The meeting was called to order at 7:04pm.

Present were Chairman Daniel Heney, Pamela Holmes, Leonard Demers, Michael Nelson (arriving at 7:20pm) and Maria Lajoie (Administrative Secretary. Absent was Sean Holland.

7:04 PM CASE #2011-07
Hearing this case will be Daniel Heney, Pamela Holmes and Leonard Demers. Present were the Applicants and their representative Michael Weaver of Guerriere & Halnon. The Gressak’s are requesting a Special Permit in a Rural/Agricultural Zoned area, Section 3.4.7 – Reconstruction after Catastrophe or Demolition, #3 to demolish an existing cottage and construct a new dwelling with a garage located on a nonconforming lot with no frontage with access on a right-of-way. The Planning Board had no objection to this request for a Special Permit. An Order of Conditions was issued by the Conservation Commission and was also approved by the Board of Health for the septic. Weaver explained that there is no frontage on this 3.02-acre parcel and meets the setback requirements. Demers asked about the required 200-feet of frontage and this application has no frontage. Heney explained that this is a pre-existing lot with a right-of-way that lacks frontage. After discussion, a Motion was made by Demers to close the Public Hearing, seconded by Holmes. Vote was unanimous. A Motion was made by Demers to approve a Special Permit as submitted, seconded by Holmes. Vote was unanimous. Holmes discussed this filing for frontage, Section #3. Heney said this Section #3 most closely resembles this filing. Holmes suggested the Board have Town Counsel in to a meeting at some point to discuss square footage and other issues.

1. Received a letter from Blatman, Bobrowski & Mead dated 10/3/11 stating that CASE #2010, Peter & Susan Brady, 35 Wallis Street have dismissed their Appeal against the Board.
2. Received a letter from Normand Gamache of Guerriere & Halnon dated 9/29/11 regarding the Metal Recycling Facility on Cliff Street owned by Francis Beaupre. They are requesting an “amendment” to CASE #2011-02 due to the current plan being modified. Michael Weaver of Guerriere & Halnon present on behalf of the owner. Heney said this plan submitted does not match the plan that was approved by the Board early this year. Weaver said Beaupre is before the Planning Board now for Site Plan Review and asked if the Board would consider holding an earlier hearing than November 2nd to modify the amended plan due to winter coming and the Board said no because the owner could have come before the Board months ago.
3. Meeting Minutes of 3/9/11. After review, a Motion was made by Holmes to approve the Meeting Minutes of March 9, 2011, as submitted, seconded by Demers. Vote was unanimous.
4. Meeting Minutes of 7/13/11. After review, a Motion was made by Demers to approve the Meeting Minutes of July 13, 2011, as submitted, seconded by Holmes. Vote was unanimous.
5. Citizen Planner Training Collaborative: Fall 2011 Workshops. FYI. The members should let Lajoie know if they want to attend.
6. Scheduling Hearings. Lajoie asked if the Board wanted her to schedule public hearings at fifteen (15) or thirty (30) minute intervals and they said every fifteen (15) minutes.
7. ZBA Rules & Regulations. Holmes said she would like to start reviewing the Regulations at their next meeting, if possible, and the members agreed.

At 8:03pm, a Motion was made by Nelson to adjourn the meeting, seconded by Holmes. Vote was unanimous.
