The meeting was called to order at 7:13pm.

ATTENDANCE
Present were Linda Brown (Chairman), Brandi Van Roo, Michael Greco, Jack Pruitte, and Stephen Zisk (Conservation Agent). Absent was Tracy Sharkey (Vice Chairman), David Windoloski, David Gallant and Maria Lajoie (Administrative Secretary).

7:13 PM DISCUSSION
1. 143 Martin Road Update. Present were owners David & Danielle Buzzell requesting a Certificate of Compliance. Zisk went to the property and said the banking is stabilized and looks good. The owners said they want to purchase a shed (10’ x 10’ or 12’ x 12’) that would be placed on gravel or cement blocks and will not be doing any excavating. Brown said they should file a Request for Determination to show where the shed would be placed. Zisk suggested that the shed be placed on stone instead of gravel. Van Roo said the erosion controls are still in place but the owners should file an RDA showing a plan as to where the shed is going and also stating that there will be no excavating and then the Commission will have a paper trail on file. Zisk said to file for an RDA, the owners only need to place an ad in the newspaper and pay $25; a full Notice of Intent would cost much more. A Motion was made by Van Roo to issue a Certificate of Compliance, seconded by Greco. Vote unanimous. The Buzzell’s said they will file an RDA when they are ready to purchase the shed.

7:25 PM (NOI) #143-0841 PUBLIC HEARING CONTINUED – 115 Shore Road / MILLER, ROBERT
Present on behalf of the Applicant was Bill Pybas of Guaranteed Builders & Developers. Zisk reviewed the revised plan and said that the plan noted that the erosion controls were extended, there will be no excavating and the material will be loaded on a truck and taken off site. A Motion was made by Van Roo to issue an Order of Conditions, seconded by Pruitte. Vote unanimous.

7:30 PM (RDA) PUBLIC MEETING CONTINUED– 21 Davis Street / DOUGLAS INTERMEDIATE / ELEMENTARY SCHOOL
Present was Superintendent Nancy Lane and her employee Courtney Keegan. A letter was received from Superintendent Lane stating that she is withdrawing the RDA because now that construction has begun, the trail has too much of a drop down and will not be used. The boards and erosion controls were removed and the students will be using the gym instead. A Motion was made by Van Roo to accept the withdrawal of the Douglas Intermediate / Elementary School RDA, seconded by Greco. Vote unanimous.
Violation Fee: Brown said that it did not make sense to charge the school a $100 fine when the money goes back into the General Fund. Van Roo disagreed by stating that the Commission has a Policy to issue fines when a violation occurs. A Motion was made by Van Roo to fine the school $100, seconded by Pruitte. VOTE: Yes-3, No-1. Vote passed.

7:40 PM (NOI) #143-0850 PUBLIC HEARING – 160 Southwest Main Street / GUARANTEED BUILDERS & DEVELOPERS, INC.
Present on behalf of the Applicant was Bill Pybas of Guaranteed Builders & Developers.
Pybas said that the Legal Notice said the Town of Brookfield instead of Douglas and will have to re-advertise. The Commission could not open this Public Hearing but scheduled it for Monday, December 3, 2012 at 7:15pm. Pybas said he was going before ZBA also for a 15-foot side yard setback.

DISCUSSION
1. 722 Northwest Main Street. Zisk said that a letter was received from Steven O’Connell of Andrews Survey stating that Lot #5 is really Lot #4.4 (Parcel 122, Lot 4.4) according to the Assessors and is asking that the Commission write a letter to Dale Bangma’s bank stating this. Zisk was asked to write this letter on behalf of the Commission.
2. 2013 Meeting Schedule. A Motion was made by Greco to approve the 2013 Meeting Schedule as presented, seconded by Van Roo. Vote unanimous.
3. Meeting Minutes of 10/1. A Motion was made by Pruitte to approve the Meeting Minutes of October 1, 2012, as written, seconded by Greco. Vote unanimous.
4. Meeting Minutes of 10/15. A Motion was made by Greco to approve the Meeting Minutes of October 15, 2012, as amended, seconded by Van Roo. Vote unanimous.
5. Meeting Motions. Zisk stated that motions are not necessary when someone withdraws an application.
6. Hemlock Street Bridge Update. Zisk said that the State redesigned the bridge and added new abutments and will expand the rip rap and straw bales.

SIGNED:
1. Certificate of Compliance: Shady Knoll Estates. A Motion was made by Greco to issue a Certificate of Compliance for Shady Knoll Estates, seconded by Van Roo. Vote was unanimous. These roads (Downs Road, Manzi Way, Essex Street & Crescent Lane) were voted as public ways at town meeting.
2. Certificate of Compliance: David & Danielle Buzzell, 143 Martin Road.
3. Order of Conditions: Robert Miller, 115 Shore Road.

ADJOURNMENT
At 8:05pm, a Motion was made by Van Roo to adjourn the meeting, seconded by Greco. Vote unanimous.
