CONSERVATION COMMISSION MEETING MINUTES
MONDAY, NOVEMBER 13, 2017

A meeting of the Conservation Commission was held on Monday, November 13, 2017. Ms. Brown called the meeting to order at 7:09 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Stephen Zisk (Conservation Agent)
ABSENT: Brandi Van Roo

7:09 PM (NOI-DEP #143-0935) PUBLIC HEARING CONTINUED: 58 Chestnut Street/ DAPRATO, ALFRED.
Norman Hill of Land Planning Inc. joined the meeting. Since the last meeting, the topography downstream of the three 48”culverts has been surveyed. Three cross sections were done in order to calculate the flood elevations. Mr. Hill used the method in the FEMA guide to calculate the amount of water coming off the watershed. The road would be overflowed in a 100-year storm. The Dept. of Environmental Protection (DEP) was copied last Tuesday.
Jim Malley of the Board of Health (BOH) has reviewed the plan. Mr. Hill has addressed all of Mr. Malley’s comments, however the BOH has not yet approved the plan.
Mr. Hill is providing a 25’ no disturb zone. The proposed house is 24’ x 36’, three bedrooms and a one-car garage. The Commission’s regulations require a 50’ no build zone.
Erosion control will be straw wattles and silt fence.
Mr. Hill has adjusted what FEMA mapped for the flood plain elevation. Ms. Sharkey asked to see the reference in the regulation that allows the flood plain to be adjusted. Mr. Hill stated that he followed a FEMA procedure outlined in their manual, and he had that certified with an engineering stamp. He could submit his data to FEMA for a Letter of Map Amendment, however it is a 4-5 week process.
Mr. Zisk presented DEP’s comments from the last meeting. Mr. Zisk asked Mr. Hill to follow up with DEP for a determination.
Mr. Hill stated that his client is willing to donate two of the lots to the Town as Conservation land. Ms. Brown asked that it be put in writing. The potential donation of land is not part of this decision.
The riverbank on the other side of the river has been flagged. Mr. Hill did the calculation for riverfront area percentage for the one lot. He will add the calculation to the plan.
Mr. Hill was asked to stake out the building corner at the closest point to the wetlands, the retaining wall, and the 25’ no disturb zone. A slurry pit needs to be added to the plan. Mr. Hill will have it staked by next Wednesday.
Mr. Hill was asked to add a narrative to the plan describing how he meets the criteria under 1056, 1057, and 1058. He was also asked for a construction sequence.
A site walk was scheduled for Saturday, December 2, 2017 at 9:00 AM.
Ms. Sharkey made a motion to continue the public hearing for Alfred DaPrato, 58 Chestnut Street (NOI-DEP #143-0935) to December 4, 2017 at 7:45 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:30 PM (NOI-DEP #143-0934) PUBLIC HEARING CONTINUED: 294 Northwest Main Street/FARINEAU, DONALD.
Eric Bazzett of Heritage Design Group joined the meeting. The plans now show the concrete tubes for the foundation, the 4’ overhang for the second story, and stairs on both sides of the house. The retaining wall in the front is shown as 6’ tall at one end, sloping to 5’tall at the other. A note was added that the plans for the 4’ wall need to be stamped by an engineer; walls over 6’ tall need a Building Permit. The roof infiltration unit was removed. They will be meeting with ZBA on December 14, 2017. Straw bales with silt fence and wattles with silt fence are being planned for erosion control. There is now a construction sequence.

7:37 PM (NOI-DEP #143-0937) PUBLIC HEARING: 32 Linden Street/LOPES, CORY & NATALIA.

Ms. Sharkey made a motion to continue the public hearing for (NOI-DEP #143-0937) Cory and Natalia Lopes, 32 Linden Street to December 4, 2017 at 8:00 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:47 PM (NOI-DEP #143-0924) PUBLIC HEARING CONTINUED: Gilboa Drive/ GOGOLINSKI, CAROL A. & COGLEY, WILLIAM S.
JP Connelly of Andrews Survey and Engineering joined the meeting. He reviewed the changes requested by the Planning Board. An access and utility easement has been added, grading for the road construction is shown as separate plan, a guardrail has been added around a basin, and an underdrain line was relocated to stay within the easements. There is now an offsite improvement plan to handle widening Gilboa Court to 18’ at the entrance to the subdivision, install a section of curbing and install sod on a 2:1 slope.
Straw wattle with silt fence will follow the boundary uphill to protect the neighbor’s property. Mr. Connelly will verify that a note has been added to the plan to say that stockpiling will be outside the 100’ buffer zone.
Ms. Sharkey made a motion to issue an Order of Conditions for (NOI-DEP #143-0924) Gilboa Drive, Carol Gogolinski and William S. Cogley with the condition that no stockpiling be done within the 100’ and that the Commission is in possession of plans with the revision date of 10/24/2017. Mr. Greco seconded the motion. Vote: Unanimous.

7:58 PM (ANRAD-DEP #143-0936) PUBLIC HEARING CONTINUED: 30, 46 & 50 Southwest Main Street/BASILE, LAWRENCE.
Ms. Brown stated that the applicant has asked for a continuance. The applicants have not filed a Notice of Intent. Mr. Zisk will contact Art Allen of EcoTec for a status.
Ms. Sharkey made a motion to continue the public hearing for (ANRAD-DEP #143-0936) 30, 46 & 50 Southwest Main Street, Lawrence Basile to December 4, 2017 at 7:15 PM. Mr. Greco seconded the motion. Vote: Unanimous.

8:24 PM (NOI-DEP #143-0939) PUBLIC HEARING: 136 Perry Street/GALIMI HAYES, ROSE MARIE.
Ms. Brown opened the public hearing. JP Connelly of Andrews Survey and Engineering and Mr. and Mrs. Hayes joined the meeting. The applicants are looking to install a covered porch, deck, stairs, an in-ground pool, cabana, and concrete pads around the pool. The lot has many restrictions. They are proposing that the pool be placed in 2’-4’ of fill. A temporary accessway is also proposed for the construction equipment and concrete trucks. The stockpile area is within the 100’ buffer. There will be some tree clearing. The Commission reviewed photos of the site.
Mr. Zisk is concerned about high ground water. The old septic plan shows two testing pits with water at 30” and 32”. Mr. Connelly explained that if Lakeside Pools encounters ground water, they put a French drain network at the bottom of the pool. The water will exit into the stockpile area. The water needs to flow away from the wetland area.
DEP’s comment was that the swimming pool is in the buffer zone.

8:45 PM (NOI-DEP #143-0940) PUBLIC HEARING: Walnut Street, Lot #5/WALNUT STREET DEVELOPERS, INC.
Ms. Brown opened the public hearing. JP Connelly of Andrews Survey and Engineering joined the meeting. Mr. Connelly stated that there is an isolated wetland and a bordering vegetative wetland. No work is planned within the 50’ buffer. The applicant is proposing to build a dwelling that will be mostly within the 100’ buffer. The septic system is entirely outside of the 100’ buffer. The well and slurry pit will be isolated with erosion control.
The wetland delineation was done on February 8, 2017. Mr. Zisk believes that there is an approved ANRAD. Mr. Zisk and Mr. Connelly will look for the ANRAD. Mr. Connelly will check to see if there is BOH approval. He will also check for a street number.
Ms. Sharkey suggested that decks and stairs be added to the plan if the applicant wants them.
Ms. Sharkey made a motion to continue the public hearing for (NOI DEP #143-0940) Walnut Street Developers, Inc., Walnut Street, Lot #5 to December 4, 2017 at 8:30 PM. Mr. Greco seconded the motion. Vote: Unanimous.

8:53 PM (NOI-DEP #143-0---) PUBLIC HEARING: 45 Crescent Lane, Lot #10/CRESCENT LANE, LLC.
Ms. Brown opened the public hearing. Neil Rybicki of TB Builders joined the meeting. He stated that his Comp. Permit inadvertently expired in June, 2017. They were doing work without a valid Order. Mr. Zisk issued a Cease and Desist and asked them to file by the next meeting. A Notice of Intent was not filed. The hearing was advertised and the abutters were notified, however Mr. Rybicki’s engineers are still working on the NOI paperwork.
Ms. Sharkey made a motion to continue the public hearing for (NOI DEP #143-0---) Crescent Lane, LLC, 45 Crescent Lane, Lot #10 to December 4, 2017 at 8:45 PM. Mr. Greco seconded the motion. Vote: Unanimous.

8:57 PM (NOI-DEP #143-0---) PUBLIC HEARING: 41 Crescent Lane, Lot #11/CRESCENT LANE, LLC.
Ms. Brown opened the public hearing.
Ms. Sharkey made a motion to continue the public hearing for (NOI DEP #143-0---) Crescent Lane, LLC, 41 Crescent Lane, Lot #11 to December 4, 2017 at 9:00 PM. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Update: Sleepy Hollow Subdivision. Andy Leonard joined the meeting and stated that the erosion control barriers were breached during heavy rain. The brook also overflowed. Mr. Allen of EcoTec told Mr. Leonard that the rain was at the rate of a 100-year storm for 2-3 hours. Mr. Zisk presented photos. The silt has been cleaned up. Wattles were placed at the top of the stream bed at the request of Mr. Allen.
Mr. Leonard will try to have a report by the end of the week regarding the capacity of the pond during construction as opposed to construction completed with the houses.
On Thursday, they will begin construction of a dyke made of low-permeable fill. It will be tested by Briggs Engineering. Ms. Brown asked that Mr. Leonard contact Mr. Zisk when the dyke is completed so that he can take photos.
2. Update: Vine Street. Mr. Zisk stated that a complaint was sent to the DEP that someone was clearing trees and working at night. When the Building Permit came in, Mr. Zisk asked Karen Keegan of Guaranteed Builders, Inc. to be sure to flag the pond and put erosion controls along the 100’ no disturb. All work was outside the 100’ for the house lot. Construction was started. A complaint came in. Mr. Zisk emailed Ms. Keegan to certify that all work is being done outside the 100’, and she answered that it is. Mr. Zisk did not see any violation. Louis Tusino of Guaranteed Builders, Inc. joined the meeting. Mr. Zisk asked that Mr. Tusino have Ms. Keegan double check the area near the gravel knoll.
3. Request for a Certificate of Compliance: Webster Ventures, 146 Monroe Street (DEP #143-0858).
Ms. Sharkey made a motion to issue a Certificate of Compliance for Webster Ventures, 146 Monroe Street (DEP #143-0858). Mr. Greco seconded the motion. Vote: Unanimous.
4. Request for a Certificate of Compliance: Attorney Catherine Hennessy, 220 Maple Street, Lot D (DEP #143-0293). Colleen Romer of 210 Maple Street joined the meeting. She has sold her house. Her title search came up with an Order of Conditions, but it is not on her property. A discussion was held.
An Order of Conditions was issued for 210 Maple Street. Ms. Romer’s deed specifically excludes Lot D and the Order of Conditions is only on Lot D. There is no action that the Commission can take.
5. Sign Vouchers.
6. Minutes: September 18, October 2, & October 16, 2017.
Approval of the October 16, 2017 Conservation Commission meeting minutes was deferred to the next meeting.
Ms. Sharkey made a motion to approve the September 18, 2017 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Unanimous.
Mr. Greco made a motion to approve the October 2, 2017 Conservation Commission meeting minutes as amended. Ms. Sharkey seconded the motion. Vote: Unanimous.

OTHER BUSINESS:
JP Connelly of Andrews Survey and Engineering joined the meeting on behalf of Paul Bernier regarding 245 Southwest Main Street. The septic tank and chamber that were proposed and approved were relocated due to rock. Ms. Sharkey made a motion that the change of the location for the septic tank and chamber for Paul Bernier, 245 Southwest Main Street is considered a minor change to the plan. Mr. Greco seconded the motion. Vote: Unanimous.
