The meeting was called to order at 7:00pm.

Chairwoman Marylynne Dube, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, David Windoloski and Angela Saunders (Associate Member) and Stephen Zisk (Planning/Conservation Agent). Absent were Vice Chairman Michael Yacino and William Cundiff (Town Engineer).

Ed’s Construction, 88 West Street. The Commission reviewed the letter from Kopelman & Paige dated 2/6/09 regarding the basis to deny this Notice of Intent. Attorney Eichman recommends re-opening the public hearing and obtaining peer review of the project. Van Roo stated that the Applicant’s presumption was highly speculative in regard to wildlife habitat because the area is wet in July and August and there is the possibility this would provide habitat. The Applicant did not supply adequate information on how this project will not impact the area. The Applicant only provides information regarding the surrounding homes. The Commission discussed four (4) options:

1) Approve the Notice of Intent with special conditions;
2) Deny the Notice of Intent because the Applicant has not provided a detailed report on how they would overcome the presumption set forth in Section 10.3 of the Douglas Wetland Regulations;
3) Deny the Notice of Intent due to lack of information; or
4) Request the Applicant to re-open the public hearing to allow peer review.

Van Roo said that at the last public hearing continuance for Ed’s Construction, she asked the Wetland Scientist, working for the Applicant, how he compiled his information and he said that it was his opinion.

Zisk will consolidate the Commission’s concerns and the members will vote to issue or deny the Notice of Intent at their next scheduled meeting.

At 8:00pm, a MOTION was made by Mosczynski to adjourn the meeting, seconded by Windoloski. VOTE UNANIMOUS.
