The meeting was called to order at 7:05pm.

ATTENDANCE
Chairwoman Marylynne Dube, Vice Chairman Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, David Windoloski, Tracy Sharkey (Associate Member), Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary). Absent was Kelley Donley (Associate Member).

7:05 PM DISCUSSION
1. Schedule Site Walks: 188 South Street, Cross Street, Lot #1 (Summerlyn Estates), 77 Ledgestone Road, 26 Elm Street. The site walks will be done on Wednesday, April 14, 2010 at 5:30pm. Zisk will e-mail the members the list by order.
2. Mosczynski property, Oak Street (Chapter 61A). Leon Mosczynski recused himself. The Commission received a letter from Susan Mosczynski’s Attorney Kevin Sullivan dated 3/19/10 stating that Ms. Mosczynski is selling a 4.74 (+/-) acre parcel in the amount of $98,000. The Town has the right of first refusal. After discussion, a Motion was made by Yacino not to exercise their right of first refusal, seconded by Windoloski. Vote was unanimous. Chesley will send a memo to the Board of Selectmen regarding the Commission’s vote.
3. N A J Properties, LLC, 24 Riedell Road. On 3/31/10, Nicholas Jane came in to the office to inform Zisk that there is flooding at his business due to all the rain. Yacino and Zisk went to look at the problem and Jane was issued an Emergency Certification Form to pump water from 24 Riedell Road across the street into a sediment dewatering area. The applicant was allowed to pump the water level down enough in order to have access onto the property. Once access has been achieved, no further pumping of water from the area will be allowed. Jane was allowed to start this work on 3/31/10 and end on 4/3/10. The special conditions were that no buildup of sediment would be allowed in the dewatering area. A Motion was made by Yacino to ratify the Certification Form, seconded by Van Roo. Vote was unanimous.
4. Justin & Rhonda Lapham, 188 South Street. Rhonda told the Commission that when she and her husband Justin watched the meeting on the cable access channel, they were concerned about their privacy due to their house being shown to the public. Rhonda submitted a letter dated 4/5/10 requesting that the meeting of March 15, 2010 be removed from the cable channel and the website as soon as possible. The Commission said that they are unable to do this because they do not have the authority but Cundiff suggested that she contact Mitch Cohen of the Cable Advisory Committee to ask that it be removed.
5. SIGNED: Request for Extension of Order of Conditions: Margaret Bacon, 80 Maple Street (DEP #143-0761). (One Year)

7:30 PM - DEP #143-0818 (NOI) PUBLIC HEARING CONTINUED - 187 Maple Street / STAITI, MICHAEL - CREATIVE DEVELOPMENT
ASSOCIATES
Present on behalf of the Applicant was Eric Bazzett of Andrews Survey. A site walk was done and the Commission has no remaining issues. Bazzett said that the Applicant received Board of Health approval. A Motion was made by Yacino to close the Public Hearing and issue an Order of Conditions, seconded by Brown. Vote was unanimous.

MEETING MINUTES OF 3/15
After review, a Motion was made by Yacino to approve the Meeting Minutes of Monday, March 15, 2010, as written, seconded by Brown. Vote was unanimous.

*The Commission recessed from 7:40pm to 8:00pm.

8:00 PM - (NOI under Wetland Local Bylaw) PUBLIC HEARING CONTINUED - 88 West Street / WHIPPLE, EDWARD - ED’S CONSTRUCTION, INC.
The Commission received a letter from Peter Robidoux of Natural Resource Services dated 4/1/10 requesting a continuance on behalf of the Applicant. A Motion was made by Yacino to continue the Public Hearing on Monday, May 17, 2010 at 7:45pm, seconded by Van Roo. Vote was unanimous.

8:03 PM - DEP #143-0819 (NOI) PUBLIC HEARING CONTINUED – 78 Cottage Colony Drive / STANHOPE, CAROL –
Estate of Dorothy Abram
Present were Applicants Bill & Carol Stanhope, their Engineer Roger Woods of Roger Woods & Company and Sign Language Interpreter Dion Fitzpatrick. A site walk was done. Ribbons were placed on the trees that are to be removed. Woods was asked to show these trees on the plan. Woods said that the Stanhope’s are also going before ZBA for a Special Permit and the Commission said that they would continue the Hearing pending ZBA approval. A Motion was made by Yacino to continue the Public Hearing on Tuesday, April 20, 2010 at 8:15pm, seconded by Van Roo. Vote was unanimous.


8:13 PM - (RDA) PUBLIC MEETING CONTINUED - 75 Ledgestone Road / BURGESS, ELLIS
Present were Applicants Ellis & Laura Burgess. A site walk was done. Brown asked that straw bales be placed along wall where the Commission told them to during the site walk. Ellis said that the bales are already placed. The Burgess’s said that they are going before ZBA for a Special Permit and a Variance and the Commission said that they would continue the Hearing pending ZBA approval. A Motion was made by Yacino to continue the Public Meeting on Tuesday, April 20, 2010 at 8:16pm, seconded by Brown. Vote was unanimous.

8:15 PM - (RDA) PUBLIC MEETING CONTINUED - 21 Richie Road / ASLANIAN-SHEA, JUSTINE
The Commission received a letter from William Drexel of Northwest Engineering Services dated 4/5/10 requesting a continuance on behalf of the Applicant for the purpose of completing further study of the lot by the biologist. A Motion was made by Yacino to continue the Public Meeting on Monday, May 17, 2010 at 7:30pm, seconded by Van Roo. Vote was unanimous.

ADJOURNMENT
At 8:20pm, a Motion was made by Yacino to adjourn the meeting, seconded by Van Roo. Vote was unanimous.
