. After discussion, a MOTION was made by Brown to continue the Public Hearing on Wednesday, January 20, 2010 at 7:30pm, seconded by Windoloski. VOTE UNANIMOUS.

8:00 PM - (RDA) PUBLIC MEETING – 11 Newport Drive / PETRUCCELLI, ANDREW
Mr. Petruccelli present to request permission to cut down six (6) pine trees on the side of his house along the driveway for fear that they may fall onto his house especially during the winter and one (1) dead maple tree in the rear of his house. Brown asked that he not remove the stumps and it was agreed that this will be noted as a condition. A MOTION was made by Brown to issue a Negative Determination of Applicability with the condition that there will be no stumping of the trees, seconded by Mosczynski. VOTE UNANIMOUS.

8:15 PM - (RDA) PUBLIC MEETING – Route 146 / MASS DEPARTMENT OF TRANSPORTATION
Windoloski recused himself. Present on behalf of the Mass Department of Transportation were Richard Handfield and Hud Quistorff. They are requesting permission to resurface the ramp north of Lackey Dam Road. Handfield said that the project will begin in April. Straw bales will be used for erosion control. A MOTION was made by Brown to issue a Negative Determination of Applicability with the condition that straw bales are used for erosion control, seconded by Dudley. VOTE UNANIMOUS.

8:30 PM - DEP #143-0818 (NOI) PUBLIC HEARING CONTINUED – 187 Maple Street / STAITI, MICHAEL – CREATIVE DEVELOPMENT ASSOCIATES
There was no one present on behalf of the Applicant. The Commission is waiting to do a site walk but due to the snow they have been unable to. A MOTION was made by Brown to continue the Public Hearing on Wednesday, January 20, 2010, at 8:00pm, seconded by Windoloski. VOTE UNANIMOUS.

8:45 PM - (RDA) PUBLIC MEETING – Martin Road (near house #56) / TOWN OF DOUGLAS HIGHWAY DEPARTMENT
Present was Stephen Zisk on behalf of the Town. The Highway Department is requesting permission to install a catch basin (BMP) and associated underground piping in front of 56 Martin Road. The stormwater will discharge across the roadway onto Mr. Smith’s property which has wetlands within 100-feet of the discharge point. The project will improve stormwater quality by routing flow through a deep sump catch basin. The Commission will add a condition that 10-feet of rip rap will be placed along the outlet pipe to reduce velocity. A MOTION was made by Brown to issue a Negative Determination of Applicability with the above condition, seconded by Mosczynski. VOTE UNANIMOUS.

At 8:40pm, a MOTION was made by Brown to adjourn the meeting, seconded by Windoloski. VOTE UNANIMOUS.
