CONSERVATION COMMISSION MEETING MINUTES
MONDAY, DECEMBER 5, 2016

A meeting of the Conservation Commission was held on Monday, December 5, 2016. Ms. Sharkey called the meeting to order at 7:10 PM.

ATTENDANCE:
PRESENT: Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT: Linda Brown (Chairman-Excused)

7:10 PM (NOI-DEP #143-0906) PUBLIC HEARING CONTINUED: 439 Northeast Main Street, 34 & 36 Davis Street/JMT SLEEPY HOLLOW, LLC & FITZPATRICK, JAMES.
Ms. Sharkey stated that the applicant has asked for a continuance.
Ms. Van Roo made a motion to continue the public hearing, (NOI-DEP #143-0906) 439 Northeast Main Street, 34 & 36 Davis Street/JMT Sleepy Hollow, LLC & Fitzpatrick, James to January 9, 2017 at 7:00 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:17 PM (NOI-DEP #143-0917) PUBLIC HEARING: 86-88 Gilboa Street / BOWIE, BARBARA.
Ms. Sharkey opened the public hearing. Paul Hutnak of Andrews Survey and Engineering joined the meeting. Mr. Hutnak stated that the site has a common driveway. He is proposing to cut into the embankment that comes off Gilboa, bring a driveway up and turn into an existing driveway. He is proposing a dense grade stone driveway with a 25’ paved apron off of the street. He has added a construction sequence to the plan.
He proposed placing a mulch sock across the access of the driveway at the end of the day during construction. The loamed areas will be hydroseeded or matted and seeded during the non-growing season.
A discussion was held including the direction of the run off from the gravel driveway and sight distances. The Commission asked that the Highway Dept. and Town Engineer review this plan and submit comments.
Ms. Van Roo made a motion to continue the public hearing (NOI-DEP #143-0917) 86-88 Gilboa Street, Barbara Bowie to January 9, 2017 at 7:15 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:30 PM (NOI-DEP #143-0918) PUBLIC HEARING: 71 Old Farm Road, SHEA/SCOTT.
Ms. Sharkey opened the public hearing. Dave Marquedant and Scott and Christa Shea joined the meeting. Mr. Marquedant presented the plan for a single-family home. He stated that most of the plan is the same as it was in 2005. The wetland line has been updated since 2005. The bulkhead is not yet shown on the plan. The driveway will be paved.
Ms. Sharkey suggested adding something to limit the lawn creep. Stockpile area should be placed outside the 100’. Items to add to the plan: the closest limit to the wetland, more erosion control around the slurry pit, foundation drain, stockpile area, bulkhead, patio, shed (if needed).
Ms. Van Roo made a motion to continue the public hearing for (NOI-DEP #143-0918) 71 Old Farm Road, Scott Shea to January 9, 2017 at 7:30 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:48 PM (NOI-DEP #143-0920) PUBLIC HEARING: 229, 187 & 175 Main Street, RILEY, ALLEN G. & HARE, ROBERT C & MARIBELLE.
Ms. Sharkey opened the public hearing. Eric Bazzett of Heritage Design Group joined the meeting. He stated that the plan is a Definitive Subdivision Modification Plan. They are proposing a 2100’ cul-de-sac with 24’ of pavement: a 50’ right-of-way for the first 400’ and 60’ beyond that to the end. They are proposing 28 new lots, with 24 new homes.
The upper stormwater basin has a discharge within the buffer zone. They are proposing two limited project wetland crossings: one is for the roadway using 1595 sq. ft. of fill and the other is for a shared driveway for two lots with 525 sq. ft. of fill. The proposed replication ratio is 1.9:1. The crossings will be constructed between July and October. At the crossings, they are proposing open bottom culverts. They are proposing to put timber mats in the stream bed during construction.
The culvert design is based on bank width, but the bank was never determined. Mr. Bazzett will measure and flag the bank widths at the crossing areas next week, and Mr. Zisk will verify the measurements. Mr. Zisk asked for details on how the crossings will be constructed.
The location of the replication area is 150’-200’ into the woods and accessed through lot 9. Mr. Bazzett will look to see if he can come up with another location. Mr. Zisk suggested he consult EcoTech.
Mr. Zisk informed Mr. Bazzett that when the residential crossing gets tied to a subdivision and then the lot is sold, the partial Certificate of Compliance needs to be completed before the lot is sold. Options include including the crossing as part of the subdivision or excluding the crossing and filing separately.
The Water Dept. would like the water line looped out to Brookside Drive. This work is not proposed as part of this plan. It will be filed separately as a Water Dept. project. This work will create a temporary disturbance.
Melissa Witkus asked if the work planned would have any impact on the perennial stream or Meek’s pond. Mr. Bazzett replied in the negative and showed where the replication areas will be.
Ms. Van Roo made a motion to continue the public hearing (NOI-DEP #143-0920) 229, 187 & 175 Main Street, Allen G. Riley and Maribelle and Robert C. Hare to January 9, 2017 at 7:45 PM. Mr. Greco seconded the motion. Vote: Unanimous.

8:22 PM (NOI-DEP #143-0919) PUBLIC HEARING: 28 Ridge Trail, ALLEN, JOSEPH.
Ms. Sharkey opened the public hearing. Mike Yerka of Civil Site Engineering joined the meeting. He presented a revised plan. He stated that a septic repair was done several years ago. Mr. Allen is now in the process of selling a parcel and the bank requires an artesian well. They are proposing to put in an artesian well just off the stone wall. They will decommission the shallow well. The sideline setback is 11’-12’.
Michael Collins, 24 Ridge Trail will enter into a temporary agreement for access. He does not have an issue with the revised plan.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP#143-0919) 28 Ridge Trail, Joseph Allen. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. 208 Yew Street-Violations: Ms. Sharkey recused herself. Karen Keegan and Louis Tusino of Guaranteed Builders joined the meeting. Mr. Zisk stated that a vendor thought that he could start clearing trees because the area was staked and erosion controls were set up. The vendor was told to stop, however he was working on the site again on Friday. Mr. Zisk issued a Cease and Desist and submitted a Violation Notice.
The two bonds were submitted and Mr. Zisk and Ms. Keegan walked the site on Saturday.
Ms. Van Roo made a motion to issue a $100 fine for a violation that occurred at 208 Yew Street. Mr. Greco seconded the motion. Vote: Unanimous.
Ms. Sharkey rejoined the meeting.
2. Request for Certificate of Compliance: Scott Shea, 71 Old Farm Road (DEP #143-0662). Mr. Zisk stated that this is an old outstanding Order of Conditions that the applicant would like closed out because the work was never done.
Mr. Greco made a motion to grant a Certificate of Compliance for Scott Shea, 71 Old Farm Road (DEP #143-0662) because the work regulated by the above referenced Order of Conditions never commenced. The Order of Conditions has lapsed and is no longer valid. No future work subject to regulations under Wetlands Protection Act may commence without filing and receiving new Notice of Intent. Ms. Van Roo seconded the motion. Vote: Unanimous.
3. Request for Certificate of Compliance: Suzanne Gagnon, Potter Road (DEP #143-0682). Suzanne Gagnon joined the meeting. The Commission reviewed photos of the site from the entrance to the replication area.
Ms. Van Roo made a motion to issue a Certificate of Compliance for Suzanne Gagnon, Potter Road (DEP #143-0682). Mr. Greco seconded the motion. Vote: Unanimous.
4. Request for Certificate of Compliance: Steven Frankel, 10 Smith Hill Way (DEP #143-0882). Ms. Van Roo made a motion to issue a Certificate of Compliance for Steven Frankel, 10 Smith Hill Way (DEP #143-0882). Mr. Greco seconded the motion. Vote: Unanimous.
5. Request for Certificate of Compliance: Christopher & Concepcion Goodwin, 11 Manzi Way, Shady Knoll Estates, Lot #27 (DEP #143-0402). This item is postponed until spring. There is a kennel within the buffer that is not on the map.
6. Request for Project Review-Douglas Library Parking Lot, 290 Main Street.
