CONSERVATION COMMISSION MEETING MINUTES
MONDAY, OCTOBER 2, 2017

A meeting of the Conservation Commission was held on Monday, October 2, 2017. Ms. Brown called the meeting to order at 7:00 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Stephen Zisk (Conservation Agent)
ABSENT: Brandi Van Roo

7:00 PM (NOI-DEP #143-0924) PUBLIC HEARING CONTINUED: Gilboa Court Extension/GOGOLINSKI, CAROL, A. & COGLEY, WILLIAM S.
Ms. Brown stated that the applicant has requested a continuance.
Ms. Sharkey made a motion to continue the public hearing for (NOI-DEP #143-0924), Gilboa Court Extension, Carol Gogolinski and William S. Cogley to October 16, 2017 at 7:00 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:16 PM (NOI-DEP #143-0934) PUBLIC HEARING: 294 Northwest Main Street/FARINEAU, DONALD.
Ms. Brown opened the public hearing. Eric Bazzett of Heritage Design Group joined the meeting. The property is on a right-of-way off of Northwest Main Street. The lot is 7,000 sq. ft. They are proposing to remove the existing house and tight tank and construct a new house, install a new well and a new title 5 septic system near the well. Mr. Bazzett showed erosion control barriers along the perimeter. They have filed with the Board of Health and Zoning Board of Appeals.
Mr. Zisk asked about getting the truck to the well site. Mr. Bazzett replied that they will first remove the house and then create a ramp for the truck to drive on. Excavated material needs to be taken off site. There will be two layers of erosion control along the well.
They are proposing a 6’ stone wall closer to the reservoir, with a stone patio at the basement walk-out level. They will be filling within the 10’. Detail on the construction of the wall needs to be included on the plan.
There will be a 4’ porch on the water-side on the second floor. Sonotubes will be used to construct that porch. The porch and placement of sonotubes need to be shown on the plan. Mr. Farineau stated that the foundation is 31’ x 31’, inclusive of the porch. Mr. Bazzett will amend the plan to show a 31’ x 27’ foundation with a 4’ slab for the porch.
Along the property lines will be staked straw wattles and silt fence. Along the water’s edge will be straw bales and silt fence. Mr. Bazzett will remove the roof infiltration units.
Ms. Sharkey made a motion to continue the public hearing for NOI-DEP #143-0934, 294 Northwest Main Street, Donald Farineau to October 16, 2017 at 7:15 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:37 PM (NOI-DEP #143-0936) PUBLIC HEARING: 30, 46 & 50 Southwest Main Street/BASILE, LAWRENCE.
Ms. Brown opened the public hearing. David Feist of McClure Engineering, wetlands scientist MaryAnn DiPinto of Three Oaks Environmental and Mr. Basile joined the meeting. Mr. Feist stated that they are looking for an Abbreviated Notice of Resource Area Delineation (ANRAD) on three properties adjacent to Morris Pond. In the future, the applicant plans to propose a flexible residential development.
Ms. DiPinto described how she delineated and flagged the wetland areas. She has walked the entire property. She did not find a culvert feeding the isolated wetland area. The man-made pond is not included.
Mr. Feist reviewed the perimeters of the three lots included in the filing. Mr. Zisk pointed out wetland areas that have not been flagged and need to be included on the ANRAD. Ms. DiPinto answered that they are asking for approval from the Commission for resource areas for lots 4, 5, 6, 7, and 8, the riverfront area, bank, BVW, and the areas subject to flooding.
Mr. Zisk has a proposal for EcoTec to review the site with Ms. DiPinto before the next meeting. Mr. Feist asked for the information on the additional cost. Mr. Zisk feels the filing fee will cover that cost.
Ms. Sharkey made a motion to continue the public hearing for NOI-DEP #143-0936, 30, 46 & 50 Southwest Main Street, Lawrence Basile to October 16, 2017 at 7:30 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:55 PM (NOI-DEP #143-0935) PUBLIC HEARING CONTINUED: 58 Chestnut Street/ DAPRATO, ALFRED.
Norman Hill of Land Planning, Inc. joined the meeting to present a revised plan. The house has been made smaller to create a 25’ no disturb zone. They are going to focus on just one lot. They will only be disturbing the areas to create the house, well and septic, which are as far away from the river as possible.
Mr. Hill feels that the FEMA flood plain is wrong. He plans to take cross-sections across the river, calculate the amount of water coming down in a 100-year storm and calculate the flood elevation using a DEP methodology, which he explained. Ms. Sharkey stated that approval from FEMA is needed to change the flood plain. Mr. Hill does not need to move FEMA’s zone off his site. A discussion was held.
Mr. Zisk asked Mr. Hill to calculate the new riverfront percentage and include it on the plan. Mr. Hill will write up a summary and submit it to the Commission.
Ms. Sharkey made a motion to continue the public hearing for (NOI-DEP #143-0935), Alfred Daprato, 58 Chestnut Street to November 13, 2017 at 7:00 PM. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Violation Notice: Milton Mota, Southwest Main Street. This is the Morse Pond Subdivision. Mr. Mota is planning to eliminate the eleven lots and create one house lot. He did some cutting for the driveway and did not realize there were wetlands. Mr. Zisk issued a Cease and Desist. Mr. Mota spoke to Mr. Zisk in his office. Mr. Zisk gave him a copy of the plan, showed him where he was working in the buffer zone, and told him he had to file a Notice of Intent for the driveway. Mr. Mota did not stay for the Commission meeting. A discussion was held, including the clearing already done and installation of straw wattles. Mr. Zisk will talk to Mr. Mota and Mike Labbe tomorrow.
Ms. Sharkey made a motion to issue a fine in the amount of $100 for the buffer zone clearing without a permit for Milton Mota, Southwest Main Street, and straw wattles must be installed along the area of disturbance within one week. Mr. Greco seconded the motion. Vote: Unanimous.
2. Violation Notice: Cory & Natalia Lopes, 32 Linden Street. Mr. Zisk has checked the erosion controls. Ms. Brown asked for photos. A Notice of Intent will be filed. Ms. Brown said that an Order of Conditions was never recorded, but she is sure that one was filed. The lot was sold in 1998. The fine has not been paid. Ms. Zisk will speak to the Lopeses tomorrow and ask them to come to the next meeting.
3. EcoTec, Inc.: Wetland Consulting Services Proposal, 30, 46 & 50 Southwest Main Street. See 7:37 PM hearing above. The Commission agreed with the proposal.
4. Extension Permit for Order of Conditions: Alfred DaPrato, Colonial Road, Lot #10 (DEP #143-0875). Ms. Sharkey made a motion to approve the Extension Permit for Order of Conditions for Alfred DaPrato, Colonial Road, Lot #10 (DEP #143-0875) to 2020. Mr. Greco seconded the motion. Vote: Unanimous.
5. Mowing Conservation Fields. Some of the pine trees near Manchaug Road are approximately 5’ tall. Nydam’s will be there on Saturday to see what must be cut. The neighbor will be asked if they can assess the field from their property.
The French property looks good.
6. Request for a Certificate of Compliance: Kevin Bliss, 24 Perry Street (DEP #143-0789). Mr. Zisk showed photos of the site. Ms. Sharkey made a motion to issue a Certificate of Compliance for Kevin Bliss, 24 Perry Street (DEP #1 43-0789). Mr. Greco seconded the motion. Vote: Unanimous.

OTHER BUSINESS:
Norman Hill of Land Planning, Inc. spoke about Frank Crowley’s plan on 10 Colonial Road. They are proposing to stake a new siltation control line at the 25’ no disturb line, then they will loam, New England Wetland Plants transitional seed mix or wildlife seed mix, and plant the no disturb area. They are planning a little over one plant for every 100 sq. ft.
The Commission asked Mr. Hill for a copy of the types of seed in the transitional mix. Ms. Sharkey found a list of species in the wildlife seed mix. Mr. Hill will ask his client to get this done in the next week. Construction cannot begin until all of this is done.
It was decided to place this item on the next meeting’s agenda for discussion.
Mr. Zisk received a non-compliance letter from the Dept. of Conservation and Recreation for Dudley Pond Dam. It must be filed by December and a plan done by spring.
