ZONING BOARD OF APPEALS
MINUTES TO PUBLIC HEARING
OCTOBER 4, 2006


The meeting was called to order at 7:20 pm

Present:
Mr. Colin Haire – Chairperson
Mr. Harold Davis – Vice-chairperson
Mr. George Burns – Clerk


Case No. 2006-18 – Brian Guilfoyle, 37 Hough Road, Public Hearing continuation:
Case No. 2006-19 – Brian Guilfoyle, 37 Hough Road, Public Hearing continuation:

Mr. Haire opens the public hearing by reading the notice.

The applicant has requested a continuance to gather the information requested at the previous hearing.

Mr. Davis made a motion to approve the applicant’s request for a continuance to December 14, 2006 at 7:00 pm and 7:15 pm respectively; Mr. Burns seconds, all in favor.

Closed 7:30 pm

Case No. 2006-21 – Robert Sutton, 426 Northeast Main Street, Public Hearing:

Mr. Haire opens the public hearing by reading the notice.

The Planning Board had no objection to the request for a Variance.

Present was the applicant, Mr. Robert Sutton. There were no parties in interest present.

Mr. Sutton presents the application and plans to the Board:
- install an above-ground pool
- more permanent than the one that was previously there
- lacks the required side yard and rear yard setback
- lot drops and this is the only level area
There are no further questions from the Board and no questions/comments from the floor.

Mr. Davis made a motion to close the Public Hearing, Mr. Burns seconds, all in favor.

Closed 7:45 pm

Mr. Davis made a motion to open a Decision Meeting, Mr. Burns seconds, all in favor.

Opened 7:45 pm

Mr. Davis made a motion to approve the applicant’s request with the following findings:
- Existing circumstances of this locus as related to its physical characteristics are peculiar to this locus and do not generally affect the V/R Zoned District, in which it is located.
- Approval of the request would no substantially be to the detriment of the public good and would not substantially nullify or derogate from the intent and purpose of the bylaws.

Mr. Burns seconds, all in favor.
