The meeting was called to order at 7:00pm.

Present: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Brandi Van Roo (Member), Michael Greco (Member), Jeremy Manning (Member), Stephen Zisk (Conservation Agent) and Maria Lajoie (Administrative Secretary).

Present on behalf of the Applicant was Daniel Dunleavy and Stephen Dix. The Applicant is requesting permission to pave a 40-foot long by 25-foot wide area to connect the existing plant pavement to Gilboa Street on the east side of the mill. Mr. Zisk said that the pond is located on the right side. Ms. Brown asked how far away the stream was and Mr. Zisk said it was on the other side of the parking lot and is further away than the pond is which is 80-feet. Mr. Dunleavy said the main reason they want to do this work is for fire safety reasons. Ms. Brown asked if they would be bringing in any fill and Mr. Dunleavy said no and that they will be stripping what is there and then paving and that they are also taking down the chain link fence. A Motion was made by Ms. Van Roo to close the Public Meeting and issue a Negative Determination of Applicability, seconded by Mr. Manning. Vote: Unanimous.

1. Request for a Certificate of Compliance: Kyle Ellis, 118 Chestnut Street. Present was Michael Yerka of Civil Site Engineering on behalf of Mr. Ellis. Mr. Yerka said that this is an old Order of Conditions (DEP #143-0568) from 2003 that needs to be closed and that no work has been done on this site. The Commission approved the Certificate of Compliance.
2. Request for a Certificate of Compliance: KTKM Realty Trust, 32 Olde Carriage Lane, Lot #25 (DEP #143-0847). There was discussion about the limit of disturbance, landscaping, plantings and mulch at this site. Ms. Van Roo says it looks good but she is not comfortable looking at the pictures that Mr. Zisk took versus the plan. There was much discussion regarding people who want a Certificate of Compliance (such as this one) immediately because they are closing on a house in two weeks or less. We need to let the homeowners, engineers, attorney’s, real estate agents, etc. know that the Commission has to perform a final site walk and request a month to six weeks ahead of time is not too much to ask. From now on, last minute requests such as this one will not be approved until the site walk is performed. The Commission asked that a letter be sent to homeowners to either close their Order of Conditions or renew it. A Motion was made by Ms. Van Roo to issue a Certificate of Compliance for 32 Olde Carriage Lane, seconded by Ms. Sharkey. Vote: Unanimous.
3. South Street Bridge Update. Mr. Cundiff received an e-mail from Highway Superintendent John Furno dated 11/20/13 stating that the emergency work has been completed and the sand bags as well as the stone have been put in place to prevent any further damage until permanent repairs can be made. Ms. Brown asked if a Notice of Intent had been filed yet and Mr. Zisk said not yet. Ms. Brown asked Ms. Lajoie to contact Mr. Cundiff to tell him a Notice of Intent needs to be filed for the 1/6/14 meeting for this emergency work. Another Notice of Intent must be filed when permanent repairs are to be done.
4. Minutes: 8/19, 10/7, 10/21, 11/4/13. These minutes will be approved at the next meeting in order for the Commission to review them.

At 7:53pm, a Motion was made by Ms. Van Roo to adjourn the meeting, seconded by Ms. Sharkey. Vote: Unanimous.
