The meeting was called to order at 7:00pm.

ATTENDANCE
Chairman Michael Yacino, Linda Brown, Brandi Van Roo, David Windoloski, Tracy Sharkey, Stephen Zisk (Planning/Conservation Agent) and Maria Lajoie (Administrative Secretary). Also present David Gallant. Absent was William Cundiff (Town Engineer).

7:00 PM DISCUSSION
1. Newly appointed Commission member David Gallant present and introduced him. Gallant will be unable to participate in this meeting tonight because he has not yet been sworn in by the Town Clerk.
2. Received a Memo from Michael Guzinski, Town Administrator dated 2/29/12: Wetland Protection Fund. There was much discussion regarding the Administrator’s request for $10,000 for FY13. Sharkey asked what the history was of giving the Selectmen money from this account. Yacino said that in 2008, the Commission agreed to give the Selectmen $5,000 per year for five (5) years beginning in FY09. For FY10, $5,000 was given, $10,000 in FY11 and $5,000 in FY12 but agreed that nothing would be given in FY13 because the Commission met the agreement made with the Selectmen for a total of $25,000. There was much discussion about donating additional funds. Yacino asked Zisk if he could have Cundiff do another grid for the next meeting. Van Roo is concerned about the Selectmen will be asking for money on an annual basis until the account is empty and are there any other departments, boards or committees donating their funds. The Commission agreed that Yacino and Zisk will ask the Town Administrator, Michael Guzinski to meet with them to discuss the fund and to have Guzinski write a letter to the Commission stating what the Selectmen’s intensions are with the money from this fund. The Commission will discuss this at their next meeting on 3/19/12.
3. Meeting Minutes of 2/6/12. After review, a Motion was made by Brown to approve the Meeting Minutes of February 6, 2012, as amended, seconded by Van Roo. Vote was unanimous.
4. Meeting Minutes of 2/21/12. After review, a Motion was made by Brown to approve the Meeting Minutes of February 21, 2012, as amended, seconded by Van Roo. Vote was unanimous.
5. Town Clean-Up Day. Zisk said that John Furno (Highway Superintendent) agreed to pick up all the trash on Monday and bring it to the Transfer Station at no charge per the Board of Health.



7:15 PM (NOI) #143-0841 PUBLIC HEARING – 115 Shore Road / MILLER, ROBERT
Maria Lajoie received a telephone call from Seth Lajoie, representative for Robert Miller, stating that he did not place the legal notice in the newspaper but did notify the abutters. A Motion was made by Brown to hold this Public Hearing on March 19, 2012 at 8:00pm and to inform Seth Lajoie that he must place the legal notice and re-notify the abutters, seconded by Sharkey. Vote was unanimous.

7:30 PM (NOI) #DCC-05 PUBLIC HEARING CONTINUED – 34 & 36 Davis Street / PYNE SAND & STONE COMPANY, INC.
Present was Gary Vecchione (Owner), abutters Andrew Smith and Jeremy Flansburg. The Commission received a letter from Gary Vecchione dated 2/23/12 stating that the Conservation Commission members, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Adelle Reynolds (Building Commissioner) are not allowed on the 34 & 36 Davis street property without Vecchione’s permission. Zisk said that the Planning Board approved the Aquifer Protection Special Permit but denied the Earth Removal Special Permit. Vecchione said that he received a letter from Mr. James Pyne stating that he no longer was affiliated with this project. Yacino told Vecchione that the Commission needed a letter from Mr. Pyne to the Commission stating this. Vecchione then asked the Commission to close the Public Hearing and issue a decision. Zisk said that the Commission did not receive a final plan from Guerriere & Halnon with the revised date. Yacino said the Commission needs to see the final plan to make a decision and asked Vecchione if he would get a copy for the Commission and Vecchione said yes. Jeremy Flansburg stated that the slope is very steep and that straw bales and/or silt fencing needs to be placed. Vecchione said he placed straw bales down gradient from the slope. Yacino asked Zisk to go to the site to make sure everything is stabilized. Zisk said that Vecchione’s letter states that he cannot go on the property. Vecchione said that the letter said “without his permission” and Vecchione gave Zisk his permission to go on his property. Vecchione said that Guerriere & Halnon is no longer the project engineers but he will ask Mike Weaver for the final plan and a punch list. After discussion, a Motion was made by Sharkey to continue the Public Hearing on March 19, 2012 at 8:15pm, seconded by Brown. Vote was unanimous.

ADJOURNMENT
At 7:45pm, a Motion was made by Van Roo to adjourn the meeting, seconded by Sharkey. Vote was unanimous.
