PLANNING BOARD MEETING MINUTES
TUESDAY, MARCH 25, 2014

A meeting of the Planning Board was held on Tuesday, March 25, 2014. Mr. Marks called the meeting to order at 7:04 PM and announced that the meeting is being recorded and will be available on cable and on the website.

ATTENDANCE
PRESENT: Ernest Marks (Chairman), Eben Chesebrough (Vice Chairman), Ken Ballou, Michael Greco, Tracy Sharkey, Robert Werme, Jr., Michael Zwicker, William Cundiff (Town Engineer)
ABSENT:

1. 7:04 PM P UBLIC HEARING: DOUGLAS PLANNING BOARD
Proposal to amend the zoning map by extending the existing R/A Zoning District. Located easterly of Monroe Street and northerly of Maple Street in a northerly direction to the Southern New England Trunkline Trail. The affected area is currently Zoned Industry.
Mr. Marks opened the public hearing. Atty. Henry Lane joined the meeting to present the proposal. The site is approximately 53 acres, 2/3 of which is owned by his clients. It is currently Zoned Industry, but it is separated from the existing industrial zone by the Trunkline Trail and the pipeline. Monroe Street is zoned for Residential purposes on that side of the street and is not suited for industrial traffic. The Economic Development Committee and the Board of Selectmen did not support the proposal. Atty. Lane and the petitioners feel that the land is not suitable for industry but is suitable for residential development.
A discussion was held. Mr. Greco does not feel this change should be made, especially when the Board of Selectmen is spending money for an economic development study. It would make sense to not change the zoning until that study is complete. Mr. Zwicker does not feel that the land could be accessed from Rte. 16. Ms. Sharkey does not want to take away industrially zoned land without replacing it. Mr. Marks does not feel the land could be used for an industrial purpose. Mr. Werme agrees.
Dennis Michalik, 415 Northeast Main Street stated that he does not feel the town needs more residential development.
Pamela Schwartz, 343 Southeast Main Street, asked if any of the land were wetlands. The northwest corner has a small amount of wetlands.
Mr. Chesebrough made a motion to close the public hearing, Proposal to amend the zoning map by extending the existing R/A Zoning District. Mr. Zwicker seconded the motion. Vote: Unanimous.
Mr. Chesebrough made a motion to report favorably to the Annual Town Meeting regarding the rezoning of 53 acres off of Monroe Street from Industrial to Residential Agricultural. Mr. Zwicker seconded the motion. Vote: Aye-5, No-2.
Atty. Lane left the meeting.

2. 7:23 PM PUBLIC HEARING: DOUGLAS PLANNING BOARD
Proposal to amend the dimensional regulations for single family homes in a Residential-Commercial II (RC-2) Zoning District.
Mr. Marks opened the public hearing. Les Stevens joined the meeting. He stated that the Board of Selectmen voted in favor of the article. Of the 65 properties in the zoning area, 22 lots are non-conforming. This proposal would bring all but 4 of those 22 lots into conforming. Mr. Marks will present the article at Town Meeting.
Mr. Chesebrough made a motion to close the public hearing, Proposal to amend the dimensional regulations for single family homes in a Residential-Commercial II (RC-2) Zoning District. Ms. Sharkey seconded the motion. Vote: Unanimous.
Mr. Chesebrough made a motion to report favorably to the Annual Town Meeting on the rezoning of the Residential-Commercial II (RC-2) Zoning District as presented in the article. Mr. Greco seconded the motion. Vote: Unanimous.

3. 7:30 PM PUBLIC HEARING: DOUGLAS PLANNING BOARD
Proposal to amend the Zoning Map by extending the existing Village Business (VB) Zoning District. Located southeasterly of Route 16 (Main Street) in the vicinity of Gleason Court. The affected area is currently Zoned Village Residential (VR).
Mr. Marks opened the public hearing. Mr. Cundiff presented the proposal. He stated that the Old Grammar School Disposition Committee (OGSDC) would like to rezone the area surrounding the Old Grammar School because it is currently VR and they want to rezone it to VB. This rezoning would broaden the potential uses at this location and accept a wider range of proposals. This rezoning includes the flat area behind the building and the parcel across the street, opposite Gleason Court, that is town-owned.
If the property was sold, there is a question as to who would retain ownership of the road. Gleason Court only extends to the end of the Post Office. The rest of it is a right-of-way. Mr. Cundiff stated that the town could have public access through an easement or it could be laid out as a public right-of-way. A discussion was held.
Ms. Pamela Schwartz of the OGSDC stated that the proposal was brought before the School Committee. They were concerned about the nature of the use of the building, preferably not for housing. A representative from the Worcester Business Development Committee stated that the building is not suitable for housing.
Mr. Chesebrough made a motion to close the public hearing, Proposal to amend the Zoning Map by extending the existing Village Business (VB) Zoning District. Mr. Zwicker seconded the motion. Vote: Unanimous.
Mr. Chesebrough made a motion to report favorably to the Annual Town Meeting on the article to rezone the area of approximately 5.36 acres from Village Residential to Village Business, located southeasterly of Route 16 (Main Street) in the vicinity of Gleason Court and including the so called Old Grammar School. Mr. Zwicker seconded the motion. Vote: Unanimous.

DISCUSSION:
1. 772 Northwest Main Street: Proposed Residential Compound. Mr. Cundiff stated that the proposal is looking theoretically at 22 2-acre lots on the 47 acre parcel. Joseph and Meghan Schlesman joined the meeting. They wish to sell their home and build a home farther up the driveway. They are unable to do that due to frontage restrictions. Their proposal is for 7 lots. She presented their first scenario and second scenario. Mr. Cundiff presented the requirements for a residential compound. A discussion was held regarding frontage, accessibility for emergency vehicles, and formation of an association. Mr. Chesebrough suggested expanding the driveway beyond 14’.
Ms. Schlesman asked if she could propose the compound in two phases: propose less than 10 lots and then build only 1. Mr. Cundiff was not comfortable with that and would seek the advice of Town Counsel.
The Board was favorable with the Schlesmans moving forward.
2. Received a letter from Stuart Clark of Bucks Hill Realty dated 3/18/14 requesting a 2-year extension for “Morse Pond Preserve” subdivision. Mr. Marks stated that a request for a withdrawal was also received. He read the withdrawal request. The Board was in agreement with the withdrawal request. The applicant will re-file a Residential Compound with the Planning Board.
3. Site Distance Report: Upton Site Remediation, 466 Northeast Main Street. Mr. Cundiff stated that Gene Bernat of Upton Site Remediation provided the report. A traffic engineer found that there was not adequate site distance. Mr. Bernat is proposing to take down a few trees and do some regrading within the town right-of-way. This proposal has been shared with the Board of Selectmen, the Highway Superintendent, and the Tree Warden. Mr. Cundiff is asking Mr. Bernat to flag the trees he plans to take down. A discussion was held.

OPEN SESSION:
Mr. Cundiff presented an informal preliminary drawing of 74 Main Street. He had a Technical Review meeting with the applicant’s engineer today. He expects a filing to be made within a month.
The next meeting will be April 8, 2014 at 7:00 PM.

MINUTES: March 4, 2014
Mr. Greco made a motion to approve the March 4, 2014 Planning Board meeting minutes as presented. Ms. Sharkey seconded the motion. Vote: Unanimous.
