SIGN BYLAW STUDY GROUP MEETING MINUTES
WEDNESDAY, MARCH 20, 2013

A meeting of the Sign Bylaw Study Group was held on Wednesday, March 20, 2013. Mr. Marks called the meeting to order at 6:05 PM at the Douglas Municipal Center.

ATTENDANCE
PRESENT: Ernest Marks (Chairman), Richard Preston, Tracy Sharkey, Michael Zwicker, William Cundiff (Town Engineer)
ABSENT:

1. SIGN BYLAW DISCUSSION
Mr. Cundiff presented an email from Atty. Rich Bowen, who prepared language to add to the existing bylaw to allow an appeal or waiver process. A full overhaul of the bylaw would be prepared for the fall Town Meeting. The email was reviewed.
It was decided that appeals should be made to the Board of Selectmen. The Building Commissioner would issue the permits and be the enforcement officer. It was decided that a hearing should be held within thirty days of receipt of a waiver application instead of fourteen days and seven days of advance notice of the hearing should be provided to the applicant. Mr. Cundiff suggested replacing, “The Board shall issue a decision…” with “The applicant shall be notified of the Board’s vote no later than seven (7) days after the decision.” He also suggested adding that repetitive petitions would not be allowed for a period of two (2) years. Mr. Preston suggested that the Board of Selectmen issue a written decision no later than fourteen days after the hearing.
Mr. Cundiff suggested “Any person receiving a notice referred to in section 10.3.2.1 above, or has been denied an application for a permit under section 10.2.1.3 may, within twenty-one (21) days apply to the Board of Selectmen for a waiver of any provisions of the sign by law.” Mr. Zwicker suggested, “Any person receiving Notice of Violation of any part of Article 9, may appeal to the Board of Selectmen.” It was the consensus of the committee to run the language by Town Counsel.
Mr. Cundiff presented the amended language. Mr. Cundiff will ask Atty. Bowen if they can strike “subsidiary”. Mr. Cundiff will renumber the draft to correct the article numbers from “10” to “9”. Mr. Cundiff will send a copy to the Planning Board and the Board of Selectmen and schedule a public hearing with the Planning Board.

The next meeting will be April 10, 2013 at 6:00 PM.

3. ADJOURNMENT
Ms. Sharkey made a motion to adjourn the meeting at 6:48 PM. Mr. Preston seconded the motion. Vote-Unanimous.
