January 13, 2015 Planning Board Meeting

A meeting of the Planning Board was held on Tuesday, January 13, 2015. Mr. Marks called the meeting to order at 7:03 PM and announced that the meeting is being recorded and will be available on cable and on the website.

PRESENT: Ernest Marks (Chairman), Ken Ballou, Michael Greco, Tracy Sharkey, Robert Werme, Jr., Michael Zwicker, William Cundiff (Town Engineer)
ABSENT: Eben Chesebrough (Vice Chairman-Excused)

1. 7:03 PM PUBLIC HEARING CONTINUED: DIANA DUBE (SR141112). Application for a Scenic Road Permit, 69 Oak Street.
Mr. Marks continued the public hearing. Mr. Cundiff has not heard from Ms. Dube. The $50 fine is still outstanding. Mr. Cundiff’s understanding is that Ms. Dube’s mailing address is not the address on the application. He suggested that the notice and related documents be re-sent to her post office box and the Board wait one more month.
Mr. Zwicker made a motion to continue the public hearing, Diane Dube (SR141112), Application for a Scenic Road Permit, 69 Oak Street to January 27, 2015 at 7:30 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

2. 7:07 PM ANR PLAN: TRACY ABADY, 38 Chestnut Street.
Mark Hester joined the meeting. Mr. Cundiff stated that this plan came before the Board in 2006. Lot 2 was submitted as a Lot Frontage Exception Lot. The intent is to carve out a part of Lot 1 and deed it over to become part of Lot 2. Town Counsel told Mr. Cundiff that this ANR does not rise to the point of being a Lot Frontage Exception Plan, because all they are doing is creating Parcel A, which is not a separate buildable lot. Taxes are delinquent for two quarters, however the Town can only withhold endorsements or permits if taxes are delinquent for one year or more. A discussion was held.
Ms. Sharkey made a motion to endorse the ANR Plan, Tracy Abady, 38 Chestnut Street. Mr. Greco seconded the motion. Vote: Unanimous.

MEETING MINUTES: December 9, 2014
Mr. Zwicker made a motion to approve the December 9, 2014 Planning Board meeting minutes as presented. Mr. Greco seconded the motion. Vote: Unanimous.

1. CMRPC – Scope of Work. Mr. Cundiff presented a proposal for CMRPC to do a Build-Out Analysis on the industrial land on the north side of Rte. 16 at no cost to the Town. CMRPC is proposing 27.5 total hours to do the mapping and analysis. Mr. Cundiff will get clarification as to whether or not the expenses are also covered.
Ms. Sharkey made a motion to accept the CMRPC proposal for services for the infrastructure as proposed. Mr. Zwicker seconded the motion. Vote: Unanimous.
2. 69 Oak Street Fine Status. The $50 fine has not been paid. It was the consensus of the Board to defer this discussion until the applicant comes in to the next meeting and the Scenic Road Permit issued is resolved.

Regarding the discussion of Pyne Sand & Stone at the December 9, 2014 meeting, Mr. Marks stated that vibrations felt by Pam Beauregard, 458 Northeast Main Street were due to hammering ledge in the lot next to Pyne.
Mr. Pyne called Mr. Cundiff the day after the meeting (December 10, 2014) and told him that he did speak to his employees about not using Monroe Street.
Budget Reports-The request for FY16 is to level fund. CMRPC’s bill will not be known until the end of the fiscal year. Ms. Sharkey made a motion to level fund and accept and approve the FY16 Planning Board Budget as presented. Mr. Zwicker seconded the motion. Vote: Unanimous.
Parker Road email-Busses do not currently go down Parker Road. It is a private road. The inquirer is asking for the Safety Committee to consider moving forward with making Parker Road a public road so that busses can go down. The issue will be taken up with the Safety Committee. Mr. Marks stated that there is no turn-around on Parker Road. The road is narrow. Mr. Marks does not support busses going down Parker Road.
Shirley Mosczynski, 60 Oak Street, would like to know how the public can be informed of the Scenic Road bylaw. A discussion was held. Information is available when citizens come in and inquire. Mr. Cundiff offered to create a slide for the public access channel listing the scenic roads in town and that mentions the Scenic Road Bylaw. Mr. Zwicker and Roy Swenson suggested the applicant be told the rules of the Scenic Road bylaw when a permit is pulled.
Mr. Zwicker suggested that a sign listing the scenic roads be posted in the office. Mr. Marks feels that a responsible person should find out what the rules and regulations are before any work is done.
Mr. Swenson does not feel that a $50 fine is enough to motivate people to follow the rules and regulations. Mr. Cundiff stated that the fine is dictated in the bylaw. Mr. Marks suggested an agenda item to discuss the adequacy of the current fines.
Mr. Cundiff will call the gentleman on Oak Street to find out the status of his application.

Mr. Zwicker made a motion to adjourn the meeting at 7:43 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
