October 28, 2014 Planning Board Meeting

A meeting of the Planning Board was held on Tuesday, October 28, 2014. Mr. Marks called the meeting to order at 7:07 PM and announced that the meeting is being recorded and will be available on cable and on the website.

PRESENT: Ernest Marks (Chairman), Ken Ballou, Mike Greco, Tracy Sharkey, Robert Werme, Jr., Michael Zwicker, William Cundiff (Town Engineer),
ABSENT: Eben Chesebrough (Vice Chairman - Excused)

1. Pyne Sand & Stone Earth Removal Special Permit, Northeast Main Street: Guard Rail on Monroe Street. Mr. Cundiff stated that one of the conditions in the decision had to do with the guard rail. The proposed plan showed grading right up to the edge of Monroe Street. After he met with Mr. Pyne in the field, Mr. Pyne proposed to not disturb the area where the guard rail would have been installed. Mr. Cundiff spoke to Town Counsel who said that this change could be handled by stating the new plan in a letter.
Mr. Zwicker made a motion that the condition dated July 20, 2014 is satisfied, and that the new plan, dated October 22, 2014, shows no disturbance to the land adjacent to Monroe Street, where the guard rail was proposed. Mr. Greco seconded the motion. Vote: Unanimous.
2. Pyne Sand & Stone Requesting a 3-Year Extension to Special Permit for “Area H”. Mr. Marks stated that “Area H” is off of Lackey Dam Road. Mr. Cundiff stated that this extension is standard procedure. There have been no complaints. The bond is staying in place.
Mr. Zwicker made a motion to approve a 1-year extension for “Area H” at Pyne Sand & Gravel on Lackey Dam Road. Mr. Werme seconded the motion. Vote: Unanimous.
3. Whitin Reservoir Estates: Daily Construction Report. Mr. Cundiff provided a copy of the last construction report. Lori Funari is not planning on doing any more work this year. The issues do not have to be completed this year. Mr. Cundiff stated that the road is not blocked off. The area is safe.
4. Robert Mateer, 93 Webster Street: Request for Extension to Accessory Apartment Special Permit.
Mr. Greco made a motion to approve the Request for Extension to Accessory Apartment Special Permit, Robert Mateer, 93 Webster Street. Ms. Sharkey seconded the motion. Vote: Unanimous.
5. Stormwater Management Bylaw Discussion. Mr. Cundiff stated that he met with the Board of Selectmen (BOS) who inquired about the status of the Conservation Commission and Planning Board meeting on the stormwater bylaw that was proposed a few years ago. They are currently looking at it again. The Conservation Commission is seeking a specific charge from the BOS and what they are looking for so that they can respond. Mr. Cundiff suggested that the Planning Board do the same and he will send a letter to the BOS on behalf of the Planning Board. He will also send the Planning Board members copies of the emails from the EPA regarding the scope of it. Previously the Planning Board took the position that the Town’s current bylaws and permitting procedures satisfy the requirements for the MS-4 permits. A discussion was held.

Mr. Cundiff presented a renewal Accessory Apartment Application, David Windoloski, 48 Orange Street to sign. There are no changes. Taxes are paid.
Mr. Werme made a motion to accept the renewal Accessory Apartment Application for David Windoloski, 48 Orange Street. Mr. Zwicker seconded the motion. Vote: Unanimous.
Mr. Marks presented a copy of the proposed 2015 Meeting Schedule for review. The schedule will be discussed at the next meeting, which will be Wednesday, November 12, 2014.
Mr. Marks mentioned that on November 11, 2014 at 3:00 PM, two Civil War rifles will be rededicated on the Town Common.

MEETING MINUTES: September 23, 2014.
Approval of the September 23, 2014 Planning Board meeting minutes was deferred to the next meeting.

Ms. Sharkey made a motion to adjourn the meeting at 7:31 PM. Mr. Werme seconded the motion. Vote: Unanimous.
