CONSERVATION COMMISSION MEETING MINUTES
MONDAY, MARCH 16, 2015

A meeting of the Conservation Commission was held on Monday, March16, 2015. Ms. Brown called the meeting to order at 7:05 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Michael Greco, Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

1. 7:05 PM (RDA) PUBLIC MEETING CONTINUED: 93 Linden Street/JOLIN, JASON
Ms. Brown opened the public meeting. Mr. Jolin joined the meeting. The Commission told Mr. Jolin to place standard straw bales, wattles or mulch rolls around the back and sides of the chicken coop. He could use any type of erosion control, other than hay.
Regarding the shed, Ms. Van Roo stated that if the applicant goes with the current plan, then she feels that he will need to file a Notice of Intent with the Commission. The shed is between the 50’ and 75’ buffers. Three-quarter inch stone will be laid down 6”-8” deep and the shed placed on top of that. Mr. Jolin is going into previously undisturbed buffer. Lawn creep was discussed.
Twelve to fifteen small trees would be cut down. Ms. Sharkey would like them marked. She will do a site walk. The Commission would like to see alternative locations for the shed. Alternative locations were discussed.
Ms. Van Roo made a motion to issue a positive RDA for 93 Linden Street, Jolin, Jason. Ms. Sharkey seconded the motion. Vote: Aye-3, No-1.
Ms. Van Roo made a motion to rescind the vote, 93 Linden Street, Jolin, Jason. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Van Roo made a motion to continue the public meeting, 93 Linden Street, Jolin, Jason to April 6, 2015 at 7:45 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

2. 7:36 PM (NOI-DEP #143-0886) PUBLIC HEARING: 74 Main Street/NEW ENGLAND REALTY VENTURES, LLC
Ms. Brown opened the public hearing. She stated that the applicant has asked for a continuance.
Ms. Van Roo made a motion to continue the public hearing, NOI-DEP #143-0886, 74 Main Street, New England Realty Ventures LLC to April 6, 2015 at 8:00 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

3. 7:38 PM (RDA) PUBLIC MEETING CONTINUED: 83 Island Road/VANDENAKKER, DEBORAH
Ms. Brown reopened the public meeting. Ms. VandenAkker joined the meeting and stated that she is requesting permission to remove two pine trees because they are dropping branches and appear to be unhealthy. She will not remove the stumps.
Ms. Van Roo made a motion to issue a negative RDA for 83 Island Road, VandenAkker, Deborah. Ms. Sharkey seconded the motion. Unanimous.

OPEN SESSION:
Mike Yerka of Civil Site Engineering joined the meeting to present the 41 Pine Street draft plan. 41 Pine is the original farmhouse. A discussion was held regarding whether or not the easement was recorded on the lot. Mr. Zisk and Mr. Yerka explained that there are two ANR plans. Mr. Yerka left the meeting.

DISCUSSION:
1. Ross Smith, 151 Davis Street: Request for Extension (DEP #143-0840). This item is an informational update. Michael Fitzpatrick, 55 Southwest Main, and Mr. Smith joined the meeting. Mr. Smith has not done the work because he is thinking of modifying the plan to have less disturbance. Mr. Fitzpatrick spoke about a plan using a smaller detention pond. Once the snow is gone, they can have the topos done. Mr. Smith is very busy with work and would not be able to do the project with the flow of traffic in and out of the property. They will come in with a modified plan before the work begins. This project falls under the Permit Extension Act.
2. James Pyne, 34 & 36 Davis Street: Request for Extension (#DCC-05). Mr. Zisk stated that this permit is outside the jurisdiction of the Commission. The original permit was signed April 2, 2012.
Ms. Van Roo made a motion to grant the extension for 34 & 36 Davis Street, James Pyne (#DCC-05) to April 2, 2018. Ms. Sharkey seconded the motion. Vote: Unanimous.
3. Request for Certificate of Compliance: Francis Beaupre, Cliff Street (DEP #143-0666). This item cannot be done because there is still snow on the ground. There was no discussion.
4. Sign-North Village Covenant & Partial Release of Covenant. The Partial Release of Covenant will not be signed until the project is completed. The Covenant was reviewed and signed.
Ms. Sharkey made a motion to endorse the Douglas Conservation Commission Covenant for North Village, LLC. Ms. Van Roo seconded the motion. Vote: Unanimous.
5. Request for Certificate of Compliance: Matthew and Amy D’Anello, 19 Linden Street (DEP #143-0410). This item was signed.
6. Schedule Site Walk: Yew Street, Lot #4. The site walk was scheduled for April 6, 2015.

OPEN SESSION (Cont.)
Ms. Brown was informed that 135 gallons of diesel fuel spilled at 215 South Street on Sunday. Ms. Brown visited the site and did not see wetlands or evidence of a spill. There is an aquifer on the street line. Mr. Zisk will investigate.

8:19 PM ADJOURNMENT:
Ms. Van Roo made a motion to adjourn the meeting at 8:19 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
