CONSERVATION COMMISSION MEETING MINUTES
TUESDAY, SEPTEMBER 7, 2010
EXECUTIVE SESSION

The meeting was called to order at 8:19pm.

ATTENDANCE
Vice Chairman Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, David Windoloski, Tracy Sharkey (Associate Member), Stephen Zisk (Planning/Conservation Agent) and William Cundiff (Town Engineer). Absent were Chairwoman Marylynne Dube and Kelley Donley (Associate Member).

8:19 PM EXECUTIVE SESSION: COOPERTOWN REALTY TRUST
34 DAVIS STREET
To Discuss Strategy with Respect to Litigation
At 8:19pm, a Motion was made by Van Roo to go to Executive Session and to allow Cundiff, Zisk and Lajoie to remain and will not return to regular session, seconded by Brown.

Cundiff said that there is a Handbook with specific material regarding soil testing and borings. Discussed options: 1) continue to pursue pursuant to the Handbook Requirements; 2) have soil testing done at the time of commencement of work
Zisk discussed stormwater and coldwater fishery, which BSC Group and DEP both agreed and will be controlled by DEP. Cundiff said that excavation will consist of a 50 – 60 vertical cut.
The members were asked if they wanted to continue pursuing this and all members said yes. Cundiff said that Pyne Sand & Stone wants to move forward with the project and James Pyne has been cooperating.








At 8:45pm, a Motion was made by Brown to rise from Executive Session, seconded by Van Roo.
