The meeting was called to order at 7:01pm.

Chairwoman Marylynne Dube, Vice Chairman Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Chesley (Administrative Secretary). Absent were David Windoloski and Angela Saunders (Associate Member).
Yacino discussed affirming votes after coming out of Executive Session and he said that he would look into this.
A MOTION was made by Brown affirming all votes taken in Executive Session, seconded by Yacino. VOTE UNANIMOUS.

1. George Lahousse, 1 Buxton Road. Zisk received a telephone call from a concerned citizen about Lahousse grading in the buffer zone near a stream. Lahousse told Zisk that he wants to finish grading, screen & spread loam and seed the entire yard. He also wants to plant shrubs and mulch where needed, install a walkway to his front door and replace the driveway. Zisk suggested that he reconstruct the wall and to also place straw bales. Van Roo questioned why he was not issued a violation and telling him to file at least an RDA like everyone else in order to remain consistent with everyone. Yacino feels that the man did what was suggested immediately and came in to the Commission’s next meeting. Yacino’s opinion is that when the Commission tries to cooperate with people that are sincere and take care of the issue, the Commission needs to be flexible. Brown feels that ignorance of the law is no excuse. Dudley said to let Lahousse do the work. Yacino said that Lahousse was told by a former Commission Member that this area was not wetlands. After discussion, a MOTION was made by Van Roo that a letter be sent to Lahousse requesting the evidence of what the former member said (was it in the form of a letter or meeting minutes and what year) or if this information cannot be produced, Lahousse must file an RDA by the next scheduled meeting and Lahousse is also to be told to place straw bales, seconded by Brown. VOTE UNANIMOUS.

2. Wind Farm. This proposed wind farm is located on the Sullivan property off of Webster Street. Zisk received a fax from David Orwig of Orwig Associates requesting the Commission allow him to cut trees on cart path to access the property for the installation of a temporary tower to collect data and to determine feasibility for a wind farm. Orwig is asking that three (3) trees or one (1) tree be cut on the existing 12-foot cart path. Cundiff said that there would be no excavation done. Brown said that she does not want the stumps removed.
Van Roo asked about putting stone down if it is wet. Zisk said that the wetland on this site is upgradient and in the spring it may overflow and then if this happens, stone should be put down. Orwig will install straw bales and silt fence. Van Roo said that she would abstain from voting because she did not go look at the site and wants to know what the distance is to the wetlands. A MOTION was made by Yacino to allow Orwig to cut down the one (1) dead tree and leave it on the ground, seconded by Dudley. VOTE: YES-5, ABSTAINED-1. VOTE PASSED.

3. Dolores Colonero, Laurel Glades. Colonero is asking permission to remove two (2) trees near her cottage. After discussion, a MOTION was made by Brown to allow the tree removal with the stumps being ground to 4-inches, seconded by Dudley. VOTE: YES-5, ABSTAINED-1. VOTE PASSED.

At 7:45pm, a MOTION was made by Brown to adjourn the meeting, seconded by Mosczynski. VOTE UNANIMOUS.
