The meeting was called to order at 7:00pm.

ATTENDANCE
Present: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Brandi Van Roo, Michael Greco, Jack Pruitte, Stephen Zisk (Conservation Agent) and Maria Lajoie (Administrative Secretary).
Absent: David Windoloski and David Gallant.

7:00 PM (RDA) PUBLIC MEETING – 94 Island Road / RUSSELL, JUDITH
Present was Owner/Applicant Judith Russell and her daughter Lauren. Russell is requesting permission to install steps to existing deck. Footings will be put down and holes for the sona tubes will be hand dug. The stairs will be the average of 3-feet wide. The Commission had no issues. A Motion was made by Van Roo to close the Public Meeting and issue a Negative Determination of Applicability, seconded by Pruitte. Vote: Unanimous. The members signed the Negative Determination of Applicability.

DISCUSSION:
1. Cummings Court: Tree Removal. Zisk received a phone call from Mary Crawford of 12 Cummings Court stating that additional trees were down and leaning on her property from the conservation land. She said she had trees that needed to come down in her property also and is having Full Circle Tree Care remove them at her expense. Zisk said he went to the site and observed four (4) cherry & one (1) pine tree leaning over the fence and one (1) pine tree next to the fence. Zisk contacted Full Circle Tree Care for an estimate for the members for tonight’s meeting and also showed pictures of the trees stating that the pines are snapping off at the top. Pruitte has a concern of taking down trees that are not dead. Van Roo does not want to have that pine tree next to the fence taken down and to see only the leaning trees taken down. A Motion was made by Van Roo to remove the leaning trees with the exception of #3 (tall pine next to fence that is not leaning), seconded by Pruitte. Vote: Unanimous. Zisk to contact Full Circle Tree Care to tell him which trees are to come down and to submit a revised invoice.
2. Meeting Minutes of 5/7/13. The Commission will approve these minutes at their meeting on 6/3/13.

7:15 PM (NOI) #143-0855 PUBLIC HEARING – 8 Meeting House Lane, Lot #28 / KTKM REALTY TRUST
Present on behalf of the Owner was their representative Peter Lavoie of Guerriere & Halnon. The project involves grading of the back yard of a proposed single family home, septic system, well and driveway, a portion of the work falls within 100-feet of a bordering vegetated wetland. The property is located at the end of the cul-de-sac and consists of 2.4 acres. There is 2,000 square feet of buffer zone and 23,000 square feet to be disturbed. Straw wattles are to be placed during construction. Van Roo asked if the owner intends to have more lawn and Lavoie said yes. Zisk said that the grading will be on the right side of the property within the buffer zone. Lavoie said the owners want their privacy in the back of the property. Lavoie said markers could be placed along the buffer zone area so it will not be violated. Van Roo suggested plantings instead of markers. Sharkey asked if there were a lot of boulders on the site and Lavoie said yes. Sharkey suggest boulders be placed along the buffer zone 20-feet apart on the south side of the lawn. Lavoie said 4-foot by 6-foot boulders could be placed. Van Roo suggested vegetation be planted in between the boulders or place the boulders closer together. Lavoie said that boulders will be placed 10-feet apart. Even though this is not a condition of the Order of Conditions, the Commission asked Lavoie to ask the owner if they would consider continuing the boulders to the back of the property along the north corner. A Motion was made by Pruitte to request that Lavoie ask the owner to consider continuing the boulders to the back of the property along the north corner, seconded by Van Roo. Vote: Unanimous. A Motion was made by Sharkey to close the Public Hearing and issue an Order of Conditions, seconded by Greco. Vote: Unanimous.

7:30 PM (NOI) #143-0854 PUBLIC HEARING – 12 Meeting House Lane, Lot #27 / KTKM REALTY TRUST
Present on behalf of the Owner was their representative Peter Lavoie of Guerriere & Halnon. The project involves the proposed grading for the driveway and side yard of the proposed single family home, a portion of which falls within 100-feet of a bordering vegetated wetland. The property consists of 4.2 acres with 22,000 square feet of disturbance. The drainage goes around the house. The disturbance to the wetland is 80-feet. Van Roo asked if the driveway could be moved and then nothing would be in the buffer zone. Lavoie will revise the plan to show the driveway moved to the right to be out of the buffer zone. A Motion was made by Van Roo to continue the Public Hearing on Monday, June 3, 2013 at 7:15pm, seconded by Sharkey. Vote: Unanimous.

7:45 PM (NOI) #143-0853 PUBLIC HEARING CONTINUED – Hemlock Street at Tinkerville Brook / TOWN OF DOUGLAS
Present on behalf of the Town is Matthew Weidele of CDR Maguire. Weidele submitted a General Plan, Profile & Typical Section, Army Corps of Engineers Programmatic General Permit – Inland Wetland Category Determination Form, Bridge Plan & Elevation, Existing Bridge Openness Ratio, Special Provisions to the Mass Department of Transportation Standard & Supplemental Specifications and information on the Microbial EarthBlanket. Brown and Zisk did a site walk on 5/17/13. MassDOT directed Weidele to use mulch rip rap and an earth blanket for water quality. A large double ash tree will be removed. Sharkey asked if there would be filtration and Weidele said yes. Van Roo asked what the blanket was and Weidele said composted mulch. Zisk said that this would be used in the water quality swale. Van Roo asked what was in the mineral grit and said the explanation is vague in the contract. Weidele said this is not his expertise but it is written in the contract to be used. Brown said that as a condition she wants it stated to use rip rap and not mulch spray. Brown asked what their definition of the time of low flow and Weidele said July 31 to August 31. Zisk said normally the low flow is from July 31 to September 15. The Commission agreed to change the date from June 15 to September 15 in case the contractor runs into problems during the project. Zisk asked about the boulders under the bridge and Brown said the water does get high. Cundiff asked that two (2) boulders be removed as requested by the abutters, Mr. & Mrs. Hutnak because they said the boulders create turbulence and are causing scouring. Van Roo said the boulders are a rocky sub-strate and she does not want them removed. Cundiff said the Hutnak’s told him that they have erosion problems due to the boulders. Van Roo said that boulders detain water and by removing them the Hutnak’s will have more problems. Weidele said that the rocks were placed under the bridge years ago to reinforce the slopes. Van Roo wants the rocks to stay where they are because this would not be a solution to scouring and the Commission agreed. Zisk said that removal of the boulders was not a part of the Notice of Intent. Weidele informed the Commission that the bridge number has changed from D-09-014 (6NK) to #D-09-014 (BKP). After discussion, a Motion was made by Van Roo to close the Public Hearing and issue an Order of Conditions, seconded by Sharkey. Vote: Unanimous.

At 8:10pm, a Motion was made by Sharkey to adjourn the meeting, seconded by Van Roo. Vote: Unanimous.
