10/18/2010 - Executive Session Meeting Minutes

The meeting was called to order at 8:30pm.

ATTENDANCE
Acting Chairwoman Linda Brown, Leon Mosczynski, Brandi Van Roo, Ralph Dudley, David Windoloski, Kelley Donley (Associate Member), Tracy Sharkey (Associate Member), Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Lajoie (Administrative Secretary). Absent were Chairwoman Marylynne Dube and Vice Chairman Michael Yacino.

8:30 PM EXECUTIVE SESSION: To discuss Strategy with Respect
to Litigation

At 8:30 pm, a Motion was made by Van Roo to go in to Executive Session to discuss strategy with respect to litigation, and will adjourn and not return to regular session, seconded by Mosczynski.

Cundiff received a copy of Form 11 – Soil Suitability Assessment for On-Site Sewage Disposal (drawing with borings) from Michael Weaver of Guerriere & Halnon stamp dated 10/18/10 and the DEP Settlement Agreement. Cundiff said they have satisfied the Stormwater Handbook. Attorney Brian Winner of Kopelman & Paige is asking that the Commission be specific regarding comments/conditions to incorporate into the Settlement Agreement. Cundiff said that Coopertown Realty Trust still needs to file under the Local Wetland Bylaw. After discussion, the above was approved by the Commission.

At 8:40 pm, a Motion was made by Van Roo to rise from Executive Session and return to the Regular Meeting, seconded by Dudley.
