PLANNING BOARD MEETING MINUTES
TUESDAY, DECEMBER 10, 2013

A meeting of the Planning Board was held on Tuesday, December 10, 2013. Mr. Marks called the meeting to order at 7:05 PM and announced that the meeting is being recorded and will be available on cable and on the website.

ATTENDANCE
PRESENT: Ernest Marks (Chairman), Eben Chesebrough (Vice Chairman), Michael Greco, Robert Werme, Jr., Tracey Sharkey (arrived 7:49 PM), William Cundiff (Town Engineer)
ABSENT: Michael Zwicker

7:05 PM PUBLIC HEARING: LOUIS TUSINO (MOD-131031) APPLICATION FOR A MODIFICATION OF A SUBDIVISION PLAN, Cardinal Drive
Mr. Marks opened the public hearing. Mr. Bill Pybas of Guaranteed Builders joined the meeting and asked for a continuance.
Mr. Chesebrough made a motion to continue the public hearing, Louis Tusino (MOD-131031), Application for a Modification of a Subdivision Plan, Cardinal Drive to January 14, 2014 at 7:00PM. Mr. Werme seconded the motion. Vote: Unanimous.

SIGN:
1. Funari Whitin Reservoir Estates-two vouchers. Mr. Cundiff stated that the roads have been paved for both vouchers. The next bill from the consultant will be significant. Mr. Cundiff has sent a letter to Funari requesting replenishment of the account for the full amount. He has not heard back yet.

7:17 PM PUBLIC HEARING: EDWARD & MARY LOGUE-MAGUIRE (AA 131101) APPLICATION FOR AN ACCESSORY APARTMENT SPECIAL PERMIT, 31 Royal Crest Drive
Mr. Marks opened the public hearing. Mr. Cundiff stated that the permit was previously approved in November, 2001. It is currently expired. Nothing has changed from the original permit. Extensions were approved through October, 2013. No waivers are required; taxes are current. The Fire Chief stated that the apartment must be equipped with appropriate smoke and carbon monoxide detectors. Ms. Maguire stated that the detectors are in, connected and working.
Mr. Chesebrough made a motion to postpone final action on the Special Permit, Mary and Edward Logue-Maguire until an appropriate time later in the meeting. Mr. Werme seconded the motion. Vote: Unanimous.

OPEN SESSION
Mr. Cundiff stated that the Board of Selectmen have been advertising for the open positions on the Planning Board. He sent an email to Ms. Suzanne Kane to be sure all the appropriate advertising is done and stating that the Planning Board would like a joint meeting with the Board of Selectmen to make the appointments.

MINUTES: November 12, 2013, November 27, 2013
Mr. Chesebrough made a motion to approve the November 12, 2013 Planning Board meeting minutes as presented. Mr. Greco seconded the motion. Vote-Unanimous.
Approval of the November 27, 2013 Planning Board meeting minutes was held until the next meeting.

7:33 PM PUBLIC HEARING: SHANNON (MILLS) RODDY (AA 131105), APPLICATION FOR AN ACCESSORY APARTMENT SPECIAL PERMIT, 94 Pine Street
Mr. Marks opened the public hearing. Mr. Cundiff stated that the original permit was issued December, 2004. The apartment was constructed at 1100 sq. ft., which did receive a waiver. Extensions were granted through March, 2005. The property transferred hands. A new application was submitted from the new owner on November 5, 2013. Taxes are current. A waiver will be required. The occupant of the apartment is the niece of the current owner. Mr. Cundiff stated that the Fire Chief stated that the apartment must be equipped with working smoke and carbon monoxide detectors.
Ms. Shannon Roddy stated that the apartment is over a garage. She clarified that the two sketches are for the upstairs and the downstairs. The square footage was clarified at 1100 sq. ft. Ms. Roddy stated that all the smoke and carbon monoxide detectors are new.
Mr. Chesebrough made a motion to grant the waiver for the Special Permit Accessory Apartment Application of Shannon (Mills) Roddy (AA 131105), 94 Pine Street. The waiver is to allow the accessory apartment to be 1100 sq. ft. Mr. Werme seconded the motion. Vote: Unanimous.
Mr. Marks postponed final action on the Special Permit Accessory Apartment Application of Shannon (Mills) Roddy (AA 131105), 94 Pine Street until an appropriate time later in the meeting.

7:45 PM PUBLIC HEARING CONTINUED: UPTON SITE REMEDIATION, LLC (SPR 130819) APPLICATION FOR SITE PLAN REVIEW: 466 Northeast Main Street, Map 140, Parcel 7
Mr. Marks reopened the public hearing. Mr. Gene Bernat of Upton Site Remediation joined the meeting. Mr. Bernat stated that he acted on the comments from the last meeting to the best of his ability: including a narrative of the flowable fill, showing the location of the future septic field, including 5’ grades on the conceptual plan, and a storm water calculation. Mr. Cundiff’s comments were given to him today, which ask for the engineer to redraw the plan. Mr. Bernat asked for some clarifications. Mr. Bernat asked the board to consider granting the permit based on Mr. Cundiff receiving what he has asked for in his comments.
Mr. Bernat stated that it is difficult to provide an estimate of cost due to the variability of the project. Mr. Cundiff explained that the estimate is for bonding purposes, and the project would require slope stabilization, should the project not be completed. A discussion was held. Mr. Bernat will try to come up with an estimate.
Mr. Bernat asked for an explanation regarding the request to show detail on the entrance/egress, item #11. Mr. Cundiff explained that this item is consistent with the survey requirement. He was concerned where the egress would be relative to Monroe Street. A discussion was held, including drainage conditions. Ms. Sharkey joined the meeting at 7:49 PM.
Mr. Cundiff suggested continuing the hearing until the next meeting, and he will plan on having a decision at that time.

DISCUSSION
1. NextSun Energy: Soil Testing. Mr. Steve O’Connell of Andrews Survey & Engineering joined the meeting. Kevin Donegan of Gehrlicher Solar and Tom McIntyre and John Palmer of McIntyre Loam were also in attendance. Mr. O’Connell presented the Topographic As-Built Plan that Gehrlicher asked him to do. He added the test pits. They found that some areas were slightly deficient in depth; others exceeded the depth of four inches. The quality of the soil was suitable to grow grass. Surface rocks and sticks larger than ¾ inches were picked up. Additional loam was added and hand-seeded to areas outside the fence where loam was deficient. When weather is appropriate, straw mulch will be added to seeded areas. When spring comes, everything will be inspected to be sure it meets the satisfaction of the Conservation Commission, the Planning Board and the owner.
In response to Mr. Cundiff’s inquiries, Mr. O’Connell stated that the property line is not different on this plan than was on the approved plan, and the solar panels are beyond the building set-back. Mr. Cundiff summarized the results of the test holes. There was no testing done within the panel areas, and everyone present at the site walk assumed that the tests areas are representative of what is in the panel area.
Mr. Craig Bosma of 173 Wallis Street stated that rye is an annual grass and will die even if mulch is placed over it. Nothing was taken care of inside the fence. What has been done does not meet the satisfaction of the owner. Mr. O’Connell replied that the rye will give the area a jump start. Whatever needs to be reseeded will be reseeded in the spring. A discussion was held regarding the soil and vegetation inside the fence.

Ms. Sharkey made a motion to adjourn the meeting at 8:25 PM. Mr. Chesebrough seconded the motion. Vote: Unanimous.
