ZONING BOARD OF APPEALS
MINUTES TO PUBLIC HEARING
SEPTEMBER 13, 2007


The meeting was called to order at 7:05 pm

Present:
Mr. Colin Haire – Chairperson
Mr. Harold Davis – Vice-chairperson
Mr. Daniel Heney – Clerk

Case No. 2007-04 Charles Brothers Public Hearing:

Applicant a no show and sent a check for the re-notification of abutters to late. There were no parties-in-interest present.

Mr. Davis made a motion to withdraw the application without prejudice. Applicant may re-file the application, Mr. Heney seconds, all in favor.

Mr. Haire at this time addressed the old business of the minutes.

Mr. Haire stated that he received an e-mail from Mr. Cohen addressing the issue of the ZBA minutes. An item that was stated was the fact that the minutes do not reflect a vote taken to approve prior minutes. Mr. Haire suggests that the Board reaffirm its approval of the minutes beginning January, 2006 to June, 2007.

Mr. Davis made a motion to approve minutes from January, 2006 to June, 2007 any minutes prior to January, 2006 to be stamped unofficial/reproduced, Mr. Haire seconded, Mr. Heney abstained. Motion passed by majority vote.

Case No. 2007-10 Mae and Larry Fayer, 55 Linden Street, Public Hearing:

Mr. Haire opened the public hearing at 7:15 by reading the notice. Present were the applicants, Mae and Larry Fayer. There were no parties-in-interest present. The Planning Board had no objection to the applicant’s request for a Variance. Also submitted into record is correspondence from the applicant’s abutters stating no objection to the request for a Variance.

Mr. Fayer presented the application and plans to the Board:

Mr. Fayer stated that the layout of the land, even being 4 acres, is a strange configuration.

David and Jennifer Briggs were the first people we asked for a letter as they would be the most affected. Their house is set closer to the street than ours. Their back yard swing set is not even perpendicular to where we want to put the addition. Included in the package are some photographs.

Mr. Haire asked, “What was the setback request?”

Mr. Fayer stated, “I think approximately 12’.”

Mr. Haire asked, “Do you have a surveyed plan showing exactly what it is?”

Mr. Fayer stated, “This is the plan that I got from Cliff.”

Mr. Heney stated, “This is a septic plan. Do you have a mortgage survey?”

Mr. Fayer stated, “No.”

Board members agreed that the septic plan is not always accurate. They would like to see something more substantial.

Applicant to provide a plan showing original dwelling, and the proposed addition with the lot line in question surveyed.

Mr. Davis made a motion to continue the Public Hearing to October 11, 2007 at 7:00 pm, Mr. Heney seconded, all in favor.

Old/New Business

Mr. Davis made motion to approve minutes for August 9, 2007, Mr. Haire seconded, all in favor.

Mr. Haire provided to Mr. Heney and Mr. Davis copies of the complaint filed by Mitch Cohen regarding an Open Meeting Law violation, as well as his answer to the complaint.

Mr. Haire made a motion to adjourn, Mr. Heney seconded, all in favor.

Adjourned 7:45 pm.
