Notice of Planning Board Public Hearing
Relative to
Proposed Zoning By-law Amendment
Pursuant to M.G.L. c. 40A, § 5

The Planning Board of the Town of Douglas will hold a public hearing to discuss a proposed amendment to the Town’s Zoning Bylaw for Commercially-Scaled, Land-Based Wind Energy Conversion Facilities (CWECF), being Section 6.7 thereof, subject to compliance with applicable substantive and procedural standards.

The Public Hearing will be held on Tuesday, June 8, 2010, at 7:00pm in the Community Meeting Room, Douglas Municipal Center, 29 Depot Street, Douglas, MA.

The following amendment is proposed:

Add the following, new sentence to the end of Section 6.7.3.1:

"Any CWECF authorized pursuant to a use variance and/or other zoning relief as of the date of adoption of this Section 6.7 shall be exempt from this Section 6.7 in its entirety, including but not limited to any special permit requirement contained herein; provided that, where authorized by variance, said variance shall be exercised within one (1) year of the date of issuance thereof, pursuant to G.L. c. 40A, § 10 and as may be extended in accordance therewith; and further provided that any exempt CWECF shall be subject to all other provisions of the Zoning By-law and the requirement of site plan review by the Planning Board."

The full text of the proposed amendment and Section 6.7 of the Zoning Bylaw, to which it pertains, are available for viewing in the Community Development Department during regular business hours within the Douglas Municipal Center, 29 Depot Street, Douglas, MA.
