The meeting was called to order at 7:01pm.

Present: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Brandi Van Roo, David Windoloski, Michael Greco, Jack Pruitte Stephen Zisk (Conservation Agent) and Maria Lajoie (Administrative Secretary).
Absent: David Gallant.

Present was Nicholas Cristofori, P.E. of Comprehensive Environmental Incorporated and Cary VandenAkker, Wallum Lake State Park Supervisor. Cristofori is requesting permission to perform limited trail maintenance and rehabilitation to allow emergency vehicular access along the trail. The Midstate Trail is a popular hiking and biking trail located within the Douglas State Forest. Construction will include the removal of select large boulders, trees, stumps, roots, logs and select areas will also be re-graded to allow emergency access along the trail. The project is approximately 2,272 linear feet long with an area of .78 acres, all of which will be disturbed. No work will take place within any resource areas and only a portion of work will be within the 100-foot buffer zone (433 linear feet and .15 acres total). Straw bales and/or silt fence will be placed along the downhill slope of areas subject to re-grading as necessary. Zisk said this work consists of two areas within the Commission’s jurisdiction and is in the same area as last year when a beaver retriever was installed. Van Roo said that when she walks the trail in that area someone is laying down black, dusty dirt that gets on her clothes and skin and it also smells. Cary said it may have been put down years ago by the railroad but Van Roo said this is fresh. VandenAkker agreed to go with her to the area that she is talking about. Zisk asked if they would be putting down the same ½” gravel as the last project and VandenAkker said yes and that it will take less than two weeks but more than one to complete. The total disturbance is .02 acres and the closest point to the resource area is 40 to 50 feet. Discussed unauthorized motorized vehicles (dirt bikes and ATV’s) ruining the trails and how the gates don’t keep them out. VandenAkker said the Environmental Police did a few stings last year but they need to be out there more often. Brown asked Van Roo what the impact is and Van Roo said wildlife, vegetation and noise pollution and said she is not complaining about emergency vehicles. Sharkey feels that by keeping up with the maintenance, the emergency vehicles can get more stings done. VandenAkker said he would talk to the Environmental Police about checking more often. The Commission did not feel it was necessary to do a site walk since they were out there last year.
A Motion was made by Sharkey to issue a Negative Determination of Applicability with conditions that erosion controls are placed and Zisk is notified prior to the commencement of work, seconded by Windoloski. Vote: Yes-5, Abstained-1. Vote passed. Lajoie was asked to contact the Commission when the permit is ready to be signed.

1. Meeting Minutes of 3/18/13. After review, a Motion was made by Sharkey to approve the Minutes of March 18, 2013, as written, seconded by Pruitte. Vote: Yes-5, Abstained-1. Vote passed.
2. Meeting Minutes of 4/1/13. After review, a Motion was made by Sharkey to approve the Minutes of April 1, 2013, as written, seconded by Van Roo. Vote: Yes-4, Abstained-2. Vote passed.
3. Request for Certificate of Compliance: 58 Lakeshore Drive. The Commission scheduled a site walk on 4/22/13 @ 6:00pm.

1. (Used) File Cabinet Purchase. Lajoie purchased a used file cabinet for the Commission. The Chairman previously approved this expense.
2. MACC Handbook for Greco.

At 7:55pm, a Motion was made by Van Roo to adjourn the meeting, seconded by Sharkey. Vote unanimous.
