The meeting was called to order at 7:00pm.

ATTENDANCE
Chairwoman Marylynne Dube, Vice Chairman Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Brandi Van Roo, Tracy Sharkey (Associate Member) –arriving at 7:15pm, Kelley Donley (Associate Member), Stephen Zisk (Planning/Conservation Agent) and William Cundiff (Town Engineer). Absent was David Windoloski.

7:00 PM DISCUSSION
1. Reorganization of Members and Reappointment of Associate Member. A Motion was made by Yacino to reappoint Marylynne Dube as Chairwoman, seconded by Van Roo. Vote was unanimous. A Motion was made by Brown to reappoint Michael Yacino as Vice Chairman, seconded by Mosczynski. Vote was unanimous. A Motion was made by Yacino to reappoint Kelley Donley as an Associate Member, seconded by Van Roo. Vote was unanimous. Lajoie was asked to send a memo to the Board of Selectmen.
2. Request for Certificate of Compliance/Schedule Site Walk: Charles & Judith Maddocks, 39 Main Street (DEP #143-0709). The Commission did a site walk and after discussion, a Motion was made by Van Roo to issue a Certificate of Compliance, seconded by Brown. Vote was unanimous. The Certificate will be signed at the next meeting.
3. Request for Extension Permit: KTKM Realty Trust, “Stonegate at Douglas” Subdivision, Franklin Street (DEP #143-0505). Zisk informed the Commission that the six (6) years has run out but could maybe be issued a Partial Certificate of Compliance for work that has been completed. The remaining work is that both cul-de-sacs need to be paved. The Commission scheduled a site walk for 8/5/10 @ 9am.
4. River Flow coming from Whitin Reservoir: Present was Russell Gray of 206 West Street. Gray said that a couple of weeks ago the Whitin Reservoir District shut off the water flow for a week, which caused fish to die down stream. The water flow was opened up again two days ago but the spillway water just seeps through. Gray said that the rise and fall of the water is causing erosion and floods his property. Cundiff said that the outflow (draw downs) may warrant filing with the Commission. Dudley agreed that they are not meeting the Special Acts and that the water is flowing half of what it should be. Cundiff was asked to get a copy of the “Special Acts”. The Commission will invite the District in to the next meeting to discuss the issues. Brown said that the District is in violation now and should have them in and also file. Yacino agreed that they are in violation due to no life in the river and not enough water for anything to survive. Van Roo said that the Commission needs to have communication with the District. Dube asked that a violation notice be sent. A site walk was scheduled for 8/5/10. Van Roo suggested sending a violation notice and have them in or the Commission will begin an enforcement order. A Motion was made by Yacino to have the Whitin Reservoir District in on 8/16/10 @ 8:00pm, seconded by Van Roo. Vote was unanimous. Yacino also wants National Wildlife notified. Van Roo will write a letter and ask them to come down and look at the situation.

7:55 PM – (RDA) PUBLIC MEETING – 3 Vine Street / CORRON, LISA
Present was Owner Lisa Corron. Corron was issued a violation notice for cutting trees on her property within the buffer zone. The proposed work consists of tree removal, general clean-up and landscape restoration. Van Roo asked about the removal of the stumps and Corron said any stumps that are outside the 100-foot buffer zone would be removed from the property. Van Roo said she feels comfortable but would like Zisk to check the erosion controls prior to any work being done. Corron said that she was going to place silt fence and straw bales (or waddles). Corron said she is not bringing in fill but plans to level the area. After discussion, a Motion was made by Van Roo to issue a Negative Determination of Applicability with the conditions that silt fence or straw bales are to be used for erosion control, Zisk is to be contacted when erosion controls are placed and will monitor during the duration of the project and loam & seed area to match the current contours, seconded by Yacino. Vote was unanimous. A Motion was made by Van Roo to issue Corron a $100 fine for cutting trees, seconded by Brown. Vote was unanimous. Corron said she would be in this week to pay the fine.

8:15 PM SCOTT & CHRISTINA WASSELL, 54 OAK STREET
Installation of Utility Poles
Present were Scott & Christina Wassell. The owners are requesting permission to install three telephone poles along their driveway close to the wetland areas. After discussion, a Motion was made by Van Roo to approve the request and the amended plan, seconded by Brown. Zisk will add this revised plan to the Wassell’s file. Lajoie will write a letter to National Grid regarding the Commission’s approval.

These minutes will be approved at the next meeting.

DISCUSSION
1. Mechanic Street Bridge – Mass DOT. Highway Superintendent John Furno wants to know if they need to file with Conservation for fixing the bridge. Forms will be put on the bridge to restore it. Dube asked about the arch because it is a historic site and Cundiff said that the work to be done will not change the bridge’s appearance in any way. Brown asked when the work will begin and Cundiff said probably this summer. The Commission agreed that an RDA must be filed for the project. Cundiff to inform Furno and MassDOT.
2. West Street Well Site. A Motion was made by Yacino to ratify the action taken at the well site on West Street that was sent to the Board of Selectmen, seconded by Brown. Vote was unanimous. Yacino said that dirt bikes and ATV’s have done a lot of damage on the property and is littered with trash. This is a town well site for drinking water and endangered species are located there which makes this a very sensitive piece of property.
3. NPDES. Cundiff said that he would contact the State to ask if they would come in to a meeting in September.

ADJOURNMENT
At 8:45pm, a Motion was made by Brown to adjourn the meeting, seconded by Van Roo. Vote was unanimous.
